MONDAY, JUNE 13, 1977
7:30 P.M.
The meeting was called to order at 7~:30 P.M. by Chairman Stoffel.
Members Present: Stoffel, Gergen, Terrell, Murray, Fischer, Wendler,
Johnson and Kramer
Member Absent: Groth
Commissioner Kramer indicated that the minutes
omitted the discussion of modifying the C-1
zoning ordinance to allow second floor apartments as a permitted
use.
Moved by Commissioner Fischer, seconded by Commissioner
Weldler to approve the Minutes as amended. 8 Ayes - 0 Nayes.
The public Hearing was called to order at 7:30 P.M. by
Chairman Stoffel. The Planning Director referred to
the Notice of Public Hearing, which was published twice
in the legal newspaper, and the Certificate of Mailing.
The Planning Director informed the Commission that
no information has been provided regarding the proposed
elevations and as a result, the staff recommends that
the Public Hearing be continued to the June 27, 1977
meeting.
Moved by Commissioner Wendler, seconded by Commissioner
Johnson to continue the Public Hearing until June 27, 1977.
8 Ayes - 0 Nayes.
The petitioner requests a variance of one foot from
the zoning ordinances 4 foot setback requirements for
a garage. At the present time the only access to the
property is from Sibley Street. Since garages are
viewed as a necessity, and the only place that it is
possible to construct a garage is in a location suggested
by Isobel Carsten, the variance seemed justified.
Moved by Commissioner Fischer, seconded by Commissioner
Murray to grant a one foot variance for the construction of
a garage three feet from the property line subject to a
verification of the property line with a survey. 8 Ayes -
0 Nayes.
Mr. Wes Franzmeier has submitted an application
for a home occupation permit to allow the use of his
home as a real estate office. The business involves
Mr. Wes Franzmeier and his mother, both residents
of 2410 Southview Court. The item was referred to the
Kramer Committee by Chairman Stoffel.

Mr, Kieffer asked for a variance from the City's zoning
ordinance to allow the construction of an attached garage
two feet from the property line. Mr. Kieffer felt that
such a variance would allow him to keep his home more
in line with the home to the north of him. Mr. Kieffer
indicated that he was not sure of the exact variance because
his plans had not been finalized.

Moved by Commissioner Johnson, seconded by Commissioner
Murray to refer the Kieffer variance request back to a
comittee until plans are finalized. 8 Ayes - 0 Nayes.
The petitioner has submitted plans to add into their
existing single family home to accomodate a nursery
school. Within an R-1 district, day care centers
(nursery school is equivalent), are a special use.

Moved by Commissioner Wendler, seconded by Commissioner
Fischer to call a Public Hearing for June 27, 1977.

Chairman Stoffel referred this matter to the Wendler
Committee.
Mid Continent Development Company has submitted a
preliminary plat entitled 'Whispering Oaks 3rd Addition'.
The plat involves 28 townhouse units on 8.382 acres for
a density of 5.73 units per acre.

Moved by Commissioner Kramer, seconded by Commissioner
Terrell to schedule a Public Hearing For June 27, 1977.
8 Ayes - 0 Nayes.
Judge Electric Company has plans for building a
warehouse and retail facility. At the present time the
property is zoned R - 2 and the petitioner requests that
the property be rezoned to C - 3.

The item was referred to the Fischer Committee by
Chairman Stoffet.
Commissioner Fischer indicated that he felt that it would
be inappropriate to investigate only the request by Judge
Electric Company, but rather the Committee should investigate
some broader issues, such as the desirability of C - 3 as the
commercial zone in this area.
The planning Commission agreed that Commissioner
Fischer should broaden the Committee's investigation
as he saw fit.
Moved by Commissioner Fischer, seconded by Commissioner
Wendler to call a Public Hearing for July 11, 1977.

The Schumacher's own property along Hwy 55 and have
requested that the City include their property in that
being considered for rezoning from R-3 to a C-3 zone.
Chairman Stoffel referred the item to the Kramer
Co~ittee.
Moved by Con~issioner Wendler, seconded by
Commissioner Murray to adjourn at 8:39 P.M.
