MINUTES OF THE HASTINGS PLANNING COMMISSION MEETING
HELD WEDNESDAY, MARCH 5, 1969
The meeting opened at 7:30 P.M. without a quorum for the purpose of
Pastor Fair's Haven Homes establishment and Mr. Kent Erickson who is
with Adolphson-Peterson Architects to review a proposed layout for
expansion of the Haven Homes Complex. The proposal is for a three story
complex facing north, four stories facing south, with a garden level at the
lower court with two designs for room accomodations, the purpose being
for married couples living in Haven Homes. One unit would contain only a
breakfast nook, the larger size units would contain an actual dining area.
However, in both cases the larger room residents would have to eat one
meal in the central dining hall and the smaller unit residents would have
to eat two meals in the dining hall.
The next item of business before the regular Planning Commission meeting
was a presentation by Mr. Bruce Rasmussen, Executive Secretary of the
Municipal Commission. The other members of the Municipal Commission
was Mr. Art Swan from Rochester representing out-state communities,
Mr. Bob Ford representing cities of the first class and Mr. Bob Johnson
representing cities not of the first class. Mr. Rasmussen's comments
consisted of the following remarks:
The procedure for annexation can be initiated by the City,by the
Township or by the residents in the area to be annexed.
Application for any annexation must be made to the Municipal
Commis s ion.
A public hearing is held at or near the location for annexation.
The applicant must present his case to the Municipal Commission
justifying the annexation. In the case of the City initiating the
annexation, the Township would then present their case in opposition
to, or in agreement with, the proposed application. Some factors
involved in the Municipal Commis sion' s cons ide ration fo r annexation
would be:
a. The City would provide services to the area to be annexed.
b. Taxes would increase in proportion to the services rendered.
c. That there is a definite need for the services within the
annexed area.
5. In some cases, a professional consultant is hired to provide an
overall plan for annexation by both parties to the annexation.

After the presentation of the case by the annexing parties, all
testimony given at the hearing and the presentation of the case
is considered by the Metropolitan Commission and a ruling is
made for or against annexation or suggested changes to the
boundaries of the annexation.
7. In a case where annexation is initiated by the majority of the land
owners in number within the annexed area, no referendum vote is
necessary.
8. If there is not an intiation by the land owners in the annexed area,
a referendum vote is required and the referendum is carried by
the majority of the voting residents within the arnlexed area.

It was suggested by Mr. Rasmussen that we start laying ground
work to work with the townships involved at an early date so that
the pian has not been formulated before they are involved.
Any area considered for annexation shall be armexed only if it is
urban or suburban in nature.
The tax differential between rural and urban sections within the
municipality should be set up ~h~ad of annexation. This however,
is subject to alteration by the~(~g~ncil of the Governing Body.
The next procedure that could be considered would be one of
consolidation where the townships and cities combine, providing
it has the vote of more than 100' land owners and the City Council,
and a new City is formed.
In case of consolidation, things to be settled in advance would be
who's ordinances apply, how will bonded indebtedness be spread,
if in fact it would be spread, and also there is a 60-day waiting
period to file a petition for referendum vote in case of consolidation.
In general, the new municipality on a consolidation plan would take
the name of the area of highest population density.
Another method of annexation is by ordinance when a majority of
the land owners of the area, less than ZOO acres in size, if not
platted, or if it is platted could be of a larger size than ZOO acres
and there is no objection by the Township involved, the annexation
is approved. However, if it is objected to by the Township, hearings
would be required. The method of annexation by ordinance can only
be done if the area is urban in nature and does require urban services.

The proposed legislation now being considered by the 1969 Legislature
would remove the referendum vote completely from the existing laws.

In any case of annexation, a guarantee that services will be provided
whether a reasonable length of time, would be included in the approval
of annexation.

