HomeMy WebLinkAbout02/14/77PLANNING COMMISSION MINUTES MONDAY, FEBRUARY 14, 1977 7:30 P.M. Due to lack of a quorum, the meeting was not called to order by Acting Chairman Stoffel until 8:05 P.M. Members Present: Stoffel, Fischer, Wendler, Latch, Trautmann Members Absent: Peterson Since Councilman Latch was not appointed APPROVAL OF MINUTES to the Planning Commission until the Council Meeting of February 7, 1977 the minutes should not show him as being absent. Also under the section entitled "Quorum Needed For Next Planning Commission Meeting," reference was made to Council- man Latch as being a member which he was not at that time. Moved by Commissioner Fischer, seconded by Commissioner Wendler to approve the Minutes of the January 24, 1977 Planning Commission Meeting as amended above. 5 Ayes - 0 Nayes The Public Hearing was opened at 8:08 by Chairman Stoffel. The Zoning Administration made reference to the Affidavit of Publi- cation and the Certification of Mailing and informed the Commission that the Public Hearing had been properly called. PUBLIC HEARING- SPECIAL USE PERMIT & VARIANCE - LLOYD GATH- 414 SPRING STREET A petition in opposition to Mr. Gath's proposed duplex was read by Chairman Stoffel. After all people present were afforded an opportunity to be heard, the Public Hearing was closed at 8:11 P.M. Moved by Commissioner Fischer, Seconded by Commissioner Wendler to recommend approval to the Council of Mr. Gath's request for a special use permit for a duplex in a R-2 zone and also his request for a variance of 460 sq. ft. for the lot square footage. A survey of the lot will be required at the time permits are issued. Also, a modification of the exist- ing zoning requirements in relationship to older Plannin~ Commission Minutes 2 February 14, 1977 Continued parts of Hastings should be looked at by the Planning Cormnission. 5 Ayes - 0 Nayes. Moved by Commissioner Fischer, seconded by Commissioner Wendler to recommend approval to the Council of the Final Plat for Tannen- baum Estates at 22nd and Pine Streets with the following conditions: FINAL PLAT TANNENBAUM ESTATES 22ND AND PINE STREETS Final Plat should show square footage in each lot. 2. Resolve easement questions with adjoining property owners. Documentation should be provided for ease- ments as agreed to in the Council's approval of the Preliminary Plat. 4. Payment of appropriate subdivision fees. Southview Drive extended easterly be named Southview Drive instead of 22nd St. 5 Ayes 0 Nayes Moved by Commissioner Fischer, seconded by Commissioner Wendler to recommend approval to the Council for the Site Plan Review of Rosewood Corporation's second proposed building with the following conditions: SITE PLAN REVIEW INDUSTRIAL PARK #1 ROSEWOOD CORPORATION Trees at the west side of the westerly entrance and the east entrance should be moved back approximately ten feet for better traffic vision. 2. Any steep sloped grassy areas should be sodded instead of seeded for better erosion control The City will provide water and sewer lines from the main to the property line. Installation and maintenance of water and sewer line from the main, and the hydrant are the responsibility of Rosewood Corporation. The City will provide the hydrant itself. 4. Waste material storage must be provided. Planning Commission Minutes 3 February 14, 1977 Continued City Attorney to determine whether or not a surety bond is necessary for landscaping or if the bond necessary for financing of the entire project is sufficient. A painted concrete block building will need Council approval. Drainage plans must be approved by City Engineer once correct elevations are known. The Planning Commission will submit a memo to the Industrial Park Advisory Committee asking for their interpretation of when easements should be required when dealing with Industrial Park land· 5 Ayes 0 Nayes Johnson Standard at 15th and Highway #61 requested a variance to add on a car wash to their present service station. The Fischer Committee studied thr proposal and recommended denial of the request due to the limited park- ing, the bad traffic situation, and the con- gestion already at this location. VARIANCES- JOHNSON STANDARD - CAR WASH 15TH & HIGHWAY #61 Moved by Commissioner Fischer, seconded by Commissioner Wendler to recommend to the Council that the variance for Johnson Standard to build a car wash be denied. 5 Ayes 0 Nayes Mr. Dale Sulla, 1208 East 3rd. St. has re- quested a home occupation permit to do small appliance repair work in his garage. The Home Occupation Permit Ordinance states that a home occupation can only be done in a person's home and not in any accessory building so therefore his home occupation would have to be denied. However, the Fischer Committee will be studying whether or not the Home Occupation Ordinance should be modified to allow a home occupation in an an accessory building. HOME OCCUPATION PERMIT DALE SULLA - 1208 E. 3RD. STREET. Mr. Robert Thorpe, 1334 West 18th Street has requested a Home Occupation permit to do architectural drawing in his home. This will not create any additional traffic or parking problems. HOME OCCUPATION PERMIT ROBERT THORPE - 1334 West 18TH STREET Planning Commission Minutes 4 February 14, 1977 Continued Moved by Commissioner Wendler, seconded by Commissioner Fischer to recommend approval to the Council for this Home Occupation Permit 5 Ayes - 0 Nayes Dakota County has requested that our zoning ordinance be amended to allow administrative offices in a PI zone. Once this is done they want the fifty acres that the Government Center is presenlty on and the new Social Service center is proposed to be on to be rezoned from Agricultural to PI. DAKOTA COUNTY GOVERNMENT PROPERTY Moved by Commissioner Fischer, seconded by Commissioner Wendler to recommend to the Council that administrative offices be allowed in a PI zone. 5 Ayes- 0 Nayes DAKOTA COUNTY PROPERTY AMEND ZONING ORDINANCE Moved by Commissioner Fischer, seconded by Commissioner Wendler to recommend to the Council that once zoning ordinance is amended that the Dakota County Government Center Property(50 acres) be rezoned from Agriculture to PI zone. 5 Ayes - 0 Nayes DAKOTA COUNTY PROPERTY REZONE FROM AGRICULTURE TO PI. Moved by Commissioner Fischer, seconded by Commissioner Wendler to change March 28, 1977 meeting to March 29, 1977, since there is a conflict with a Council meeting scheduled for March 28, 1977. 5 Ayes - 0 Nayes. Moved by Commissioner Fischer, seconded by Commissioner Wendler to submit to the Council for approval the names of Gilbert Gergen, Otto Murry, and Milton Terrell as new members on the Planning Commission. A proposed ordinance by Councilman Karnick in regards to the restructing of the Planning Commission was discussed. It was generally agreed that this proposed ordinance was a fairly good compromise except that the Planning Commission itself would have no say in the selection of new members.
