ADJOURNMENT: Next Regular City Council Meeting on Monday, December 6, 1999 Hastings, Minnesota November 1, 1999 The City Council of the City of Hastings met in a regular meeting on Monday, November 1, 1999 at 7:00 p.m. in the City Hall Council Chambers, 101 4th St. East, Hastings, Minnesota . Resolution No. 10-18-99-Livable Communities 2000 Participation Hastings City Council Minutes of regular meeting of November 1.1999 Page 2 of 4 1997-5 & 1998 Improvements Assessment Hearing Mayor Werner opened the Public Hearing at 7:02 p.m. Public Works Director Tom Montgomery outlined the following projects for assessments: Project No. 1998-01 Montgomery stated that the project cost $1.7 million, $600,000 which will be assessed to the benefitting property owners. Project No. 1998-02-Featherstone Road The cost of the project is $456,600, of which $426,500 will be assessed to the benefitting property owners. Council acknowledged the appeal from Raymond and Vivike Solac of 1403 Featherstone Road. Project No. 1998 -3-10th Street & Walnut Street The cost of the project is $107,700, of which $43,000 is to be assessed to the benefitting property owners. Hearing no further public comments, the public hearing was closed at 7:16 p.m. Resolution No. 10-19-99-Adopting Assessments for 1998 Improvement Program Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to approve Resolution No. 10-19-99 adopting the assessments for the 1998 Improvement Program. 7 Ayes; Nays, None. Project 1997-5-0Id Mill Addition Improvements Mayor Werner opened the Public Hearing at 7:18 p.m. Public Works Director Tom Montgomery informed the Council that Herman Fasbender had requested the delay of the adoption of the assessments. Staff recommended proceeding with the adoption of the assessments. Hearing no further public comment, the public hearing was closed at 7:25 p.m. Moved by Councilmember Simacek, seconded by Councilmember Riveness, to adopt assessments for 1997-5 Old Mill Addition Improvements. 7 Ayes; Nays, None. Resolution No. 10-20-99-Award Contract-Hydropower Trash Rack Cleaner Public Works Director Tom Montgomery stated that after Staff review it is recommended that the bid be awarded to Bracket Greene in the amount of $177,000 for the Hydropower Trash Rack Cleaner. Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to approve Resolution No. 10-20-99 approving the purchase of the Hydropower Trash Rack Cleaner in the amount of $177,000. 7 Ayes; Nays, None. Copy of resolution on file. Award Contract-Civic Arena Reinforce & Enclose Roof Support Beams Parks & Recreation Director Marty McNamara recommended the low bid ofM. G. McGrath Company to reinforce and enclose the roof support beams at the Civic Arena in the amount of $43,670. Moved by Councilmember Riveness, seconded by Councilmember Johnson, to approve the bid of $43,670 to reinforce and enclose the roof support beams of the Civic Ice Arena. 7 Ayes; Nays, None. Hastings City Council Minutes of regular meeting of November 1, 1999 Page 3 of 4 Award Contract-Civic Arena-Inject Preservative Treatment of Exposed Roof Beams Parks & Recreation Director Marty McNamara recommended the Council approve the low bid from Timerland in the amount of $29,907 to inject preservative treatment of exposed roof beams at the Civic Ice Arena. Moved by Councilmember Yandrasits, seconded by Councilmember Simacek, to approve the bid as presented. 7 Ayes; Nays, None. Public Hearing-Amusement License Ordinance Amendment Mayor Werner opened the Public Hearing at 7:28 p~~:_ Administrative Assistant Melanie Mesko stated that this amendment is requested to allow the Council to set the license fee by resolution rather than ordinance. Hearing no public comment, the public hearing was closed at 7:29 p.m. Moved by Councilmember Riveness, seconded by Councilmember Yandrasits, to approve the first reading and order a 2nd reading and adoption of amusement license ordinance amendment changes at the November 15, 1999 Council meeting. 7 Ayes; Nays, None. Industrial park Economic Impact Study City Administrator Dave Osberg requested approval to undertake an analysis of the Industrial Park to be conducted by Springsted in the amount not to exceed $12,100. Osberg stated that the study should be completed by the end of 1999 and its goal is to determine what the value is of the industrial park land and what is the best and highest use for the land. Moved by Councilmember Simacek, seconded by Councilmember Hicks, to approve the Industrial Park Economic Impact Study at a cost noHo exceed $12,100. 7 Ayes; Nays, None. Resolution No. 10-21-99-2000/2001 Goals Program City Administrator Osberg recommended approval of a resolution identifying the work plan for the City of Hastings City Council and City Staff for the years 2000 and 2001 as listed: 1. Improve overall communications with the public and internally with the City Council and City Staff 2. Complete the comprehensive plan 3. Determine the City's role with the Highway #61 bridge, Highway #316 and Highway #61 redevelopment 4. Continue to work with the Red Rock Corridor committee Qn commuter rail options 5. Select a site for a senior housing facility 6. Continue to work on river front development and Lake Rebecca 7. Develop a human asset plan for the City 8. Implement the recommendations of the space needs study 9. Develop a five year road and infrastructure plan 10. Consider economic development option for the City 11. Search for property for a second fire station and other possible City uses Moved by Councilmember Johnson, seconded by Councilmember Simacek to approve Resolution No.1 0-21-99 for the 2000/2001 Goals Program. 7 Ayes; Nays, None. Approve Request for Bids-Insurance Agent of Record City Administrator Osberg stated that the Administrative Committee of the City Council is recommending that the City Council approve the solicitation of proposals for providing insurance services to the City. Moved by Councilmember Hicks, seconded by Councilmember Riveness, to approve a request for bids for the insurance agent of record. 7 Ayes; Nays, None. New Business Mayor Werner thanked the public in attendance for their patience during the recent utility and road improvement projects in their neighborhoods. Reports From City Committees, Officers, Councilmembers Councilmember Hicks reported that, as a member of the Red Rock Corridor Committee, the committee is developing a plan a for commuter rail study from St. Paul to Hastings to be developed in the next year. BACKGROUND MediaOne and AT&T has entered into an Agreement whereby MediaOne will merge into a wholly owned subsidiary corporation of AT&T. MediaOne and AT&T have submitted an application for the consent to change control of the existing MediaOne Cable Franchise in Hastings. As a result of the merger, there will be a new parent company, however the existing MediaOne Subsidiary which currently holds the franchise in Hastings will continue to do so and will continue to be responsible for all obligations contained in the franchise. Currently staff is working with Coca-Cola, the school district, and local businesses on promotions and sales. · Daily Admission Daily $5. The change will occur in the time available to rent the aquatic center. The 2000 season will allow for patrons to rent the facility from 8:45 PM - 11 PM. This is an hour and one-half later than the 1999 season. · Family Swim Wednesday evenings from 5 PM - 8:30 PM will be designated for family swim. This time will allow for families to use the aquatic center exclusively. · Teen Night One Friday night a month will be designated "Teen Night". This will allow 13-17 year olds to use the facility exclusively. Activities proposed would include a DJ, rame