Mr. Rasmussen suggested that the Metropolitan Council be contacted
to request a study for annexation. This can either be initiated by the
municipality or through the Metropolitan Council. However, the best
procedure would be to request the Metropolitan Council to make said
study through the Municipal Commission.
Mr. Rasmussen stated that he would be glad to work with the City and Townships
involved for any information in regard to legal procedures or to process a
request for study by the Metropolitan Council for these purposes.
Those present at the meeting are as follows: Planning Commission Chairman
Walt Petersen, Secretary Don Fluegel, Councilman Don Hallberg, Orvin Moen,
Councilman Ed Fischer, Leonard Bauer, Skip Soleim, City Officials present:
Mayor Evarist Rotty, Councilman Joe Novak, Secretary of the Chamber of
Commerce Jack Richards, City Engineer John Davidson, Mr. Dick Fox representing
the news media and Mr. Neal Siewert, interested property owner. Mr. Arland
Siebrecht joined the regular Plarming Commission members at the start of the
discussion by Mr. Bruce Rasmussen.
The regular meeting of the Planning Commission was opened by the Chairman
Mr. Petersen. Amotionwas made by Mr. Fischer, seconded by Mr. Soleim
that the minutes of the last meeting be approved. It was moved by Mr. Fischer,
seconded by Mr. Hallberg to recommend preliminary approval of the Haven
Homes proposal subject to review of final plans and conformance to building
requirements and zoning ordinances.
There was a presentation by Mr. Neal Siewert for a proposed extension of
Townsview Estates Addition westerly to the West Corporate Limits. This
presentation was given in two parts:
1. Asking permission to "dead-end" all streets beginning with 17th
Street and ending with gZnd Street. Ail streets to "dead-end at the
West Corporate Limits.
This proposal was objected to by the Commission to allow no "dead-end"
streets by unanimous agreement.
Z. His next proposal was to annex adjacent area, presently outside the
Corporate Limits, that area lying south of 15th Street and adjacent
to the westerly corporate limits, south of 15th Street for the length
of the present Townsview Addition.

The Planning Commission recommended that this possibility be explored by
the developer and that annexation provisions be initiated by present owner
Mr. Walin who owns the property in the area to be annexed.
Mr. Siewert reported that he would approach Mr. Walin in this regard and
possible annexat ion by Council action could be initiated.
The next item on the agenda was a request by Mr. Ray Zimmerman
representing the Farmers Co-op Elevator in Hastings for construction of
a second anhydrous amonia tank to be placed adjacent to, and south, of the
tank that was installed one year ago. A motion was approved by Mr. Soleim
and seconded by Mr. Fischer that the anhydrous amonia tank, adjacent to
and south of the existing tank would be recommended for approval at the
next regular Council meeting. However, Mr. Zimmerman would have to
furnish the City Clerk a copy of the proposed construction and the relation
of the tank to the existing street lines and existing structures in that area.
The same convenants for approval would hold for this tank as those that were
given to the original tank constructed one year ago.
At the regular meeting of August 11, 1967, the following resolution was made:
"Moved by Councilman Soleim, seconded by Councilman Fischer that the
Building Inspector issue a building permit to the Farmers Cooperative
Elevator for the construction of anhydrous amonia (liquid fertilizer) storage
facilities, ayes all, nays, none" 1No other action was taken at that time in
restricting construction of said tank.
The next item discussed was the signs for Livingston Ford Sales, Inc. in
South Hastings. A motion was made by Don Hallberg, seconded by Orvin
Moen that the signs be approved subject to Minnesota Highway Department
approval for location. The fee will be in accordance with the ordinance
regulating signs. Mr. Hallberg had computed the permit fee, the Ford
sign would cost $73.80, the A-1 sign $45.00
The next item discussed was the request by Kingdom Hall to build at the
corner of 4th and Ash, the subject was tabled until after the 1969 Construction
Program hearings set for March 24th and Z5th.
A motion was made by Mr. Fluegel, seconded by Mr. Fischer that the City
Engineer and City Clerk request information from the Minnesota Highway
Department on estimated land use and any economy studies which the Highway
Department would have for the routing on Trunk Highway 55. It was further
suggested that after this information is obtained for the next Planning
Commission Meeting that the time and date be set for a meeting with the
Minnesota Highway Department, Mr. A1 Whitman, County Engineer Mr. Jim
Gabiou and Township Officials from Marshan, Nininger, and Denmark
Townships.

A motion by Mr. Fischer, seconded by Mr. Soleim that the Planning
Commission ~pprow rcdi,~trib~tion 0f 5tare-Aid Funds as presented by
the City Engineer.
A motion by Mr. Fischer, seconded by Mr. Moen to relocate Trunk Highway
55 with llth Street as an alternate solution to the extension of the center island
at that location and that we notify Mr. Van Wermer to be at the hearing
March 17, 1969. Mr. Van Wermer stated he would be at the meeting on
March 17th. Mr. Van Wermer will be down on Thursday, March 13, 1969
to go over the alternate proposal as I presented it over the phone for
relocation of the entrance of Trunk Highway 55 onto Trunk Highway 61.
There was a discussion on the request by Livingston Ford for an address
for their new building in South Hastings. It was suggested that the City
Clerk contact the Post Office, Mr. McGree for a rural route designation
until such time as house numbers have been set in the area of South Hastings.
T here was a unanimous vote to hold the next Planning Commission meeting
on Wednesday, March 1Zth at 7:30 P.M. at the Hastings Public Library.
(Please reserve the Library for this night and make up a notice of the
meeting of March 12th).
There was a motion by Mr. Soleimto adjourn. We completed our meeting
at approximately 10:30 P.M.
