Gergen, Terrell, Fischer, Wendler, Commissioner Groth arrived at 7:35 P.M. Moved by Commissioner Fischer, seconded by APPROVAL OF MINUTES Commissioner Wendler to approve the May 9, 1977 Planning Commission Minutes. 6 Ayes 0 Nayes Public Hearing was called to order at 7:34 P.M. by Chairman Stoffel. The WESTVIEW AND T.H. Planning Director informed the Planning Commissions that the Public Hearing was property called by referring to the Affidavit of Publication, and a notice of Public Hearing. The Planning Director explained to those present that the proposal for rezoning was originated by the desire of Mr. & Mrs. Emrick to construct an office building which will include a beauty shop. Based on that request, the Planning Commission decided to investigate the desirability of re- zoning a narrow strip of land along Highway 55, both east and west of Westview Drive from R-3 to a limited commercial zone. PUBLIC HEARING - ZONING AMENDMENT 55 Name Paul Embretson Comments The City of Hastings needs more undeveloped C-3 property. At the present time there is very little undeveloped land available to ac- commodate new commercial develop- ment in the City of Hastins. Dick Stoffel The property which is currently zoned I-l,including the Stoffel Beverage Co., should be included in the rezoning. Dick Ensted As a property owner, in the area affected by the rezoning he would favor a C-3 zoning classification as apposed to a C-1. Planning Commission Minutes May 23, 1977 Page 2 Name Comments Robert Mattila The property owners affected by this proposed rezoning would pre- fer to have a C-3 zone rather than a C-1 zone. After all people were afforded an opportunity to discuss the matter, Chairman Stoffel closed the Public Hearing at 8:17 P.M. Commissioner Fischer explained to the audience that the Planning Commission realizes that the property under discussion for rezoning has some special problems which are unique to this area. Most Planning Commission members feel that it is inappropriate to rezone the property from an R-3, multiple family residential zone to a zone which would allow all types of commercial development. THe Planning Commissions concern is to find a reasonable zone which would allow property owners a return on their investment but also minimize future traffic problems along Highway 55. Moved by Commissioner Groth, seconded by Commissioner Terrell to rezone Lots 6 thru 15, Block 48, Addition #13 Lots 1 thru 18, Block 49, Addition #13, Outlot B, Imperial Estates Addition and the unplatted land within the SE~ of the NE~ of Section 29, Township 115, Range 17W.located north of T.H. 55. plus that portion of the vacated Ash Street from R-3 to C-3. 2 Ayes - Gergen, Terrell, Wendler and Fischer Nay. Stoffel abstained. Moved by Commissioner Fischer and seconded by Commissioner Wendler to rezone all of Blocks 48 and 49 of to a modified C-1 zone subject to the developers providing private easements to allow access through one driveway unto Highway 55. 4 Ayes - Terrell and Groth Nay. Stoffel abstained. Moved by Commissioner Groth, seconded by Commissioner Kramer to rezone all property along Highway 55 from Embretson's to the Hy-De-Hy Bottling Co., from R-3 to C-3. 4 Ayes - Gergen, Fischer and Wendler Nay. Chairman Stoffel appointed Commissioner's VARIANCE - ISOBEL CARSTEN Gergen, Kramer and Groth to a committee 1408 SIBLEY ST. that would investigate the variance requested by Isobel Carsten. Planning Commission Minutes May 23, 1977 Mr. Gayle Erickson representing the DOWNTOWN SUPERMARKET PROPOSAL downtown businessmen and Mr. Bill Farmer representing Fairway Foods presented a proposal for a downtown grocery ~0re. The plans indicate an expansion of the Sears building and a parking lot on the east side of Tyler St. Mr. Erickson explained to the Planning Commission that they were looking for a conceptual approval of the project. Moved by Commissioner Fischer,sec~aded by Commissioner Wendler to indicate the Planning Commissions support of the concept of a downtown supermarket and supports construction thereof assuming that the development meets all City ordinances pertaining to such construction. 7 Ayes 0 Nayes. Chairman Stoffel appointed Mr. Kramer, Mr. Groth and Mr. Wendler to a committee which will in- vestigate the Fairway proposal once a site plan has been completed. Moved by Commissioner Gergen, seconded by Commissioner Fischer to accept the basic content of the Preliminary Systems Statement subject to the letter received by Mr. Bob Mazanec of the Metropolitan Council staff regarding the concerns that the City of Hastings has. 7 Ayes 0 Nayes PRELIMINARY SYSTEMS STATEMENT Chairman Stoffel called a Public Hearing PRELIMINARY PLAT - INDUSTRIAL for June 13, at 7:30 P.M. to discuss BUILDERS - 990 WESTVIEW DRIVE the preliminary plat proposed by Industrial Builders for property located at Westview Drive and Highway 55. Chairman Stoffel referred the variance VARIANCE - AL KIEFFER - requested by Mr. A1 Kieffer to a committee 2420 SOUTHVIEW COURT consisting of Commissioners Wendler, Stoffel and Terrell. Moved by Commissioner Fischer, seconded by Commissioner Wendler to recommend to the Council that the C-1 zoning district be amended to include the following items as permitted uses: ORDINANCE - C-1 ZONING DISTRICT Planning Commission Minutes May 23, 1977 Permitted Uses: A. Medical offices and clinics; B. Dental offices and clinics; C. Essential service structures including but not limited to buildings such as telephone exchange stations, booster or pressure sub-stations, and electric sub-stations. D. Offices of persons in the professions; E. Offices for administration, executive, professional research or similar organizations, and laboratories having only limited contact with the general public; F. Retail sales and service establishments of such scale as to serve the neighborhood, to include only the following: 1. Barber shop or beauty shops, 2. Day nursery or daycare centers; 3. Gift shops; 4. Art studios and interior decorating photographic studios, music studios, dance studios; 5. Laundromats; 6. Real Estate and Insurance offices; 7. Picture framing and picture stores; 8. Mens and womens apparel stores; 9. Florists shops; and dry cleaning pickup; studios and 10. Second Floor Apartments as a permitted use In addition existing permitted uses in a C-1 district should be eliminated and a height restriction of 25' placed on all new buildings in a C-1 zone. 7 Ayes 0 Nayes.