drawings, and various contests. DATED: Council Member introduced the following Resolution and moved its adoption: WHEREAS, the city owns and operates a baseball field in the Veterans Athletic Complex; WHEREAS, this baseball field is also used by the Hastings Hawks baseball club as its "home field"; WHEREAS, the city has budgeted certain monies for improvements to this baseball field for the year 2000; WHEREAS, Hastings Hawks would like to expedite adding improvements to the field, such as the purchase and installation of an electronic scoreboard, construction of a grandstand facility, press box and public address system, two foul poles and some minor landscaping; WHEREAS, all of these improvements exceed the $20,000.00 that is presently budgeted for improvements to the baseball field for the year 2000; WHEREAS, Hastings Hawks have approached the city seeking permission to raise funds and purchase some of the added features that have not been budgett;:d by the city; WHEREAS, Hastings Hawks have approached the city seeking permission to purchase these items for the ball field if the Hastings Hawks are successful in their fund raising efforts; and WHEREAS, additionally, the Hastings Hawks have asked permission from the city to allow a major contributor to name the field in return for a substantial contribution. NOW THEREFORE BE IT RESOLVED by the Hastings City Council as follows: ., 1. If the Hastings Hawks are able to raise sufficient money to purchase an electronic scoreboard, the city will allow the Hastings Hawks to install an electronic scoreboard which has been approved by the city council. The design of the scoreboard must be approved by the Hastings City Council before it is installed. In this event, the city will also allow the Hastings Hawks to sell up to three advertising spaces (4 feet x 12 feet) on a ten year agreement. The monies received by the Hastings Hawks for these advertising spaces, must be used for the purchase of the scoreboard. 2. If the Hastings Hawks are able to secure a major contributor ($150,000.00 or more), the city will agree that the major contributor will be able to name the baseball field, subject to the approval of the name by the Hastings City Council. This major contributor will also receive appropriate recognition on the scoreboard, again subject to Hastings City Council approval. Any signs used to name the baseball field shall be purchased by the Hastings Hawks or someone other than the City of Hastings. 3. If a major contributor does not wish to name the ball field, they shall be under no obligation to do so. 4. If a maj or contributor wishes to name the baseball field, the field shall have that name for a minimum of 10 years. The work schedule for LCMR grant the City received to connect the Riverfront Trail to the Lock and Dam Trail calls for construction of the trail to begin in 2000. Staffhas also be working with the Corps of Engineers to reconstruct the access road as part of the trail construction. The Corps of Engineers have agreed to fund one half of the road construction. The City has also applied for a $400,000 federal grant to assist in the road construction. Staff is proposing a 2000 construction project that would include reconstructing the access road and extending the trail. COUNCIL ACTION REQUESTED . Concept Plan Council is requested to approve the concept plan with regards to road and trail locations so that design of these improvements can proceed. . Consulting Services . Council is requested to authorize the City to contract with an engineering consulting firm for the feasibility study and design ofthe road and trail improvements. . Matching Grant Commitment The LCMR grant for the trail requires a $155,000 matching contribution. Council is requested to commit to this matching contribution. Special conditions and circumstances that exist which are peculiar to the land, structure, or building involved are as follows; 1. To the best of our knowledge, the lower portion of our home was built in the 1850' s and consisted of a limestone structure set into the side of a limestone formation. 2. Sometime in the early 1900's the home was expanded to the west and to the south, building on top of the hill that the original home was set into. In so doing, a stair well was constructed along the east wall skirting the naturally occurring limestone formation leading to the upper portion of the rear of the building. 3. Unlike other structures with full basements or ~jnder block walls, our home is built over a partial basement (41' by 21') with two adjoining crawl spaces to the south (rear) and west of the lower portion of our home. (Note: The lower portion of our home is our master bedroom, full bath, and media room, with Egress window and front door.) B. Literal interpretation of the City Code would deprive us of an existing interior stairwell, which has been in use since the upper portions of this structure, were constructed. C. The situation of the lower portion of our home, the crawl spaces, and the naturally occurring limestone hill that our home is set into are not the result of actions of this applicant. D. Granting this variance will not confer any special privilege as these conditions have existed and have been in use before the current City Code was adopted. Having to change this design would cause us to extremely alter the appearance, the use of, and the mechanical design (plumbing, electrical service, and heating) of our structure. =~~. This revision was not intended to alter the original intent of the code chapters, only to update and clarify the existing approved chapter language. Please contact me if you have any questions or recommendations. jt CHAPTER 17 STRUCTURE MAINTENANCE CODE FOR RENTAL RESIDENTIAL PROPERTIES SECTION 17.01 - SHORT TITLE. This Section may be cited as the "City of Hastings Structure Maintenance Code," or the "Structure Code. " SECTION 17.02 - POLICY, PURPOSE; INTENT. Subd.1. Policy. It is the policy of the City to enhance the supply of safe, sanitary and adequate structures for its citizens and to prevent the deterioration of the existing structures of the City. Subd.2. Purpose. The purpose of this chapter is to carry out the policy stated in Section 2.1 by establishing minimum standards, and procedures for their enforcement consistent with the right to personal privacy, for the protection oflife, limb, health, property, safety and welfare of the general public and the owners and occupants of residential buildings. Subd.3 Obiectives. The objectives of this Code include, but are not limited to, the following: A Protection and preservation of the stability and character of residential areas in the City. B. The prevention and correction of structure conditions that adversely affect the life, safety, health and general well-being of persons occupying dwellings in the City. C. The establishment of minimum standards for light, ventilation, cooling, heating and sanitary equipment necessary to insure the health and safety of occupants of rental dwellings. D. The establishment of minimum standards for the maintenance of rental residential dwellings. E. The prevention of the emergence of blighted and deteriorating structures in the City. F. The prevention of overcrowding of rental dwellings. G. The preservation of the value of land and structures in the City. 1 Subd.4. Intent: Relation to the Provisions of City Code. The City Council intends that the Structure Code be an integral part of the City's program of health, safety, building and land use regulation. This Code is to be construed liberally in conjunction with other provisions of the City Code to give effect to the policy, purpose and objectives of this section, but is not