Soleim, Hallberg, and Pete rsen~ Guests Present: 3ohn Davldson and Dick Fox Continuing the discussion of the proposed section on a~nalnistration and Enforce- me,n.t in place of Section 'Fl of Hodnets Proposed Zonin~ Ordinance; the following changes: 1. ) Section 5o 11 Amendments - Subsection 2. It was decided to limit the proposed "Three hundred (300) feet" requirement to'one hundred fifty (150) feet. t' /Z.) Section 5.11 - Sub,~ection 5, Paragraph 2., The paragraph to be stated as follows: "At least ten (10) days before the hearing the City Clerk shall mail an identical notice to the owner and to each of the property owners within one hundred fifty (150) feet of the outside boundaries of the land proposed lo be re=one& . Failure to mail the notice or failure of the property owners to r~ceive the ~otice shall not invalidate the proceedings." 3. ) Section 5.11 - Subsection 6. The second sentence of this subsection shall be stated as follows: "No application which has been denied wholly or in part shall be resubmitted for a period of six (6) months from the date of said Order of Denial. ~' //4.) Section 5~ 1, 1 - Subsection 7.: This subsection will be eliminated and will become the second paragraph of Section 5.11 - Subsection Z and shall be stated as follows: "The petition of the property owner who is applying for an application for remoning shall contain the notarized signature of approval of the owner of at feast sixty-five (65) per cent of the property within one hundred fifty (150) feet of the outer boundaries of the property in question. 5. ) Sect$on 5. 11 - Subsection 8~_ This subsection will be eliminated entirely and this subject wilt be covered in the introduction of the proposed ordinance. Walter Petersen~ Chairman l-lastings ]Planning Commission CITY OF HASTINGS Office ol ENGINeeR MINUTES OF THE HASTINGS PLANNING COMMISSION MEETING HELD MONDAY, MAY 12, 1969 The meeting was held at 7:30 P.M. at the Hastings Public Library. Those present: Walt Petersen, Arlie Siebrecht, Ed Fischer, Orvin Moen, Leonard Bauer, Don Fluegel, Skip Soleim, Jokn Davidson, representative of the Radio Station, Mr. Fox. A motion was passed by Mr. Moen, seconded by Mr. Fluegel to accept the minutes of the last unofficial meeting held Wednesday, April 30, 1969. We continued the review of the suggested rewritten section, Section 5. 11, Amendments, Page 5, as submitted by Chairman Walt Petersen. The following are suggested changes to that section. Paragraph 2, Page 6 - change 300 ft. to 150 ft. Move Paragraph (7) to Paragraph (2) and change to read as follows: "The petition of the property owner who is applying for an application for rezoning shall contain the notorized signatures of approval of the owners of at least sixty-five (65) per cent of the property within one hundred fifty (150) feet of the outer boundaries of the property in question. Correct the second paragraph under 5 to read as follows: "At least ten (10) days before the hearing the City Clerk shall mail an identical notice to the owner and to each of the property owners and to each of the property owners with one hundred fifty (150) feet of the outside boundaries of the land proposed to be rezoned. Failure to mail the notice or failure of the property owners to receive the notice shall not invalidate the proceedings." Paragraph 6, page 6, strike the last sentence after "denial". The question of certificate of occupancy was not discussed in detail. It was decided that the paragraph on definitions would not be reviewed until the total ordinance had been rewritten. Chairman Petersen is in the process of rewriting the ordinance. The Commission reviewed the zoning map as presented by Mr. Hodne. It was suggested that the area "East Hastings" shown as R-3 or R-4 by the City Engineer would be changed to R-Z. This area had been previously designated flood plain Minutes of the Hastings Planning Commission Meeting Held Monday, May 1Z, 1969 Page 2. by Mr. Hodne. The Engineer removed it from the flood plain in order to secure a grant for sewer and water extension in this area for the residents living therein. Next, it was suggested that the zoning I-Z be extended from third and Bailey Streets south to the alley midway between 4th and 5th Street to conform with present land use in that area. Further, it was suggested that the C-3 zone west of and adjacent thereto, be zoned C-3 from Sibley Street to Bailey Street, along the alley line midway between 5th St. and 6th St. It was further suggested that the I{-3 zoning on the Schumacher property on West Trunk Highway 55 north of Trunk Highway 55 and west of Farm Street be rezoned R-l, and that the Doctors' Clinic property south of Trunk Highway 55 and adjacent to the R-3 zone of Valley Manor Addition be zoned C-1. It was suggested also that the C-2 zoning along Trunk Highway 61 (Vermillion Street) be extended west to Spring Street, extending from the south tine of Trunk Highway 55 to one-half block south of 15th Street. It was suggested by the City Engineer that the area adjacent to the industrial park on E. 10th Street, between E. 10th and the Milwaukee Railroad tracks from the easterly line of the industrial park projected north,west to Russell Street be zoned to correspond with the zoning adjacent there- to, which is I-1. It was further suggested that the agricultural zoning of the proposed industrial park be zoned I-1 between the present I-I zoning and the east line of the west one-half of the southwest quarter of Section 35, Township 115, Range 17 to correspond with the 1Z0 acre parcel that was requested by the City of Hastings from the 1969 Eegislature. It was decided that each member of the Planning Commission would review the zoning map, make suggested changes for the next regular Planning Commission meeting which would be held Monday, May 26, 1969 in the Council Chambers, following the adjourned meeting of the Council that evening. The meeting was adjourned at 10:00 P.M. A brief meeting was held of the Building and Zoning Committee. (See minutes as written by Mr. Hallberg. ) I had a request by Councilman Skip Soleim that the Parks Department install the tall fence between the softball diamond and the trainer park. It was also suggested by Councilman Fischer that Mr. Rotty might hold an early meeting of the Council in regard to the Northwest Area Sewer and l~onding Basin.
