HomeMy WebLinkAbout06/27/77PLANNING COMMISSION MINUTES MONDAY, JUNE 27, 1977 The meeting was called to order at 7:32 P.M. by Chairman Stoffel Members present: Stoffel, Gergen, Terrell, Fischer, Groth, Kramer and ~rry. Commissioner Wendler arrived at 9:33 P.M. Commissioner Murry indicated that his name is spelled Murryand not Murray as shown in the minutes. Moved by Commissioner Fischer seconded by Commissioner Terrell to approve the minutes as amended. 7 Ayes 0 Nayes. APPROVAL OF MINUTES The Public Hearing was opened at 7:36 P.M PUBLIC HEARING - MID CONTINENT by Chairman Stoffel. The Executive DirectorDEVELOPERS - PLEASANT DRIVE referred to the affidavit of Publication, AND FOURTH STREET Notice of Public Hearing and the Certificate of Mailing to indicate the Public Hearing hmd been properly called. Members of the k~ispering Oaks Townhouse Assoc. informed the Commission that the legal description included in the Public Hearing notice was inaccurate. The Planning Director informed the Commission that the legal description which was attached to the application was the one used to schedule the Public Hearing. After all people present afforded an opportunity to be beard, the Chairman closed the Public Hearing at 7:58 P.M. Moved by Cormmissioner Fischer, seconded by Commissioner Murry to reset the Public Hearing for the plat submitted by Mid Continent Development for July 11, 1977. Public Hearing for James and Kathleen Tanner was opened at 8:00 P,M. by Chairman Stoffel, The Planning Director referred to the Affidavit of Publication, the Notice of Public Hearing and Certificate of Mailing as documentation that the Public Hearing was properly called. PUBLIC HEARING - JAMES AND KATHLEEN TANNER - 1331 W. 17TH STREET The Tanners are seeking approval from the City of Hastings for a nursery school which will be attached to their family home located in an R-1 zoning district. The proposal by the Tanners requires a Special Use Permit. Mr. Theodorsen submitted a petition signed by 21 residents of W. 17th and 18th Street apposing the granting of a Special Use Permit Several residents from the neighborhood spoke to object to the proposal indicating that they felt that the nursery school would generate too much traffic fro a residential neighborhood. At 8:30 P.M. Chairman Stoffel closed the P.H. after all people were given an opportunity to be heard. Moved by Commissioner Murry, seconded by Con~nissioner Gergen to deny the Special Use Permit. 5 A~s Terrell and Fischer Nay. Mr. Franzmeier is requesting of the City a Home Occupation Permit to conduct his real estate business in his home. The business involves his mother and himself and at the present time entails selling off the newly platted lots adjacent to their home. H~ OCCUPATION PERMIT - WES FRANZMEIER 2410 SOUTHVIEW COURT Moved by Co~issioner ~rry and seconded by Co~n~nissioner Groth to approve the Home Occupation Permit. 3 Ayes Terrell, Gergen, StoffeI, Nay and Fischer abstained. The petitioner has requested a variance VARIANCE - ALLAN KIEFFER - from the seven foot setback requirement 2420 SOUTHVIEW COURT to allow construction of a home and attached garage to within two feet of the property line. The petitioner claims that since the lot is on a cul-de-sac and is of unusual shape, the build- ing would have robe constructed behind the home to the north unless a variance can be granted. Moved by Commissioner Terrell todeny the request for a variance because there is no evidence of unnecessary or undo hardship in this situation. 5 Ayes Murry and Groth Nay. Planning Commission Minutes June 27, 1977 Page 3 The Schumacher's submitted a letter to the SCHUMACHER LETTER City requesting that their property be re- zoned to a similar zone with other property that is being considered for rezoning between Westview and Pleasant Drive on Highway #55. Commissioner Kramer presented the Committee Report recormmending that the Schumacher property be rezoned to C-3. Moved by Commissioner Kramer, seconded by Commissioner Groth to reco~m~end that the Schumacher property be rezoned C-3. 3 Ayes Gergen, Terrell, Fischer and Murry,Nay. The Huberty's has submitted an application VARIANCE - A.J. for a variance to allow the issuance of a 1966 OAK STREET variance from the side yard setback requirements for a patio which has been converted to a porch. HUBERTY Moved by Commissioner Wendler, seconded by Commissioner Gergen to approve the variance. 6 Ayes Terrell and Fischer Nay. Moved by Commissioner Wendler, seconded by Commissioner Groth to recommend to the City Council that they vacate twenty five feet of Tyler Street. 6 Ayes 0 Nayes Terrell Abstained. FAIRWAY PROPOSAL - VACATION Moved by Commisisoner Fischer, seconded by Commissioner Wendler to adjourn at 10:30 P.M. 8 Ayes 0 Nayes. ADJOURNMENT STREET