to be construed to modify, amend or otherwise alter the provisions of the City Code relating to health, safety, structure.or land use regulation. SECTION 17.03 - ADOPTION OF UNIFORM HOUSING CODE BY REFERENCE. Subd,1. Code Adopted. Chapter 4,5,6,7,8,9 and 10 of the Uniform Housing Code, 1991 Edition (the "Uniform Housing Code") published by the International Conference of Building Officials is, except as modified or amended herein, adopted by reference and is made a part ofthis Code as if fully set out at length. Subd.2. Copy on File. One copy of the Uniform Housing Code, together with a copy of this Code, must be kept on file in the office of the City Clerk and available for public inspection. The Clerk and the Housing Official must keep a reasonable number of additional copies of the Uniform Housing Code and this Code available for use and inspection by the public at reasonable times. SECTION 17.04 - DEFINITIONS. Subd.1. General. For purposes of this Code the terms defined in this Section have the following meanings given them. "Code" or "This Code" means the Structure Maintenance Code; "City Code" means the Hastings City Code; "Building Code" means Chapter 4 of the City Code; "Zoning Ordinance" means the Chapter 10 of the City Code. "Common Areas" means halls, corridors, passageways, utility rooms, recreational rooms and extensive landscaped areas, not under the exclusive control of one person or family, in or adjacent to a multiple dwelling. The terms "Compliance Official and "Corporation Counsel", where those terms are used in the Uniform Housing Code, mean the Community De';elopmcnt Director Suoervisor of Inspections & Code Enforcement and City Attorney, resp~vely. "Dwelling" means a building or a portion of a building designed for residential occupancy: the te1'II1! includes a single-family, two-family and multiple-family dv;ellings including apartments. condominiums. hotels, motels and "Bed and Breakfasts". 2 "Dwelling Unit" means: A a single-family dwelling,aad B. a discrete portion of a dwelling designed for occupancy by one family. "Housing Official" means Community Development Director Supervisor of Inspections & Code Enforcement or designee. "Operator"- Buildini! Manai!er or owner representative chal1!ed with the maintenance or operation of the buildini!. "Owner", "Owner-Operator" or "Operator" means any~p_erson, firm or corporation who alone. jointly. or separately with others is in actual possession of or has charge. care or control of a dwelling or dwelling unit or structure in the City as owner, employee or agent of the owner or as trustee or guardian of the estate or the person is the title holder. and such person is bound by the provision of this Code to the same extent as the owner. "Rental Residential Property" means an occupied single or multi-family rental dwelling unit that is let to a party other than the registered owner of the, property. "Repair" means to restore to a sound acceptable state of operation, serviceability or appearance. "Replace" means to remove an existing item or portion of a system and to construct or install a new item of similar or newer quality as an existing item when repair of the existing item is impractical. "Structure" means that which is built or constructed. an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner. Subd.2. Relation to Other Code Definitions. Except as expressly provided in this Code, words, terms and phrases used in this Code have the meanings given them by the City Code. In cases where conflicting definitions of a word, term or phrase make its precise meaning unclear in its application to particular facts, the City Administrator shall resolve the definition. SECTION 17.05 - APPLICATION Subd.1. General. This code applies to Rental Residential Properties including: structures, their premises, accessory structures thereto, and dwelling units therein, used or designed to be used for human habitation or storage. 3 Subd.2. Existing Structures. A building lawfully existing under the Uniform Building Code must conform to this Code. A building need not be altered or changed to exceed the requirements of the Uniform Building Code in effect at the time of its construction, except in the following cases: . A if the structure is altered or enlarged pursuant to Uniform Building Code; B. if the structure is moved or relocated; or C. if the structure is determined to be unsafe or hazardous by the Building Official pursuant to the Unifonn Building Code, UBC Appendix Chapter 34 Life Safety requirements for existings.structures, Division I. Occupancy in structures lawfully existing under the Building Code may be continued under this code. SECTION 17.06 - DUTIES OF OWNERS AND OCCUPANTS. Subd.l. Sanitation. '(he occupant of a dwelling or dwelling unit must maintain in a clean and sanitary condition that part of the dwelling, dwelling unit and yard that the occupant occupies and controls; and is responsible for the occupant's own misuse of areas and facilities available in common. The owner or operator of a two-family dwelling or multiple dwelling must maintain in a clean and sanitary condition the shared or public areas of the dwelling and yard. The occupant ofa dwelling unit must keep all mechanical equipment and appliances, including furnace, water heater, plumbing fixtures, air conditioner, stove, refrigerator, dishwasher and thelike in a clean and sanitary condition and is responsible for the exercise of reasonable care in their proper use and operation. Subd.2. Removal of Waste Matter. The occupant of a dwelling unit must dispose of rubbish, ashes, garbage and other organic waste in a clean and sanitary manner as required in.Chapter 9 of the City Code. The owner or operator ofa multiple dwelling is responsible for the clean and sanitary maintenance of common storage or disposal facilities and must dispose of rubbish in a clean and sanitary manner as required in Chapter 9 of the City Code. Subd.3. Pest Extermination. The occupant or owner of a single dwelling unit is responsible for the extermination of vermin infestations or rodents on the premises. The occupant or owner of a dwelling unit in a building containing more than one dwelling unit is responsible for such extermination when the dwelling unit is infested. When infestation is caused by the failure of the owner or occupant operator to maintain a building containing dwelling units in a reasonable rodent-resistant or reasonably vermin-resistant condition, pest extermination is the responsibility of the owner or operator. After extermination it is the responsibility of the owner or occupant operator as the case may 4 be, to correct such maintenance or other problems to provide evidence that the infestation has been eliminated and steps have been taken to prevent reoccurence as designated by appropriate City officials to eliminate the source of the infestation. If infestation exists in two or more dwelling wilts in any dwelling, or in the shared or public parts of any dwelling containing two or more dwelling units, pest extermination is the responsibility of the owner or operator. Subd.4. Heat. The owner or operator of a building containing two or more dwelling units must supply facilities capable of providing adequate heat to every habitable room therein; for the purposes of subdivision "adequate heat" means heat sufficient to maintain a temperature of70 degrees Fahrenheit at a height of three feet above the floor in all habitable rooms, bathrooms and water closet compartments. Subd.5. Utilities. Except as otherwise provided by law, an owner, operator or occupant may not cause service equipment or utility service that is required by this Code to be removed, shut off or