The Committee approved the re.commendation for the vacating of Oak Street between 13th Street and 15th Street. with the following conditions: l) Vacate all but 9 feet west of the centerline and I1 feet adjacent to the centerline, said Z0 foot easement to be used for pedestrian Z) Concrete sidewalks 5 feet wide to be by formal petition by abutting property owners, 3) The cost of sidewalks to be shared equally 'By properW owners fronting the sidewalk on each side of Oak Street between 13th and lSth Streets. All costs incidental thereto~ including construction of bituminous curbing through street intersections, and resetting catch basin grates to match vacated portion of the streets. 4) Central Natural Gas Co. wouId have to relocate their gasmains within the 20 £oot pedestrian way or acquire separate easements from property owners affected on the easterly side of Oak Street between 13th and 15th Streets. Any relocation costs would he paid by abutting property owners, It was then moved by Hallberg, seconded by Fischer~ that the Commission recommend that the City Council approve the vacation of Oak Street between 13th Street and 15th Street subject to the forementioned conditions and acceptance of these conditions by the petitioners. Ayes~ all. It was then decided to proceed with the suggested revision of the proposed Zoning O rdinance with the following revis ions: 1) Page I - Paragral~h 5. Remove the word "and" at the end of the paragraph and substitute the following phrase: "Thereby providing for a more orderly transition from a rural to an urban or suburban environment~ and" z) Pa~e 2 - Section 1. 1 - Paragraph 3. This paragraph to be revised so that changes made in the official zoning map can be made without undue map revisions and procedures. Page 7 - Section 3.4. The following phrase to be added to the Minutes of Planning Corm'nission Ivleeting l~fonday, June 9~ 1969 by the Planning Corarnissiono" 4) Page 8'- Section 3. S . The entire section to be replaced with the fo llowing: "Section 3.5 Essential Services Essential services shall be subdivided into two classes for consideration under this ordinance: Governmentally owned and operated and Privately owned and operated° Section 3.5 (i) Governmentally owned and operated essential services shall be permitted as authorized and regulated by State Law and the ordinances of the City of Hastings° It is the intention that these essential services are exempt from the application of this ordinance° Section 3.5 {Z) Privately owned and operated essential services are subject to the provisions of this ordinance unless specifically exempted by a provision of this ordinance~ These essential services are also subject to other ordinances of the City of Hastings as applicable." 5) Page 8 - Sections 3, 6~ .3.7~ & 3.8. These three sections are to be combined and abbreviated into one section. Also~ the class of 'Special 0se Permit - Class Z" is to be introduced into the ordinance to cover such instances where the permit pertains to only engineering procedures and decisions. / 6) Page 10 - Section 5.6. This section to be rewritten to provide more clarity° 7) ~j~e 11 - Section 5.7. This paragraph to be rewritten as follows: "No accessory building shall be erected in any front or side yard, and no separate accessory building shall be erected within five feet of any other building except by issuance of a Special Use Permit - Class 2." 8) Page 11 - Section 5. 11.. This paragraph to be studied by the Commission for possible revision at the next meeting. Referring to the previously revised section of administration and enforcement, the following changes were suggested: 1) Page I - Section 5,2 - Perraits~ Section 5.3 - Permit Fees and Section 5.4 ~ Application Fees. It was generally agreed that Section 5. Z be revised to include Special ~Jse P~rmits - Class I and Special Use Permits - Class 2. Also, it was generatly agreed that these three sections be withdrawn from ~vlinutes o£ the Plan.ning Commission lv~eeting Monday, 5une 9~ 1969 P~ge ~ / z) The next meeting is scheduled to be held on Monday~ June g3rd~ t~be proposed ordinance and combined with all other Permits required by the City into one source o£ information for all concerned. Page Z - Section 5.6 - Appeals°_ This section is to be rewritten completely to allow the establishment o£ an Official Board o£ Appeals if and when the City Council feels that there is a need for such a board. Also, the procedures for making and deciding appeals is to be revised. Page 5 - Section 5o 8 - Special Ose or Conditional Use Permits. 1~nis section is to be rewritten to include Special Use Permit - Class Zo 1969 Walter Petersen~ Chairman Hastings Planning Commission Of{ice of ENC~INEER F~,STING5, ~41NNF~OTA, 55033 MINUTES OF THE REGULAR MEETING OF THE HASTINGS PLANNING COMMISSION HELD MONDAY, JUNE 9, 1969 Those Present: Chairman Wait Petersen, Mr. Soleim, Mr. Fischer, Mr. Siebrecht, Mr. Hallberg. Guests Present: Dick Fox representing K. D.W.A., City Engineer John Davidson The first item was the report of the Study Committee on the vacation of Oak Street, between 13th and 15th Streets. The committee suggested approving the vacation of all but the 9 feet west of the center line and 11 feet adjacent to the center line, said Z0 feet easement be used for a pedestrian way between 15th and 13th streets, that concrete sidewalks 5 feet wide should be constructed in the Z0 foot pedestrian way within one construction season, that a formal petition by the abutting property owners would be a requirement of the vacation, the cost for said sidewalk will be shared equally by property owners fronting the sidewalk on either side of Oak St. and all costs incidental thereto, including construction of bituminous curbing, through street intersections, resetting of catch basin grates to match the vacated portion of the street. Also as a requirement the Hastings Central Natural Gas Company would have to relocate their gas mains within the Z0 foot pedestrian way or acquire separate easements from the property owners affected on the easterly side of Oak Street between 13th and 15th Streets. Any relocation costs as a result of the gas main relocation would be paid for by the abutting property owners. It was suggested that the City Engineer prepare a list of ordinances covered by the City Engineer and City Clerk, such permits as moving permits, septic tank permits, water well permits and any of the special use permits covered by the new Zoning Ordinance. There was a review of the proposed Zoning Ordinance as rewritten by Mr. Petersen. Add to the 5th paragraph on Page 1, this statement: "thereby providing for a more orderly transition from a rural to an urban or suburban environment." Page Z, Section 1. 1 - Official Zoning Map, this paragraph should be rewritten to reference back to an official document stating when any amendment has been made to the official zoning map by amendment to the Zoning Ordinance. The Section Z. Z Definitions, No. 86 should read: Sign, Name Plate or Identifying No. 104 - Use - Non-conforming shall include hedges, trees, shrubs, fences, etc. Minutes of the Regular Meeting of the Hastings Planning Commission held Monday, June 9, 1969 Page Z. Page 7, Section 3.4 - Annexed Territory Replace the period of the sentence with a comma and add "after referral to and recommendation by the Planning Commission". Section 3. 5 - Essential Services See insert "A" Section 3.6, 3.7 and 3.8, change "Special Use Permit" to read: "Special Use Permit - Class 2" This Class Z Permit would be one issued by the City Engineer. Also check existing ordinances in regard to Section 3.7 Mining and to conform ko our present ordinances regulating gravel pits. Section 5.6, Page I0 - rewrite this paragraph regulating fences, hedges, etc. in front and side yards. Section 5.7, Page 11 - rewrite this paragraph to read that no accessory buildings should be erected in any required side or front yard and no separate accessory building should be erected within 5 feet of any other building except by Special Use Permit - Class 2. Also rewrite for [he next meeting Section 5.7 in regard to parking, storage or use or major recreational equipment. We completed our review on Page 11. The review will continue at the next regular meeting to be held Monday, June 23, 1969 at 7:30 P.M. at the Hastings Public Library with Section 6 - Non-conforming lots, etc. The meeting was completed at 10:00 P: M.
