James Moore Request to Expand a Non-Conforming Use: Mr. Moore requested a building permit to add on a home located in an industrial zone on East 10th Street. Since the use of a variance applies to discrepancies in height, width, etc., it is inapplicable in this case. Motion Jensen, Second Soleim, to recommend de~ying the variance and to deny the issuance of a building permit. All Ayes Note: An alternative could be to re-zone from industrial to residential, however, this land is located in an area of future industrial development. See attached report from Planner. Charles Huberty Application for Special Use Permit to Construct an Apart- ment at the home located at 308 West 13th Street: This land is in an R-2 zone and presently has located in the basement a Barber Shop. The addition of an apartment would create a multiple family dwelling unit, together with a commercial venture all in the same building. It is the recommendation of the Planner that this situation would be detri- mental to the residental neighborhood. Motion Kramer, Second Trautman to refer to a study committee. All ayes. Referred to Hirchert committee. Planner Report Attached. Elmer Lucking Application for Special Use Permit and Variance: Applicant owns .56 acre in an R-2 Zone at Highway 61 and 26th Street. The land is located within 600 feet of an existing sanitary sewer. No geographical Drob~ems are apparent prohibiting hookup to the existing sewer system. Regarding the special use permit for a craft shop. Noneis required as a craft show is a primary permit use within an R-2 zone. Regarding the variance, the Tanner Committee recommends denial of a variance because sewer hookup is not impractible or unreasonable. Motion Tanner, Second Hallbert to deny variance. Downtown Businessmen's Association Plan for Trees on Second Street: The ordinance requires only that a permit be issued by the council allowing installation of trees on a sidewalk. No variance is required. The Hirchert committee still is studying this matter. Hastings Co-op Creamery Request for Expansion of a Non-Conforming Use: The Creamery located at 17th & Vermillion Street is in a C-3 zone, however, thebusiness is industrial in nature. No industrial use is permitted in a commercial zone therefore, the existence of the Creamery does not constitute a non-conforming use. Hastings Planning Commission Meeting Monday, July 8, 1974 Continued Page 2 The Creamery is in the process of replacing a 3000 milk tank with a 30,000 milk tank. The new tank would be vertical whereas the old tank was horizontal. Motion Trautman, Second Kramer to recommend allowance of the installation of the new tank provided that proper footings be installed as required by the council or building inspector, or company engineer. The installation of the new tank is not seen as an expansion of its present facilities, but rather is a replacement of its existing facilities and therefore, does not constitute the expansion of a non- conforming use. All ayes. The creamery further wishes to build an addition to its building. Referred to Tanner Committee. Fee Schedule for Land Use Applications: Motion Soleim, Second Kramer to adopt the attached Fee Schedule. Motion Trautman, Second Stoffel, to amend the motion reducing the fee for a special use permit for primary business from $100.00 to $50.00 and for Secondary business from $50.00 to $25.00. On the Amendment: Voting Aye: Stoffel, Jensen, Trautman Voting NO : Tanner, Linde, Soleim, Kramer and Hallberg Motion to Amend failed 5-3 On the Voting Voting Motion Motion to Adopt this Fee Schedule: AYE: Linde, Hallberg, Kramer, Tanner, Soleim NO: Trautmen, Stoffel, Jesnen Passed 5 - 3, recommending adoption of the attached fee schedule. Rauenhorst Shopping Center: M~. Mar~ton reported that he had met with representatives of Rauenhorst and is in the process of obtaining a more complete site plan, traffic study, storm water run off plan and other engineering and construction information. The matter will be studied upon further receipt of this additional information. A copy of Mr. Marston's report attached. The commission was asked to select 2 alternative dates for a meeting with the City council on the subject of annexation. The commission recommends July 17 and July 23, for such a meeting. DAVID E.