discontinued for any occupied dwelling let or occupied by that person, except for such temporary intenuption as may be necessary while actual repairs or alterations are in process or during temporary emergencies. Subd.6. Transfer of Responsibility. A contract between owner and operator, operator and occupant, or owner and occupant, with regard to compliance with this Code, does not relieve the owner or operator of a duty imposed by this Code. Subd.7. Notice of Maximum Occupancy. An owner or operator must advise the occupant, in writing, by insertion in the lease between the parties or otherwise, the maximum number of occupants permitted in occupied premises subject to this Code. SECTION 17.07 - ADMINISTRATION; ENFORCEMENT; INSPECTION. Subd.1. Administration and Enforcement The Community De'/clopmcnt Director Supervisor of Inspections & Code Enforcement (Housing Official) is responsible for the administration and enforcement of the Code. Subd.2. Compliance. When the Housing Official determines that there exists in a building or a portion thereof conditions that constitute a violation of this Code, the Housing Official may begin enforcement procedures. SECTION 17.08 - LICENSING OF RENTAL UNITS Subd. 1. General Rule. Owners of rental dwelling units shall be required to obtain a license. The license is issued each year and expires on the anniversary date of issuance. An application for license renewal must be filed at least 90 days prior to license expiration date. 5 Subd. 2. Application. This section is intended to provide standards for licensed rental housing and to allow resolution of complaints regarding licensed rental housing. All rental dwellings shall conform to the requirements of this ~ection, without regard to when it was constructed, altered or repaired. This section establishes minimum standards for maintaining rental dwellings and their accessory structures and related premises. Subd. 3. License Fees. Owners of rental dwellings shall pay an annual license fee. License fees are due 60 days prior to the license expiration date. License fees are due upon occupancy of new rental dwelling units. License fees are set by Resolution adopted from time to time by the Hastings City Council. Subd. 4. Conditions. A license is non-transferable. The license fee is not refundable upon revocation or suspension. The license fee is refundable prorated monthly, upon proof of transfer oflegal control or ownership. Subd. 5. Licensing Phase-In Policy. Commencing on August 1, 1999, initial licensing inspection will begin according to inspection areas established by the Housing Official. Subd. 6. Application Information. Applications for a license or renewal of a license must be made by the owner of a rental dwelling. Application forms are filed with the Housing Official. The application form must supply: A Name, address and telephone number of dwelling owner, partners if partnership, corporate officers if corporation; B. Name, address and telephone number of designated resident operator or agent, if any; C. Name, address and telephone number of vendee, if the dwelling is being sold through a contract for deed; D. Legal address or parcel number of the dwelling and Parcel Indentification number: E. Number of dwelling units \vith the d'llclling; and or rental units. F. Description of procedure by which tenant inquiries and complaints are to be processed. Subd. 7. Notice of Change. The licensee must give notice in writing to the Housing. Official within five business days after any change of information in the application. Notice of transfer of ownership is governed by Subd. 12. Subd. 8. Resident Agent Required. An operating license will not be issued or renewed for a non-resident owner of rental dwelling units (an owner who does not reside in any of the following Minnesota Counties: Hennepin, Ramsey, Anoka, Carver, Dakota, Goodhue, Scott or Washington) unless the owner designates in writing the name of a resident agent or operator( an agent who does reside in one ofthe aforementioned counties) who is: 6 A Responsible for maintenance and upkeep; B. Legally constituted and empowered to receive service of notice of violation of the provisions of City Ordinances, to receive orders and to institute remedial action to effect such orders; and . C. To accept service or process pursuant to law. The Housing Official must be notified in writing by the owner of a change of resident agent. Subd. 9. Conformance to Laws. An operating license will not be issued or renewed unless the rental unit and its premises conform to this Section, the ordinances of the City and laws of the State of Minnesota. Subd. 10. Inspection Condition. An operating license will not be issued or renewed unless the owner of the rental unit agrees in the application to pennir-inspection pursuant to Section 17.09. Subd. 11. Posting of License. The licensee of a building containing three or more dwelling <, units must conspicuously post the current license in the main entry way or other conspicuous location in a frame with a glass or plastic cover. Subd. 12. Transfer. The licensee must give notice in writing to the Housing Official within five business days after having legally transferred or otherwise disposed of the effective control of licensed rental property. The notice must include the name and address of the person succeeding to the ownership or control of the rental dwelling or dwellings. Subd. 13. License. Suspension and Revocation. An operating license is subject to suspension or revocation by the Housing Official or designee if the licensed owner fails to operate or maintain licensed rental dwellings and units therein consistent with this Chapter. Suspension or revocation of an operating license may be appealed pursuant to provisions of Section 17.14. If an operating license is suspended or revoked by the staH: it is unlawful for the owner to permit new occupancy of vacant rental units until a valid operating license is issued by the City. Source: Ordinance No. 423 Effective Date: 12-15-97 SECTION 17.09 - ENFORCEMENT AUTHORITY Subd.I. Inspection Authority. The Housing Official may inspect on complaint, change in ownership, or otherwise when reason exists to believe that a violation of this chapter has been or is being committed. Except in the case of emergency, inspections must be conducted during reasonable daylight hours. The Housing Official must present evidence of official authority to the occupant in charge of a rental dwelling unit. 7 Subd.2. Inspection Access. If an owner, occupant, or other person in charge of a dwelling unit licensed under this section fails or refuses to permit free access and entry for inspection purposes; the Housing Official may, upon a showing of probable cause, obtain . orders from a court of competent jurisdiction for the inspection. SECTION 17.10 - MINIMUM REQUIREMENTS; IMPLEMENTATION STANDARDS; POLICIES Subd.1. Minimum Requirements. The minimum requirements imposed by this Code include those standards or requirements in effect on the date of the construction ofa building subject to this Code. It is not the intention of this Code to require all buildings to be upgraded to meet all requirements of the present Building Code. Subd.2. Implementation Standards. In administering this Code, the Housing Official will treat the following as conditions constituting an immediate hazard to health and safety: A. heating systems, woodbuming stove, fireplaces, oil burners and alike, that are unsafe due to: burned out or rusted heat exchanger (fire box); burned out or plugged flues; not being vented; being connected with unsafe gas supplies; or being incapable of adequately heating the living space; B. water heaters that