The Meeting was called to order at 7:30 P.M. by Chairman Stoffel
Members present: Chairman Stoffel, Wendler, Gergen, Terrell, Groth,
Kramer, and Murray.
Members absent: Fischer
The March 29, 1977 minutes indicate that the
Sieben Special Use Permit was on Second St.
and it should have stated 6th St.
Moved by Commissioner Wendler, seconded by
Commissioner Kramer to approve the March 29,
1977 minutes as amended. 7 Ayes 0 Nayes.
APPROVAL OF MINUTES
Mid Continent Builders submitted plans for
two thirty-six unit apartment buildings in
November of 1976. At that time the Planning
Commission granted approval of a footing and
foundation permit subject to Mid Continent
submitting a plat for all of Outlot A, that
the entire site plan would be reviewed at the
time that a building permit was requested for
the buildings themselves, and the developer
was to work on a long range plan of the site
with the City Engineer. The seventy-two apart-
ment units require thirty-six garage stalls and
a minimum land area of five acres.
SITE PLAN REVIEW - MID CONTINENT
BUILDERS 531-541 WESTVIEW DRIVE
The City staff recommended approval of the Site
Plan subject to no building or portion thereof
being more than two-hundred and fifty feet away
from any hydrant, that special provisions be
taken in the swale area to prevent erosion,
that the developer provide an agreement to
plat all of Outlot A, and a signed statement
from the developer indicating that all improve-
ments will be made as indicated on their plans
and agreed upon by the Planning Commission.
Commissioner Terrill expressed concern about not
looping the water line which is shown on the plans
for the two apartment buildings. It was suggested
that the developer be asked to connect the proposed
water line with another water line in the area.

Moved by Commissioner Terrill, seconded by
Commissioner Gergen to have the City staff
check into the need for looping the proposed
water line and if needed, require that the
developer do so. 5 Ayes - 0 Nayes Groth and
Wendler abstained.
Moved by Commissioner Wendler, seconded by
Commissioner Terrill to approve the site plan
for seventy-two apartment units subject to the
four conditions mentioned in the staff report.
7 Ayes - 0 Nayes.
Mr. Emrick has submitted plans to construct
a beauty shop and two apartments above the
beauty shop in an R-3 district. The ordinance
allows multiple family structures and professional
offices as permitted uses but the Planning Director
indicated that the provisions in the zoning ordinance
which allows professional offices as well as other
commercial uses should be strictly interpreted to
prevent wide spread commercial development within
a multiple family districts.

In addition, the City, over the last few years has
been considering whether or not they want to con-
tinue the service drives along Highway #55. If a
service drive is constructed in this area it may
render the property in question unusable for either
commercial or multiple family development.
The Planning Commission asked thc. City staff to
contact the Department of Transportation on their
plans for requiring service drives along ~ighway 55
and present this as well as the options available
for zoning the property.
Chairman Stoffel referred the matter to a committee
to beehaired by Commissioner Murray. Members of the
Committee will consist of Commissioner Terr~ll,
Commissioner GergenandCommissionerGroth.
The Planning Committee of the Council met
with the Planning Director and listed some
priorities and assigned those priorities
to staff members and various City Commissions.
The Planning Commission reviewed the report
from the Planning Committee and expressed
general concern about ~nforcement of existing
ordinances. The Planning Director indicated
that the Planning Committee felt that there
may be the need to hire an additional~taff member
to handle zoning responsibilities

and a report has been prepared for the Planning
Committee on this matter.
The Planning Commission reviewed the proposed ORDINANCE
ordinance which would allow detached
accessory buildings to be located within
side yards. The Commission asked that the
ordinance be revised to prevent detached
garages from being located too close to side
property lines that are on a corner lot.
The Planning Commission Chairman asked that
the ordinance be revised in accordance with
the discussion and that the item placed on
the next agenda.
- LOCATION OF
ACCESSORY BUILDINGS
In 1976 the Peavey Company requested a REZONING OF PEAVEY PROPERTY
variance to allow an addition to be con-
structed seven feet from their front property
line rather than the required fifty feet. The
Planning Commission and Council felt that, althoughj
the Peavey property was zoned I-l, that a more
appropriate zone would be I-2. I-2 is the older
industrial areas and the zoning requirements are
less stringent. The Planning Commission recommended
that the Peavey property be rezoned from I-1 to I-2,
but at the request of Peavey this action was delayed
to give them opportunity to review the affect that
this rezoning would have on their property. A letter
Was received from - Merlin Anderson, Manager of the
Peavey Mill, indicating that they now have no objection
to rezoning their property from I-1 to I-2.
Moved by Commissioner Wendler, seconded by Commissioner
Terrill to rezone the Peavey property from I-1 to I-2.
4 Ayes Stoffel, Groth and Gergen abstained.
Commissioner Wendler recommended to the COMMITTEE REPORT
Planning Commission that they consider adding
duplexes as a permitted use to an R-3 district
Moved by Commissioner Wendler, seconded by
Commissioner Groth to direct the staff to
propose an ordinance for the next meeting
which would add duplexes as a permitted use
to an R-3 district. 7 Ayes - 0 Nayes.
Commissioner Terrill asked that the Planning
Director place on the next agenda a proposal
to limit parking on Ramsey and Tyler in the
area which is presently designated as a one
