HomeMy WebLinkAbout10/28/68CITY OF HASTINGS O~fice of ENGINEER FAS~E,IGS, M~N~O~A, 55033 MINUTES OF THE HASTINGS PLANNING COMMISSION MEETING HELD OCTOBER 28, 1968 The regular Planning Commission met at 7:30 P.M. at the Hastings Library. We discussed the following subjects: 1. There was a general discussion of the Vermillion River Corps of Engineers plans which I had reviewed with three members of the Planning Commission on Wednesday, October 23rd. I explained to those present that Iwould be present- ing this to the City Council on Monday, November 4th at the regular Council Meeting. The only comment in this regard was from Leigh Nelson, stating that there was a question in his mind whether $500,000 in costs would be justi- fiable for the amount of protection provided. I explained that the Corps of Engineers had run a feasibility report and the project had to be declared feasible be- foreconstruction could take place. Therefore, this matter was left up to the disgression of the Corps of Engineers and their study. 2. The Vince Ralphe request for rezoning for an apartment complex was discussed. The committee report is as follows: "The study committee of Siebrecht and Truax (Nelson absent) reviewed the apartment site plans with Vince iKalphe in his office Saturday, October Z6. The committee had visited the site before this meeting. The committee's findings are as follows: 1) The property is 300 ft. by 207-1/2 ft. or approximately 62,250 square feet; about 1.4 acres. 2) No present access - 2 possible a) Extension of 1 lth Street - this would require negotiating with the School Board. b) He is willing to dedicate 50 ft. for a street along the west side of the property. Problems with this access: 1) He has only a 33 ft. easement over the rear of Held's property. 2) Unless the westerly leg of the access over the Meier property is completed his egress would be directly to Highway 55. Recommendations: 1) That the proposal for rezoning be tentatively approved subjected to the following: Minutes of the Hastings Planning Cormmission 10-Z8-68 Page a) No more than 14 units on the land. (This he has). b) That the access for ingress sewer and water be worked out. 2) That the matter of the ingress for traffic, sewer and water be referred to the engineer for preliminary study of the report" Mr. Siebrecht stated, that basically, the site plan is acceptable. This was amotel-type plan, 14 units, that the area was adequate for 14 units. However, the site plan furnished was a very general one and not very detailed. A motion was made by Councilman Nelson, seconded by Councilman Soleim that the plan be returned to Mr. iKalphe and he is to furnish a detailed plan including sewer, water, traffic and plans to meet uniform building code standards. The Plarming Commission would recommend no action at this time until this was secured from Mr. Ralphe. 3. Attorney Gegen was in regarding outdoor advertizing, in particular, the sign at 18th Street and Trunk Highway 61 on the Peavey Mill property. He is requesting that if the sign be moved south 50' to 75' if it would be acceptable. The Planning Commission moved that it not be allowed. Motion made by Councilman Soleim, seconded by Councilman Karpen. 4. The general review by tfermit Crouch of the proposed sub-division ordinance. The chairman asked what comments any of the members had and started with the City Engineer's report. I reported that under Section 5H Financing, paragraph 1, if this paragraph applied only to lateral improvements within sub-divisions, or took into account also oversized conduits for storm water and sanitary sewer and watermains for areas beyond the sub-division in question. Mr. Crouch stated that this item pertained merely to the lateral improvements, that we would stillhave area ssessments for trunk benefits. He stated the purpose of this financing clause generally, was to not implicate older homes after purchase in future assessments and also to protect the City from sub-division expansions, the cost of which would revert to the City if the sub-divider failed in his financial obligations. The other item I reported was in regard to Paragraph SE, tree planting or street trees. I stated that street trees shall be planted not less than 40 feet apart with a minimum of one per lot. They should be placed 5 to 7 feet outside the property line and not in the side strip or boulevard. The minimum size should measure 3" in diameter at the ground line. No two consecutive trees shall be the same type or variety. Only those varifies approved by the City Engineer will be used. The next item discussed was 7C, Public Hearing on Variances, which should be required. Planning Commission Meeting 10-28-68 Page 3. Sidewalks were then discussed. The following points were made. I am to come up with a recommended working for this part of the ordinance. The subjects are - 1. Main arteries and collector streets shall have 5 ft. sidewalks on both sides. Z. Local streets shall have 4 ft. sidewalks on at least one side, the depth of which shall be 4" of concrete for the sidewalks and 6" at the driveways. The developer must reconstruct sidewalks at driveways when the driveway locations are known. 