are unsafe due to: burned out or rusted out heat exchanger (fire box); burned out, rusted out, or plugged flues; not being vented; being connected with unsafe gas supplies; or lack of temperature and pressure relief valves; C. electrical systems that are unsafe due to: dangerous overloading; damaged or deteriorated equipment; improperly tapped or spliced wiring; exposed uninsulated wires; distribution systems of extension cords or other temporary methods; ungrounded systems; ungrounded appliances in contact with earth; D. plumbing systems that are unsanitary due to: leaking waste systems fixtures and traps; lack of water closet; lack of washing and bathing facilities; or cross connection of pure water supply with fixtures or sewage lines; E. structural systems, walls, chimneys, ceilings, roofs, foundations and floor systems, that will not" safely cany imposed loads; F. refuse, garbage, human waste, decaying vermin or other dead animals, animal waste, other materials rendering it unsanitary for human occupancy, including lack of light and air; 8 G. infestation of rats, insects and other vennin. Subd.3. Foundations. Exterior Walls and Roof. The foundation, exterior walls, and . exterior roof shall be substantially water tight and protected against vermin and rodents and shall be kept in sound condition and repair. The foundation element shall adequately support the building at all points. Every exterior wall shall be free of deterioration, holes, breaks, loose or rotting boards or timbers, and any other condition which might admit rain or dampness to the interior portion of the walls or to the exterior spaces of the structure. The roof shall be tight and have no defects which admits rain, and roof drainage shall be adequate to prevent rain water from causing dampness in the walls, All exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by paint or other protective covering or treatment. Subd.4. Exterior Doors and Windows. Every window, exterior door, and other exterior openings shall be substantially tight and shall be kept in sound condition and repair. Every window, other than a fixed window or storm window, shall be capable of being easily opened.. Every window, door and frame shall be constructed and maintained in such relationto the adjacent wall construction as to completely exclude rain, wind, vermin and rodents"from entering the building. Garages attached or detached shall have a fully operational overhead door or barn-type doors. SECTION 17.11 - REPORTING: FORMS: RECORDS. The Housing Official must prepare forms and certificates necessary to carry out the provisions of this Code. The Housing Official must design appropriate systems of accumulating or organizing and cataloging data relating to the condition, adequacy, and availability of rental residential housing in the City and must report on these matters fr9m time to time to the City Council at its request. The Housing Official's report must also contain recommendations for modifications in the provisions of this Code and its administration. SECTION 17.12 - HAZARDOUS CONDITIONS: BUILT-IN DEFICIENCIES: PROCEDURE. Subd.l. Procedure. If the Housing Official determines that there exists in a building a condition that constitutes an immediate hazard to the health and safety of its occupants, the Housing Official may: A issue a compliance order requiring immediate compliance if the condition can reasonably be corrected; B. proceed against the building pursuant to applicable City Code provisions and state laws relating to hazardous or unsafe structures; or 9 C. recommend that the City Council proceed to correct the condition by abating it as a nuisance under Minnesota Statutes, Section 429.101, and this clause is to be construed 'as authorizing the imposition and billing of charges for the cost thereof and the assessment of unpaid charges against the property on which the building is located in the manner provided by Minnesota Statutes, Section 429.101. Subd.2. Built in Deficiencies. It is determined that certain conditions within existing buildings, lawful at the time of the construction of the building, may not comply with the minimum requirements of this Code. Such conditions are herein referred to as "built-in deficiencies", and the Housing Official, in administering the Code, must consider the following built-in deficiencies as being beyond reasonable correction: A Ceiling Heights: An existing habitable room with less than a seven foot six inch ceiling height. B. Superficial Floor Area: An existing habitable room with less than 90 square feet. C. Natural Light and Ventilation. An existing habitable room with window area less than 10 percent of the floor area provided, however, that in no case may the required area of light and ventilation be less than 5 percent of the floor area. SECTION 17.13 - lNSPECTIONS. Subd.1. Records. Except in the case of emergency, inspections must be conducted during reasonable hours. The Housing Official must present evidence of authority to the owner or occupant in charge of a dwelling unit. Subject to the provisions of law, the Housing Official must keep evidence, exclusiv~ of the inspection records, discovered or obtained in the course of an inspection confidential. Subd.2. Unfit for Human Habitation. A dwelling, dwelling unit or rooming unit or portion thereof that is damaged, decayed, dilapidated, unsanitary, unsafe, vermin or rodent infested or which lacks provision for basic illumination, ventilation or sanitary facilities to the extent that the defects create a hazard to the health, safety and welfare of the occupants or of the public may be declared unfit for human habitation. If a dwelling, dwelling unit, or rooming unit has been declared unfit for human habitation, the Housing Official must order the same vacated within a reasonable time and post a placard on same indicating that it is unfit for human habitation. 10 Subd.3. Correction. It is unlawful for a dwelling. dwelling unit or rooming unit or portion thereof to be used for human habitation until defective conditions have been corrected and written approval has been issued by the Housing Official. It is unlawful to deface or remove the declaration placard froin a dwelling, dwelling unit or rooming unit. Subd. 4. Secure Unfit and Vacated Dwellings. The owner of a dwelling. dwelling unit, or rooming unit that has been declared unfit for human habitation or that is otherwise vacant for a period of 60 days or more must make the same safe and secure so that it is not hazardous to the health, safety and welfare of the public and does not constitute a public nuisance. A vacant dwelling open at doors, windows, or wall opening. if unguarded, is deemed to be a hazard to the health, safety and welfare of the public and a public nuisance within the meaning of this Section. Subd.5. Hazardous Building Declaration. If a dwelling has been declared unfit for human habitation and the owner has not remedied the defects within a prescribed reasonable time, the dwelling may be declared a hazardous building and may be removed, razed or corrected pursuant to City Code Section 4.05 and provisions of Minnesota Statutes, Sections 463.15 and 463.26. Subd.6. Compliance Procedure: Order. If the Housing Official determines that a rental dwelling, rental dwelling unit or rooming unit or portion thereof is in violation of an order of this Code, the Housing Official may issue a Compliance Order setting forth the violations of such and ordering the owner/occupant, operator or agent to correct such violation. The Compliance Order must: A be in writing; B. describe the location and nature of the violations of this Section; C. establish a reasonable time for the correction of the violation and notify the owner of appeal procedures; D. be served upon the owner, owner's agent, or the occupant, as the case may be: the notice is deemed to be properly served upon owner or agent, or upon any such occupant, if a copy thereof is: 1. served upon the owner or agent; or 2, sent by registered mail to the owner or agent's last known address; or 11 . , . . 