Continued review oi the Proposed Zoning Ordinance was the £irst order of
business with the following recommended changes:

It was decided that this paragraph be divided so that duties,
a~ b~ cs and £ would become part of the City CIerk% responsibilities
and dutiess d and e would become part of the Building Inspector's
responsibilities o

The entire contents of paragraph B will be checked against the
requirement of our Building Code by the City Engineer who will
make his recommendations /or change at the next special meeting
on April S0th,
However, it was suggested that the title o£ Paragraph 1 be changed
to "Building and Occupancy Permit" and that Sub-paragraph c be
eliminated and its contents become Sub-paragraph c of Paragraph 1
with the following changes in content:
"Hereinafter~ no new building or addition and no [and whose use has
been changed shall be occupied until a l.%ilding and Occupancy Permit
has been issued by the City Clerk, Every such permit shall state
that the new occupancy complies with all provisions of this Ordinance.

Page 3, Sub-paragraph S - Permit Fees
This paragraph witl become Paragraph 20
Again, the contents of this paragraph will be checked against the
requirement of the housing code by the City Engineer.
The intent of Hodne Associates regarding the last sentence of this
paragraph will be checked before revision is made.
The balance of the meeting was taken up in the discussion of the Board of
Adjustments and Appeals, The next special meeting will make further
suggestions on this point,

MINUTES OF THE HASTINGS PLANNING COMMISSION MEETING
HELD WEDNESDAY, APRIL 16, 1969
Prior to a quorum being reached, the City Engineer read a letter to the
Planning Commission which was received from Mr. Otto Bonestroo doing
a study for the Department of Administration for the Hastings State Hospital.
This is in regard to the Hastings State Hospital upgrading their present
Sewage Treatment Plant versus the physical connection to the City of Hastings
Sewerage System. This will be taken up separately with the Sewer Committee
and also with the entire City Council for their consideration. The Engineer
reported this to the Planning Commission for their thought and comments.
The regular Planning Commission Meeting started at approximately 8:00 P.M.
Those present:
Chairman Walt Petersen, Mr. Donald Hallberg, Mr. Ed Fischer,
Mr. Leonard Bauer, Mr. Arland Siebrecht, Mr. Clarence Soleim
and City Engineer John Davidson.
Those visiting:
Mr. Paul Birchen who had received a copy of the minutes of the
last Commission meeting and was on hand to answer any questions
that may have arisen since his request for upgrading the service
station at the southeast corner of Spring and Trunk Highway 55.
There being no questions, Mr. Birchen left the meeting.
The Planning Commission continued their review of the Zoning Ordinance, starting
as follows:
Page 2-3, Section VI, Administration and Enforcement, Paragraph A, Zonin~

This entire paragraph shall be changed to read as follows:
"1. It shall be the duty of the City Clerk to administer and enforce
provisions of this ordinance in the following specific areas.
a. Providing zoning information upon request.
b. Receiving applications for building permits, reviewing
such applications to determine if they comply with ordinance
provisions, and issuing or denying permits.
c. Receiving applications for special use permits, variances,
amendments and appeals, referring such applications to the
appropriate agency, notifying affected property owners of
required public hearings, and publishing notice of hearing.

d. Keeping the zoning map and text up to date.
It shall be the duty of the Building Inspector to administer and
enforce the provisions of this ordinance in the following specific
a. Conducting inspections
b. Inv e stigating violations.
Page 23, Paragraph B. Permits
The City Engineer is to check building permit requirements and alter them to
conform to the Uniform Building Code.
Strike in its entirety, subparagraph c under Paragraph 1, Building Permit.
Change subparagraph Z to paragraph 1 c. Occupancy Permit to read as follows:
"Hereinafter, no new building or addition and no land whose use has
been changed shall be occupied until an occupancy permit has been
issued by the City Clerk. Every such permit shall state that the new
occupancy complies with all provisions of this ordinance.
Page 24, Paragraph 3, Permit Fees.
The City Engineer is to alter these fees to fit our present fee system under the
Uniform Building Code. The City Engineer is also to check if the occupancy require-
ment is included in the Uniform Building Code."
Page 24, Paragraph 4, Exhibits
Change this paragraph to read as follows:
"Each application for a building permit and for an occupancy permit
for the use of land shall be accompanied by the following exhibits
un[ess waived or varied by the City Engineer."
Page :~4, Paragraph C. Board of Adjustments and Appeals, subparagraphl
Establishment, subparagraph a. shah read:
"Initially the City Council shall act as a board of appeals until such
time as the Council cannot expeditiously perform this duty."
Change subparagraph a to subparagraph b to read as follows:
"A Board of Adjustments and Appeals may be established at such time
as the City Council may deem it necessary. The Board shall be vested
with such administrative authority as is hereinafter provided or as
provided by State Law. Such Board shall consist of five residents of
the City of Hastings appointed by the City Council which body shall
also name one of the residents to serve as Chairman of the Board of
Appeals. Any member of the Board of Appeals may be removed by a
majority vote of the full City Council at a regular public Council meeting."

Page 25, paragraph 2 Duties, subparagraph a, sha[k read as
"To hear appeals from any decision of the Building Inspector or
City Council."
Page 25, paragraph 2 Duties, subparagraph b:
"To interpret the meaning of the ordinance in cases o£ ambiguity
and to recommend rulings with respect to the application of the
ordinances."
Page 25, paragraph 2 Duties, subparagraph e:
"To hold public hearings as deemed necessary on applications for
variances from the provisions of this Ordinance and to recommend
to act upon such applications, t~
Page 25, Paragraph D, subparagraph 1 shall read:
"To review applications for amendments to this Ordinance. The
Commission shai1 have the authority to act in a purely advisory
manner to the City Council making its recommendation in all cases
referred to it, and transmitting them to such Gouncii for final action
at or before a public hearing is held by the City Council. ~'
Page 25, Paragraph D, subparagraph 2 shall read:
"Applications for special use permits provided for within this
Ordinance and to transmit its recommended action to the City
Council for final action."
Page 25, Paragraph E, Variances, subparagraph 1:
Change granted at the end of the first line to "recommended,,.
This completed the review at this special Planning Commission Meeting.
It was suggested by Councilman Fischer that he would prepare an entire
rewritten section-c, nder Section VI Administration and Enforcement and
submit this to the entire Planning Commission for review at the next
regular meeting of the Commission.
There will be a special meeting of the Planning Commission in the Hastings
Library on Wednesday, April 30th, 1969.