3. Pedestrian ways shall consist of a paved walkway between streets where pedestrian ways are platted within the sub-division. 4. All public facilities shall be served by sidewalks. 5. All neighborhood parks shall be serviced by sidewalks. The next item discussed was driveways. The engineer recommended that driveways be constructed of concrete, from the concrete curb and gutter section, through the sidewalk on all platted lots to eliminate washing of gravel into the gutter lines after each rainstorm. There was a motion made to present the ordinance to the City Council on November 4th meeting for the first reading. I am to make up those sections of the ordinance which were to be worded by the City Engineer and send copies to Hodne & Associates and all members of the Planning Commission prior to November 4th meeting. It was also decided that the City Attorney, Mr. Don Fluegel, and the Engineer meet with Mr. Ozzie Springsted to discuss the financing section of this ordinance. In our recommendations we should include the following items: 1. The protection of the City in failure of sub-division financing. g. Protect the home buyer from future assessments. 3. To develop consistency for each sub-division, that all sub-divisions will be developed alike. I am to meet with Don Fluegel and Mr. Springsted at 3:00 P.M. on Friday afternoon, October 31, in this regard. Planning Commission Meeting 10-28-68 Page 4. The nex~ item on the agenda was the proposed zoning ordinance. A general review of the entire ordinance was given by Mr. Kermit Crouch. There were a number of items that were discussed in detail, however, it was suggested that each member of the planning commission and those present take the ordinance with them, review it, and make up a list of proposed recommended changes and report back at the next regular Planning Com- mission meeting which will be held Wednesday, November 13, 1968. After the meeting, it was requested by Mr. Grouch that I furnish him with a copy of the zoning of those properties north of Trunk Highway 55 which were platted by metes and bounds descriptions by Mr. Schumacher which contains 1t-3 zoning and also some Commercial zoning. Fluegel, Petersen Guests Present: Davidson, Hallberg, Gu~derman0 Gegen~ l~ichards, Crouch, l~otty The first order of business was the committee report on the l~alphe rezoning petition. After some discussion, it was moved by Nelson, seconded by Soleim, that the petitioner be requested to present to the Planning Commission a more developed plan that should include detailed building plans for the area, proposed traffic patterns for incoming and outgoing traffic, and proposed sewer and water hook-ups to the present utility system. Ayes; all. Mro Charles Gegen appeared in behalf of Strong Advertising and requested a decision on the tentative building permit for the construction of a billboard ' at 18th and Yermilliono After some discussion, it was moved by Soleim, seconded by KarPen, that the building permit not be approved, as was recom- mended in the April 3, 1968 minutes of the pla--lng Commission. Ayes; all. The proposed subdivision regulations was discussed in detail with Mr. Crouch° It was then moved by Nelson, seconded by Moen, that the I~larming Commission recommend that the City Council pass the first reading of the new subdivision regulations on November 4th, subject to revisions to be decided upon Between the first and second readings° ayes; all. The revisions to be proposed will be suggested by Mr, Davidson, the City Engineer and will include the fc~owing points: Section 5, Paragraph H, Financing This is to be proposed in conjunction with Mr. Don Fluegel, City Attorney and Mr. Oo Springsted, City Financial Advisor. Section 5, Paragraph E, Tree Planting Section 5, Paragraph F, Sidewalks The balance of the meeting was a thorough discussion, led by Mr. Crouch, on the proposed zoning ordi-~uceo A motion was made and approved that the bills be paid.