3. upon failure to effect notice through 1., or 2., as set out in this Section, service may be made pursuant to Minnesota Statutes, Section 463.17, Subd~vision 2, which reads as follows: "Service. this order shall be served upon the owner of record, or his agent if an agent is in charge of the building, and upon the occupying tenant, if there is one, and upon all lien holders of record, in the manner provided for service of a summons in a civil action. If the oWner cannot be found, the order shall be served upon them by posting it at the main entrance to the building and by four weeks' publication in the official newspaper of the municipality ifit has one, otherwise in a legal. newspaper in the county"; or 4. pursuant to Minnesota Statutes, Section 145A.04. SECTION 17.14 - APPEALS; RIGHT OF APPEAL Subd. 1. Appeals. Any person who may be aggrieved by a violation notice and or a compliance order order to matco repairs to repair property shall have the right to appeal any action of the Compliance Official or designee to the Board of Appeals and Adjustment (City Council). The Board may support the violation as described by the Compliance Official; void all violations; or, change any described violation by adding violations, removing violations or changing the order to repair as seen fit. Subd.2. Appeals Procedure. Any property owner or property owner's agent that has been served with a violation notice and an order to repair under the provisions of this chapter that believes such orders are without just cause shall have the right to appeal the orders to the Board of Appeals and Adjustments within thirty (30) days after receiving the order of repair. All appeals shall be made to the Compliance Official in writing with any infonnation to substantiate the appeal. The appeal shall be considered by the Board under provisions established for consideration of appeals under Section 2.04 of the City Code. SECTION 17.15 - RESTRICTIONS OR TRANSFER OF OWNERSIllP. It is unlawful for the owner of a dwelling, dwelling unit or rooming unit upon whom a Compliance Order has been served to sell, transfer, mortgage or lease or otherwise dispose the dwelling, dwelling unit, or rooming unit to another person until the Compliance Order has been complied with, unless the owner furnishes to the grantee, lessee or mortgagee a true copy of any notice of violation or Compliance Order and obtains and possesses a receipt of acknowledgment. A person obtaining an interest in the dwelling, dwelling unit or rooming unit who has received notice of the existence of a Compliance Order is bound by the order without-further notice and is subject to the penalties and procedures provided by this Chapter. 12 (Sections 17.16 through 17.98, inclusive, reserved for future expansion). ~ SECTION 17.99 VIOLATIONS: PENALTIES. Subd.l. General. It is unlawful to erect, construct, enlarge, alter, repair, move, improve, equip, use, occupy or maintain any building or structure within the City contrary to the provisions of this Code. Subd.2. Non-Compliance. Failure to comply with a lawfully issued Compliance Order is a violation of this Code. Subd.3. Violation a Misdemeanor. Any person who shall violate any of the provisions of this Code, or shall violate or fail to comply with any order made thereunder, shall separately for each and every violation and non-compliance, respectively, be guilty of a misdemeanor. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and, all such persons shall be required to correct or remedy such violation or defects within reasonable time. When not otherwise specified, each day that prohibited conditions are maintain~d shall.constitute a separate offense. Source: Ordinance 365, Second Series Effective Date: 11-28-94 13 CHAPTER 18 PROPERTY MAINTENANCE ORDINANCE SECTION 18.01 PURPOSE AND POLICY SOOD. 1. PURPOSE AND POLICY. This ordinance provides a practical method to regulate the maintenance and use of existing properties and buildings within the City of Hastings for the purpose of protecting the public health, safety and welfare. Said ordinance (a) Establishes minimum standards for maintenance property and buildings; and, (b) Provides for administration and enforcement. SOOD.2. INTENT. The Council finds there exists in the City numerous properties which are substandard in one or more important features of structure or appearance. Such conditions adversely affect public health and safety and lead to the continuation, extension and aggravation of urban blight. Adequate protection of public health, safety and welfare requires the establishment and enforcement of minimum property maintenance standards. The City Council intends that this Chapter be an integral part of the City's program of health, safety, building and land use regulation. This Code is to be construed liberally, in conjunction with other provisioQs of the City Code, to give effect to the policy, purpose and objectives of this section, but is not . construed to modify, amend or otherwise alter the provisions of the City Code relating to health, safety, structure or land use regulation. SECTION 18.02 ADOPTION OF THE INTERNATIONAL PROPERTY MAINTENANCE CODE BY REFERENCE SOOD. 1. Code Adopted. As published by the International Code Council 1998 edition. The International Property Maintenance Code herein adopted by reference and is part of this code as if fully set out in length. SOOD. 2. Copy on file. One copy of the International Property Maintenance Code together with a copy of this code, must be kept on file in the Office of the City Clerk and available for public inspection. The Clerk and the Property Maintenance Inspector must keep a reasonable number of additional copies of the International Property Maintenance code and this code available for use and inspection by the public at reasonable times. SECTION 18.03 DEFINITIONS. The following terms as used in this Chapter shall have the meaning stated: Approved: As approved by the Property Maintenance Inspector. ,Board of Anneals: The City Council of the City of Bastin!s. 1 Carport: A shelter for an automobil~ consistine of a roof extended from the side of a buildine. sometimes with an additional wall. Deteriorated: Materials or conditions that are substandard and are in need of repair or replacement. Exterior surface: Any surface exposed to weather conditions. Failed paint: Paint which is cracked, flaked, blistered, pealed, chalked, scaled over 200.10 or more of any wall surface or fence surface, or has failed to provide a protective surface for the base material. Fully Screened: Enclosed by use of a wall. fence or partition to hide the view of an object or property so as not to be readily visible from adjacent property. Hazardous trees or brush: Any tree(s) or brush that jeopardizes the structural integrity of a building, fence or structure or endangers human safety. Order to repair: An order from the City of Hastings to a property owner that requires maintenance or repairs to be done to correct a Property Maintenance Ordinance violation. Owner's agent: A person with written permission from the owner, legal guardian or power of attorney, able to represent the owner's interests. Property Maintenance Inspector: The person or persons who have been authorized by the Hastings City Council to enforce the Property Maintenance Ordinance. Specific area: One part or piece of a larger surface or assembly. Violation notice: Notice in writing given to the owner of record ofa violation of the City of Hastings Property Maintenance Ordinance. SECTION 18.04 ENFORCEMENT: SUBD. 1. The Hastings City Council shall authorize the Community Development Direetor or Community Development Division the Inspections and Code Enforcement staff as assigned by the Community Dcv:clopment Director Supervisor of Inspections & Code Enforcement to enforce this ordinance under the title of "Property Maintenance Inspector". SUBD. 2. The Property Maintenance Inspector shall make inspections and take any such action as may be required to enforce the provisions of this ordinance. 