HomeMy WebLinkAbout08/25/69· Copy of Planning Commission minutes and attached phamplet on Design Control sent Don Fluegel and Walt Petersen on 8-26-69 CITY OF HASTINGS MINUTES OF 14_ASTINGS PLANNING COMMISSION MEETING HELD MONDAY, AUGUST 25, 1969 Those present: Wait Petersen (Leaving early), Ed Fischer, Ken Truax, Skip Soleim, Don Hallberg, Don Fluegel. Also present: John Davidson and Mr. Ray Nowicki Although Mr. Nowicki was present, there was not a quorum. Those members present reviewed the preliminary plat as submitted. There was a change over the plat as submitted at the last regular Council Meeting. Mr. Nowicki re- quested permission to return to his original concept, with the following noted requirements: That the streets be platted as shown on the revised concept plan presented the City Council. All streets being 66 foot right-of-way. That the petitions be submitted to the City Clerk for improvements and rezoning. Mr. Nowicki stated that he had submitted the petitions to the City Clerk and that the original plan for building lay-out be altered only by removing the southerly most building on the north-south roadway. There was a motion by Mr. Truax, seconded by Mr. Soleim to give advisory approval of these changes. This was unanimously approved by those members present. Mr. Nowicki then left the meeting. He was advised that he would not have to return to another Planning Commission Meeting. It would be advisable for him to be present at the regular Council Meeting of September 8, 1969. We then had a meeting of the building and zoning committee until the entire Planning Commission arrived. The building and zoning committee discussed requirement of the school board to obtain a building permit for industrial art classes, constructing a garage. The City Engineer was advised that a permit would be required, but that the fee would be suspended. We also discussed the garage variance requested by Mr. Mike Simacek. His original intent was to construct a 24 foot garage, however he would request a variance for a 2Z foot width garage which would be approximately Z feet out of variance. I~: was also suggested that Mr. Simacek submit a petition for adjacent property owners, similar to the one submitted by Mr. Tom Goranson for the last variance approved. After a quorunx had been reached, a motion was made by Fischer, seconded by Truax to recommend to the City Council approval of the Nowicki plan as reviewed by the Planning Commission with Mr. Nowicki. There was a motion by Mr. Fischer, seconded by Mr. Soleim to establish a budget for the 1970 Planning Commission. The Engineer is to submit the necessary forms for the budget. The budget will be as follows: Office Supplies Printing Secretarial help $100.00 2000.00 400.00 Total budget for 1970 $Z500.00 The next item was a proposal that the City Engineer would have his secretary retype the zoning ordinance based on Hodne's outline, with those changes which had been suggested by the full committee of the Planning Commission and to incorporate as much of the rewrite by Mr. Petersen as necessary. This would be ready for the next Planning Commission Meeting on September 2gnd, 1969. The I~lanning Commission reviewed the zoning map. The Planning Commission discussed the area known as East Hastings, the boundaries being, approximately 1st Street on the north, Lake Isabelle on the south, an unnamed street one block east of Lake Street on the east, and the CMSt. P&P Railroad tracks on the west. This entire area would be zoned R-Z. The area bounded approximately by Tyler Street on the west, the alley between 4th and 5th on the south, and the CMSt. P&P Railroad tracks on the east be added to the 1-2 area. This is approximately the area of the Hastings Lumber Mart. The next suggestion was that the C-3 area bounded by Eddy St. on the west, the Mississippi River on the north and the alley between 5th and 6th on the south be extended, that the south line of this area be extended easterly along the alley between 5th and 6th Sts. from Sibley to Bailey Street on the east. It was next suggested that ali the small zones R-3 within the residential I and II areas be eliminated and that the small areas take the zoning of the large area adjacent thereto. These non-complying uses would then be granted Special Use Permits within their zones. One of these areas being the R-3 zone west of Farm north of T.H. 55. It was next suggested that the school property, the 80 acres immediately south of T.H. 55 at the west corporate limits be zoned P.I. (d) An architect (including in the term, landscape architect), construc- tion engineer, builder, or other similarly competent person, resid- ing in the City. NON-REGULAR MEMBERS: (e) A member of thc district citizen's ¢ommitm¢, resident in district, who sits witti and is a member of tile Building Board only with re- spect to a structure to be located within his own district. The members of the BuildingBoard and the district citizens cornmitte(: are appoint- ed by the Mayor with the approval of the City Council. Membership is for a term of one year, commending on the 15th day of Sanuary of each year, except that the l,irst Board and district citizen's committee shall be appointed withiu thirty (30) days of tbe bet thereof shall hold membership until the 15th day el,January next l,ollowing and qualifies. A vacancy on the Board arising by death, removal, resignation or other wise is filled by appointment as above for the remaiuder el, the unexpired term of such member. From each of said districts there shall be appointed as provided above one turc located, or to be located within his own district. Except in such instance, a member of the district's citizen's committee is not a member of the Building Board. The members of the Building Board and the district's citizen's committee serve with- their duties. · (Ref. 106) 48.02. A majority of such Board shall constitute a quor.um and the Board shall elect its own chairman and secretary. Thc Board shall keep a record of its proceedings, shall adopt rules and regulations governing its proceedings, and shall record tlle vote of each member on its l'indings and its determinations, hl case nf absence or disability chairman or acting secretary, who shall act during such period of absence or disa- bility. Whenever an application is filed with the City for a building permit for uti structure to be built, enlarged, or altered within, or moved in or into the City, the building inspector finds said application, plans and specifications, and the plan submitted therewith, hereinafter termed the application papers, comply witl~ thc code of the City except this section, but that said application papers provide structure, the exterior design, appearance and functional plan of which in the opini0a of the building inspector and the City Manager may be, when erected, so at variance or so similar with the exterior design, appearance and functional plan of structu~e~ constrnctcd or in tile course of construction in the neighborhood of said proposed struc- ture which are in the Sallie zoning district as the proposed structure as to cause a mat~ oriel dcp}eciation generally to property in the neighborhood, then the building specter shall within then (lB) days after the receipt of the application papers, file the same and such opinion in writing, signed by the building inspector and the City Mann. get with the secretary of the Building Board. 48.04. Notice to the applicant shall be by registered mail ar least three (a) days in advance of such hear- ing, provided appearance at the hearing shall constitute a waiver of any defect in thc notice thereof. Before or during the hearing, each member may view the premises upon which tho structure is located or to be located, and atrhe hearing the Board shall exa- mine the applicatiou papers and hear the applicant. It may also hear any members of the citizens' committee and any other person who requests to be heard. The Board adjourns from time to time bur within 48 bouts of the close of the hearing the Board shall, pursuant to a majority vote of all the members of the Board, file written find- ings of the fact that thc exterior design, appearance and functional plan of such struc- ture is or is not at a variance or so similar with the exterior design, appearance and functional plan of structures constructed or in the course of construction in the neigh- borhood of said proposed structures, which are in the same zoning district as the pro- posed structure, as to cause material depreciation generally to property in said neigh- borhood. The Board shall further mahe a recommendation that the application be ac- cordingly granted or denied. Such finding, determination and recomnleadationshall be in writing, signed on behalf of thc Building Board by its chairman and secretary. The secretary shall file a copy thereof, certified by him, 'with the building inspector and the City Cloth and shall mail a copy thereof to the applicant. The application papers, the written opinions, and the findings, determinations and recommendations of the Building Board shall thereupon be presented by the City Manager to the City Council at its next regular meeting. Further action with respect to the granting or fusing of a permit with respect rd such application shall be held in abeyance pending · order and direction of tbe Council.
