New Employee Introductions Charlie Judge, Facilities Manager Shawn Shorey, Building Inspector Wietecha welcomed Judge and Hinzman introduced Shorey. Employee Promotion Introductions Jamie Stevens, Firefighter/Fire Inspector Robert Wargo, Paid On-Call Firefighter Lieutenant Tim Likes, Paid On-Call Firefighter Lieutenant Jeremy Bickner, Paid On-Call Firefighter Lieutenant Chief Townsend introduced Wargo, Likes, Bickner and Stevens. Pleasant Hill Library Presentation, Branch Manager Julia Carlis Carlis provided Council with an update of new and ongoing activities and events at the Pleasant Hill and other Dakota County Libraries. V. APPROVAL OF MINUTES Approve Minutes of the City Council regular meeting on May 16, 2022. Minutes were approved as presented. VI. There will be no discussion on these items unless a Councilmember so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. Declare Surplus Property and Authorize for Public Sale – 1993 Fire Engine #3 14. Resolution No. 06-05-22: Authorizing Budget for City Hall Dome / HVAC Project IX. AWARDING OF CONTRACTS AND PUBLIC HEARING These are formal proceedings that give the public the opportunity to express their concern, ask questions, provide additional information, or support on a particular matter. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. X. REPORTS FROM CITY STAFF These items are intended primarily for Council discussion and action. It is up to the discretion of the Mayor as to what, if any, public comment will be heard on these agenda items. A. Public Works B. Parks and Recreation C. Community Development 1. Continued - Appeal of Administrative Decision: Hudella (15213 Ravenna Tr.) Fox, Liefeld to remove discussion from table. 6 Ayes, 0 Nays Hinzman revisited the previous meeting discussion. Hinzman summarized the original decision of the Building Official and Mr. Hudella’s appeal. He reminded Council that they are acting as the Board of Adjustment and Appeals. Council discussion on transfer of permit from a company to the homeowner. The fence is already built and a safety cover has been installed. Council noted that there seem to have been some process failures with this situation. Recommended that the resolution state that as long as the safety cover is in place that the fence is permissible. Also recommend review of the wording in the ordinance. Hinzman indicated that the fence handout could be more clear as to what is allowable in terms of a fence. Council discussion on improving clarity in the future—revisit of ordinance or brochure materials update. Applicant took over permit from the originating company and did not construct fence in the manner in which the permit was approved. Hinzman reported that over time a safety cover can fail and Wietecha indicated that a pool cover is not in our current ordinance and that “climbable” is the issue at hand. Council discussion on sending ordinance review to a committee to ensure that the updating does not get lost after the conversation. Council indicated that there have been appeals to ordinance or staff decisions that have been denied. Some Councilmembers indicate support for staff recommendation. Appreciation of conversation among councilmembers to help illustrate the various perspectives. Investment was already made, so there is support for overturning the staff decision. A question was posed about the liability to the City in overturning the staff decision. Attorney Land indicated that it is difficult to predict and may depend on a defensible Council decision. Precedence is not a reason to continue improper decisions. Councilmembers may support staff decision or propose current situation be approved with direction to staff to change ordinance to allow this kind of fence, with a cover required. Fox, Braucks to approve as presented. 4 Ayes, 2 Nays (Leifeld, Vaughan) Motion prevails in support of staff decision. 2. Appoint HEDRA Commissioner This item was moved from Consent by request of Councilmember Folch. Hinzman provided overview of HEDRA interview committee recommendation of Mr. Anderson. Council discussion on Mr. Anderson and his strength as a candidate for a member of HEDRA. Council noted that application forms do not provide for a lot of information for applicants to demonstrate how well qualified they might be for a commission. Discussion on how to generate more interest or recruit commission candidates. Support for Mr. Anderson to be appointed to HEDRA. Concerns about discussing candidates in a public forum as this may dissuade others from applying for other commission openings. Process questions should be addressed with one another rather than in the public forum. Council clarified the purpose for the discussion was to provide input into the application process rather than a specific candidate appointment. All ages are welcome to this free event. • Makersway Alley Market will be between Sibley and Ramsey Streets on Thursday, June 9 and 16. Support area makers and artisans within our historic downtown and riverfront park by shopping at the markets. • Summer Programs at Levee Park… o Thursday, June 9, Music in the Park with “Divas Through the Decades.” Supported by the Ruth and George Doffing Charitable Fund. o Wednesday, June 15, Storytime in the Park is “Rhymes.” A partnership with Pleasant Hill Library. o Thursday, June 16, Music in the Park with “The Lonesome Losers.” Supported by the Ruth and George Doffing Charitable Fund.
