Members Present: Stoffel, Gergen, Terrell, Members Absent: Wendler, Fischer Moved by Commissioner Groth, seconded by Commissioner Murray to approve the March 1977 Planning Commission Minutes 14, Assistant Chairman Stoffel opened the Public Hearing regarding a Special Use Permit for A1Sieben at 612 W. 6th Street at 7:31 P.M. The Planning Director read the Affidavit of Publication, the Notice of Public Hearing, and Certificate of Mailing. by Assistant Chairmen Murray, Groth, Latch, Kramer APPROVAL OF MINUTES Name Comment Tim Pelen: What are the proposed setbacks for the new building ~lanning Director: The setbacks are seven feet from both property lines which meet the City's zoning code requirements Carol~e~. The present home that is to be torn down is not occupied by two families as has been indicated by the Sieben's After all people present were afforded an opportunity to be heard, the Public Hearing was closed at 7:49 P.M. Moved by Commissioner Groth and seconded by Commissioner Terrell to approve the Special Use Permit requested by Mr. Sieben for a duplex located at 612 W. 6th Street. 6 Ayes, 0 Nayes Mr. Endres talked to the City in January regarding a Building Permit. At that time his plans were given verbal approval by the Zoning Administrator, however, when he filled out an application in March, he was informed that his plans did not meet the City's setback requirement. Based on the verbal approval 'eceived by a City staff member, Mr. Endres ordered his materials. VARIANCE - GARY ENDRES - 509 W. 19th STREET Planning Commission Minutes March 29, 1977 Page 2 Mr. Endres was told that a detached garage could be placed in the same location that .e was proposing for an attached garage and so a building permit was issued for a detached garage. Moved by Commissioner Groth, seconded by Commissioner Terrell to approve the variance requested by Mr. Endres on the grounds that an administrative error was made and Mr. Endres should not be held responsible for the mistake. 6 Ayes 0 Nayes. The petitioner requests a variance to allow the construction of a garage one and one half 120 E. feet from their property line. The Zoning code requires a five foot setback for a detached garage. The request for the variance was based on a desire of the petitioner to make use of an existing driveway for the new garage and because this garage would be in line with the remaining garages along the alley. VARIANCE - E. GARY & M. FOX 6TH STREET Moved by Commissioner Groth, seconded by Terrell to grant a variance to E. Gary and M. Fox at 120 E. 6th Street on the grounds that this garage would be in line with others along the alley and -he five foot setback is not reasonable when applied to lots that are on a public alley. 6 Ayes 0 Nayes. Mr. Merlin Anderson, Manager of the Peavey REZONING PEAVEY PROPERTY Mill submitted a letter to the City indicating that they would have no objections to the City rezoning their property from I-1 to I-2 as was suggested by the Planning Commission in the fall of 1976. This item was tabled by the Planning Commission. The Planning Director explained to the Commission that the petitioner would like to construct a garage which would be located partially in the front and side yards. The City's Zoning Ordinance prohibits detached garages from being located in either the side or front yard and the Planning Director sug- gested that the Planning Commission may want to consider recommending that the ordinance be modified to allow detached garages within a side yard. If this is the desire of the Planning Commission it can be recommended to the Council that the ordinance be modified BUILDING PERMIT - GORDON ROBIE 525 EAST 17TH STREET. The Planning Commission wan~ed an opportunity to review the proposal in more detail and the item was tabled. Moved by Commissioner Murray, seconded by Commissioner Gergen to nominate Lou Stoffel for Chairman. 6 Ayes 0 Nayes. Moved by Commissioner Gergen, seconded by Commissioner Terrell to nominate Commissioner Fischer for Vice-Chairmen. Moved by Commissioner Groth and seconded by Commissioner Stoffel to nominate Kramer for Vice-Chairman. 4 - Fischer; 2 - Kramer. ELECTION OF OFFICERS Moved by Commissioner Gerge, seconded by Commissioner Murray to adjourn at 9:40 P.M. 6 Ayes 0 Nayes ADJOURNMENT jm