2 SUBD. 3. Right of Entry: Whenever the Property Maintenance Inspector has reasonable cause to believe that there may exist in any building or on any property any condition that is in violation of this ordinance, the Property Maintenance Inspector may enter the building or property at reasonable times to make inspections or to perform any duty required to administer said ordinance. The Property Maintenance Inspector shall first present proper credentials and request entry. If the property is unoccupied the inspector shall mail notice to the owner of record by certified mail seven days prior to inspection. If entry is refused the building inspector shall have recourse to every remedy provided by law to secure entry, including the right to secure a proper inspection warrant. SUBD. 4. Violations: When a property or building is in violation of this ordinance, the property owner of record shall be issued a "Notice of Violation" and "Order to Repair" "Compliance Order" in writing to include the following information: A A description of the property sufficient for identification. ..B. Description of the violation(s) and the action required to remedy the violation(s). C. Provision of reasonable time to perform any remedy to be completed. D. Notice of any action that may be taken by the City if repairs are not make in a reasonable time period. E. Notice of any right of appeal. SUBD.5. Appeals: Any person aggrieved by a viola.tion notice and order to make repairs to property shall have the right to appeal. The Board may uphold the violation; void all violations; or, change any described violation by adding violations, removing violations or changing the order to repair. SUBD. 6. Appeal Procedure: Any property owner or owner's agent that has been served with a violation notice and an order to repair shall have the right to appeal the order to the Board of Appeals and Adjustments within thirty (30) days after receiving the compliance order. All appeals shall be made to the Community Development Director Supervisor of Inspections & Code Enforcement in writing with any information to substantiate the appeal. The appeal shall be considered by the Board of Appeals and Adjustments under provisions established for consideration of the appeals under Section 2.04 of the City Code. 3 SECTION 18.05 PROPERTY MAINTENANCE REQUIREMENTS SUBD. 1. PARKING AND STORAGE OF CERTAIN VEHICLES. It is unlawful to park or store on any property within the City, any motor vehicle, trailer or boat, without a current license unless housed within a building which complies with all City Code requirements; except as may otherwise be regulated by the City Code. SUBD. 2. ABANDONED AND INOPERABLE MOTOR VEHICLES. It is unlawful to park or store on any property within the City any abandoned or inoperable motor vehicle unless housed within a building which complies with all City Code requirements; except as may otherwise be regulated by the City Code. SUBD. 3. PARKING, STORAGE OR USE OF MAJOR RECREATIONAL EQUIPMENT. For purpose of these regulations, recreational equipment is defined as including boats and boat trailers, pickup campers or coaches (designed to be mounted on automotive vehicles), motored dwellings, tent trailers, snowmobiles and snowmobile trailers, jet skis and jet ski trailers, and the like, and cases or boxes used for transporting recreational equipment, whether occupied by such equipment or not. No recreational equipment shall be parked or stored on any lot in a Residential District except in a carport or enclosed building, and in compliance with the following provisions: 1.) No recreational equipment shall be allowed in the right-of-way; 2.) One currently licensed recreational equipment 7 feet high or less shall be allowed in a driveway; 3.) One currently licensed recreational equipment item may be parked behind the nearest portion of a . building to a street; 4.) A maximum of two currently licensed recreational equipment items may be stored outside on a property, provided.i, hov:cver 1U that such equipment may be parked anywhere on the residential premises not to exceed twenty four hours during loading or unloading. .Ill No sueh recreational equipment shall be used for living, sleeping, or housekeeping purposes when parked or stored on a residential lot., or in any rl location not approved for such use bv City Code. SUBD. 4. MISCELLANEOUS MATERIALS AND EQUIPMENT STORAGE. Within the City, all materials and equipment shall be stored within a building or be fully screened so as not to be visible from adjoining properties, except for the following: clothes lines, recreational equipment, construction aild landscaping materials and equipment currently being used on the premises, agricultural equipment and materials if these are used or intended for use on the premises, and off-street parking; except as may otherwise be regulated by the City Code. SUBD. 5. GRASS AND WEEDS ON PRIVATE PROPERTY. A It is unlawful for any owner, occupant or agent of any lot or parcel of land in the city to allow any vegitation such as weeds or grass growing upon any such lot or parcel or land to grow to a height greater than 12 inches or to allow such weeds or grass to go to seed. 4 B. If any such owner, occupant or agent fails to comply With this height limitation and after notice given by the Property Maintenance Inspector, has not complied within seven days of such notice, the city shall cause such weeds or grass to be cut and the expenses thus incurred shall be. a lien upon such real estate. The City shall certify to the Dakota County Auditor, a statement of cost incurred by the City. Such amount together with interest, shall be entered as a special assessment against such lot or parcel ofland and shall be collected in the same manner as real estate taxes. SOOD. 6. TREES, BRUSH, SHRUBS ON PRIVATE PROPERTY. A Any tree, shrub or brush that grows against any building or fence which represents a hazard to the structural integrity of said building or fence shall be removed or trimmed to prevent damage. --- B. Trees, tree limbs, brush or shrubs that are dead, damaged and hazardous by nature shall be remov~d and disposed ofin a legal manner. .. SUBD. 7. ELECTRICAL WIRES, FIXTURES AND DEVICES ON PRIVATE PROPERTY. . A. No electrical wires shall hang less than 10 feet above the ground or 12 feet from a driveway surface. B. Loose hanging electrical fixtures, wires and devices shall be repaired, replaced or properly abandoned. SUBD. 8. STORM WATER RUNOFF. Stof!I1 wat~r runoff from roofs, decks, yards and other surfaces shall drain so as not to represent a hazard to other properties or stain, discolor or degrade siding and other building surfaces. SUBD. 9. REPAIR AND MAINTENANCE OF EXISTING BUILDINGS. All buildings within the City shall be maintained as indicated below. Existing uses shall comply with these provisions within (12) months following passage of this Chapter. A All surfaces in general: 1. All exterior surfaces shall be of material manufactured or processed specifically for use in weather exposed location. 