THE HASTINGS pLANNING GOMMJ~SION HELD WEDNESDAY~ APRIL ~0, 1969 Present: Fischer, Hal[berg, 3ohn Davidson, Walt Petersen It was decided, after some discussion~ to adopt the proposed section on Administration and En/orcement in place of Section VI or Hodne's Proposed Zonin~ Ordinance. The followin~ chan~es were authorized in the proposed section: / 1. The following phrase is to Be added at the end of sentence for Section 5.1: "as set forth Below." / 2. The number Of section 5. Z and 5.3 will become Section 5. I (1) and 5.1 (2). Other sections will Be renumbered accordingly. ./ 3. The sections on Buildin~ and Occupancy Permits and fees are still to Be determined` / 4, Section 5.6 Application Fees The first sentence of 5.4 (4) shall be revised as follows: "These fees shall be payable at the liras applications are filed with the City Clerk and are not re/undable unless application is withdrawn within five (5) days - exclu~in~ weekends o r official holidays - of the date oi submission of the application." / 5o Section 5.8 (1) The phras~ "is constituted" shall be deleted and the phrase "shah function as" shall be substituted. / 6. In the first sentence the phrase "Planning Commission as the" shall be deletedo In the second sentence the term 'P!~.tnR Commission" shall be deleted and the term "Board of Appeals" shah be substituted. Section 5, 8 (6) In the second sentence the word "zoning" shall be inserted between the words "of' ~nd "district", Section 5, 9 (1) The word 'A" at the start of the second sentence shall be deleted and the phrase 'an approved" shall be substituted. Section 5.9 (2) Revise as follows: "Before authorization of any variancesp the application therefor shall be referred to the Building and Zoning Committee of the City Council /or study and recommendation for action by the City Council or returned to the applicant for further in/ormation within thirty (30) days of the date of application," Note: The thirty (30) day interval will have to be approved By the City Clerk and the City Attorney from procedural and legal view points. Section 5.9 (3) and (4) The following sentence shall be added to the end o£ each Section:. "The Planning Comnfission must forward its reco~en~tion ~ ~e Ci~ Co~ci[ ~n t~rty (30) days," Note: AEa~ ~e thir~ (30) ~y ~terval will ~ye .to be approved by ~e City Clerk and ~e City Attorney, Section 5. 9 (6) The phrase "the year or such longer period prescribed by the City Council" shall be deleted from the end of' the second sentence and the phrase 'A one (1) year period" shall be substituted. S~ctinn 5. 10 The following corre~tlon shall be made in the first paragraph; . - ' a) The word "zoning" shall be inserted between the words "the" and "district" in the first sentence, b) The sentence beginning with the words "conditions may be applied shall be rewritten as follows: · . "conditions will be applied ~o the issuance of the permit and an annual review of the permit will be required, ' The next sentence shall be rewritten as follows: "The permit shall be issued for a particular use by a particular person or firm," -2- Minutes of Planning Commission Meeting Held Wednesday, April 50~ 1969 Section 5.11 will be reviewed at the next meeting. It was decided to ask that the City Clerk try to o?;tain as much in/ormation on the following questions before our next meeting. 1 ) Definition, intent, and desirability of the use of a Certificate of Occupancy. Z) Should the City Building Inspector be responsible for the building of new schoot buildings ? In an el/oft to attract more attendance at our meetings0 it was decided to try to hold our next meeting on lvionday~ May 1Z, 1969 at 7:30 P.M. at the Library Meeting Room. MINNESOTA, 55033 MINUTES OF SPECIAL PLANNING COMMISSION MEETING HELD WEDNESDAY, APRIL 30, 1969 The meeting started at approximately 8:00 P. M. Those present: Chairman Walt Petersen, Councilman Ed Pischer, Council- man Don Hallberg, and City Engineer John Davidson. Because of a lack of a quorum, those present acted as a committee of the Planning Commission and reviewed the proposed section on Bui].ding Permits and Section VI - Administration and Enforcement as written by Chairman Walt Petersen. There was stilla question in regard to Issuance of Occupancy Permits. The Planning Commission Chairman was going to contact Hodne & Associates to clarify the intent of an Occupancy Permit and to decide how the change in use of land can be regulated. The following are the changes to Section VI as written: Section 5. 1 - Enforcing Officers, add "as set forth below." Change Section 5.Z to "lA" and Section 5.3 to 5. lB. Page 2, Section 5.6, subparagraph 4, correct to read as follows: "These fees shall be payable at the time applications are filed with the City Clerk and are not refundable unless application is withdrawn within 5 days, excluding weekends or official holidays of the date of submission. There shall be no fee in the case of applications filed in the public interest by the City Council or by the Planning Commission." Page Z, Section 5.8 - Appeals, subparagraph 1, the first sentence shall read: "The Planning Commission shall function as the Board of Zoning Appeals and shall determine, in harmony with the general purpose of this Ordinance and the comprehensive guide plan, by recommendation to the City Council, all appeals from any order, requirement, permit, or decision made by the City Council or the enforcing officers under this Ordinance; ........... " Page 2~ Section 5.8 - Appeals, subparagraph 2, change: Planning Commission to "Board of Appeals." Subparagraph 4, change Planning Commission to "Board of Appeals Subparagraph 5, strike Planning Commission as add to the last sentence after striking Planning Commission "Board of Appeals". Subparagraph 6, insert "Zoning" ahead of district boundary lines ........ " -page 3, Section 5. 9 - Variances, Subparagraph 1, second sentence shall read: "An approved n~ap or plat ........... Subparagraph 2, change the wording in the first sentence request to "application." Add at the end of the sentence ..... "or return to the applicant · ? days of the date of submission." _Page 4, Section 5. 9 - Variances, (cont.) a sentence must be added to this paragraph: "The Planning Commission must act within days." Subparagraph 4, a sentence must be added: '~The Planning Commission must act within days." Subparagraph 6, the second sentence shall read as follows: "A variance shall become void one (1) year after it was granted unless made use of within a one year period." Page 5, Section 5. 10 - Special Use or Conditional Use Permits, add ahead of district - "zoning". Third sentence from the end shall read: "Conditions will be applied to the issuance of the permit and an annual review of the permit is required. The peri, it shall be issued for a particular use by a particular person or firm." The last sentence remained the same. We completed our review at approximately 10:00 P.M. Mr. Walt Petersen had the following notes to pass onto the Planning Commission. First of all that he had approached Mr. Bob Hanson and Mr. A1 Whitman of the Dakota County in regard to annexation procedure. They recommended that the City Mir~utes of Special Planning Commission Meeting Held Wednesday, April 30, 1969 Page 3o Attorney write a lei~er to Mr. A1 Whitman and Mr. Bob Hanson outlining the legal procedure required for annexatiom Mr. Petersen indicated that he had discussed this with Mr. Fluegel who will submit the letter as requested. Mr. Petersen also indicated that on Tuesday, May 13th, at 8:30 A.M. he will meet in Mr. Whitman's office in regard to Trunk Highway 316 and annexation. Mr. Petersen had a request from the owners of Kaercher's Funeral Home requesting an addition for expansion south from the existing structure. The Building and Zoning Chairman, Mr. Hallberg could see no problen~ in allowing expansion in this area for the intended purpose of a funeral home. The next meeting of the Planning Commission will be Monday, May 1Zth, at the Hastings Library at 7:30 P.M. I completed my day at Hastings at approximately 10:30 P.M. John Davidson, City Engineer