2. All surfaces must be kept reasonably weather tight and rodent proof. 3. Exterior wood, not decay resistant by processed or natural means must be protected by paint, stain or other approved treatment and applied as approved for use by the manufacturer. 4. Exterior surfaces shall be maintained free of cracks, tears, breaks from deterioration or neglect. 5 5. Exterior protective surfaces on all buildings shall be maintained in good repair so as to provide a sufficient covering and protection of structural members, insulation and interior finishes. 6. All visible rot shall be deemed" deteriorated and must be replaced or repaired. B. Roof: 1. Roofs shall be maintained in a weather tight and water proof condition. 2. Loose, broken and missing roofing materials shall be repaired or replaced per as manufacturers recommendations. All repairs shall match original color, style and application as close as possible or as approved by the City. 3. All roofing materials shall be applied to. suitable base or sheathing according manufacturer's recommendations. Rotted or deteriorated structural members and sheathing shall be replaced prior to the installation of roofing materials. 4. Severely deteriorated roofing materials shall be replaced. When 25 percent or more of granule mineral surface coating is missing frOIp the surface of asphalt roofing products, the roofing shall be considered severely deteriorated. C. Foundations: 1. All foundations shall be constructed of materials that are resistant to rot such as: concrete, stone, brick or FDN .60 CCA retention preservative treated lumber to a point 6 inches above the finished grade. 2. All foundations shall be maintained to support the intended loads. 3. All foundations shall be repaired if any brick, stone, block or other component has fallen out or has deteriorated. 4. All foundations shall be deemed out of repair ifmore than 20 percent of mortar is loose or has fallen out. 5. All foundations shall be rodent proof and shall not have cracks more than 1/4 inch in width. D. Exterior walls, soffit, fascia and trim: 1. All surfaces shall be free of rot, damaged or missing pieces and shall provide complete weather protection. 2. All exterior surfaces on which the paint has blistered, peeled, cracked, flaked, scaled or chalked away or has failed to provide a protective surface over any wall to an extent of 20% or more of surface area, including windows, doors, trim, rails, cornice, siding, fascia, soffit and other such areas shall be deemed to be out of repair and must be repainted with materials approved for use, applied per manufacturer's recommendations. Patching of existing painted areas shall be matched in color as close as possible. 6 3. All missing trim pieces shall be replaced to match existing trim, .. E. Exterior Doors, Windows: 1. All exterior doors and windows shall be set square in secured frames and fully operable. Doors and windows may be secured in a closed position if not necessary for egress or fire escape. All broken or missing glazing or screens shall be replaced in doors and windows with new glazing or screens. All broken or missing glazing in doors or areas subject to human impact shall be replaced with safety glass as approved by the Building Official or which meets UBC Standard No. 24-2. Exterior paint must be maintained per as described in Section D2. Exterior masonry or brick chimneys will be deemed to be out of repair if 10 percent or more of the pointing is loose, has fallen out or if any brick, masonry unit or stone is loose or fallen out. .2. 3. 4. F. Steps, Sidewalks, Porch, Decks, etc. 1. All exterior steps, porches, decks, and sidewalks (located on private property) shall be repaired with decay resistant materials unless protected by a roof. 2. All rotted or missing materials shall be repaired. 3. Steps, porches, and decks shall be repaired if settlement has occurred at a rate of ~. inch in 1 foot. 4. Cracked or buckled sidewalks (located on private property) with 1 inch difference in height between must be repaired. 5. Exterior paint must be maintained as per paragraph D. 2. of this subd. G. Fences: 1. Fences shall be deemed deteriorated if any of the following conditions occur: rotted, missing or broken parts, if they are unstable leaning or failed paint over more than 20% of any fence surface 2. Existing fences shall not be constructed with materials designed to cause an injury such as fencing charged with electricity or barbwire. 3. Fences may not cause a hazard by blocking a drivers view of an oncoming. vehicle or pedestrian. 7 SECTION 18.06 PENALTIES. SUBD. 1. Any person who shall violate any of the provisions of this ordinance hereby adopted or fail to comply therewith, or shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, and from which no appeal has been taken, modified by the Board of Appeals or by a court of competent jurisdiction, within the time fixed herein, shall separately for each and every violation and non-compliance, respectively, be guilty of a misdemeanor. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and, all such persons shall be required to correct or remedy such violation or defects within a reasonable time; and, when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense. SUBD.2. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. SUBD.3. Validity. The Hastings City Council hereby declares that should any section, paragraph, sentence or word of this ordinance or of the Code hereby adopted be declared invalid for any reason, it is the intent of the Hastings City Council that it would have passed all other portions of this ordinance independent of any such portion as may be declared invalid. SUBD.4. Date of Effect. This ordinance shall take effect upo~ its passage and seven (7) days after publication. Items to report to the City Council will include the following: Standby generators that would allow for the operation of the lift stations and wells in the City, should there be a power outage, are available. Staffing will be available at the Fire Station throughout the entire day on December 31, 1999 and into January 1, 2000 if needed. As City Hall will be closed on Friday December-31, 1999, due to the-recognition of the January 1, 2000 holiday, which falls on a Saturday, the Fire Station will serve as the Emergency Operations Center (EOC) Staff is working with the Hastings Bus Company to provide for the positioning of several buses and perhaps City vehicles, throughout the City, that would be staffed with personnel and emergency phone/radio service if necessary. Information regarding these locations will be provided in the local newspaper in December. Staff has conducted a complete analysis of the systems in the City, and expects no problems throughout the Y2K time period. A brochure produced by the Red Cross was distributed in the most City Newsletter, that was mailed in October. The City will not be coordinating emergency housing shelters as a result of the Y2K issue. Staff conducted a meeting with members of the local ministerial association and advised them as such, and encouraged the churches to take the lead on that issue. The turn arrow light that allows left hand turns should also be accompanied by a green light and signage that says, "LEFT TURN YIELD ON GREEN". This proposal would make the lights on Westview Drive and Pleasant Drive identical to the lights on Highway 61 and Highway 55; Pine Street and Highway 55; and Prairie Street and Highway 55. This modification would smooth out the flow of traffic, avoid stacking and unnecessary waits for drivers wanting to make left hand turns off of Highway 55.
