Stoffel, Gergen, Terrell, Murry. Johnson, Wendler Don Latch and Walt Peterson by Chairman Stoffel Fischer, Kramer, Groth Moved by Commissioner Groth, seconded by Commissioner Terrell to approve the minutes of the July 25, 1977 Planning Commission Meeting. 7 Ayes 0 Nayes APPROVAL OF MINUTES Public Hearing was started at 7:33 P.M. There were no objections from the audience PERMIT Mr. Gergen asked if any cars would be parked 105 W. outside of the building. The only cars parked outside would be for customer pick-up or for estimates. A fence should be built around used parts to hide it from public view. PUBLIC HEARING - SPECIAL USE JAMES SOBERS 23RD STREET There were no objections to the buildings use. Public Hearing was closed at 7:40 P.M. Moved by Conm~issioner Kramer, seconded by Commissioner Groth that a Special Use Permit be granted. 7 Ayes 0 Nayes. Commissioner Terrell noted that the Ordinance HOME OCCUPATION PERMIT under Chapter 10, Sec. 10.11 Subdivision 2 MILDRED HELTON - 1005 W.15TH states that the merchandise sold must originate on the property unless it is incidental to the main commercial operation which was not in the case of the Helton's Commissioner Murry was not sure that this part of the Ordinance applied to the Helton's Commissioner Fischer stated he thought all Mr. Terrell is saying is that the Home Occupation involves clarification and better equal enforce- ment. Planning Commission Minutes .AugUst 8, 1977 Page 2 commissioner Groth recommended approval of a Home Occupation permit for Mildred Helton, seconded by Commissioner Murry. 5 Ayes, Terrell and Fischer Abstained. A plan was presented by Art Groth, Villa Development Corp. proposal putting rental townhouse or four plex units on the site there would be 18 units in all. SPECIAL USE PERMIT VILLA DEVELOPMENT COMPANY 700 W. llTH STREET A committee of planning commissioners, Terrell, Fischer, Gergen reviewed the site and recommended against the concept presented by Villa Development. The committee recommended that the concept be rejected because of the potential problems with traffic and safety caused by the development. Moved by Commissioner Fischer to reject the development concept submitted by Villa Develop- ment Corp. Seconded by Commissioner Terrell 4 Ayes 2 Nayes Art Groth abstained. The Planning Commission felt that allowing a clrive-in/backout type car wash, it would add more to the traffic problems already at this intersection. (Second highest accident corner in Hastings) VARIANCE - JOHNSON STANDARD 15TH AND VERMILLION The C~,~Rs~ion also felt that due to the shortage of space near the car wash this could hinder the car wash traffic. The Standard Station presently needs more parking space for its present pumps. They are negotiating more land to solve this problem. Therefore, Commissioner Murry moved to deny a Special Use Permit for a car wash. Seconded by Commissioner Fischer. 7 Ayes 0 Nayes. Chairman Stoffel wanted to know how tall the chimney was going to be because his neighbors windows could be affected. Chairman Stoffel referred Commissioner Kramer's committee to look into the size and/or requirements that are necessary for a variance. VARIANCE - WILLIAM COLLINS 317 W. 3RD STREET Commissioner Kramer brought up the variance to grant Fairway Foods a loading dock for parcel pick-up. VARIANCE - FAIRWAY FOODS LOADING DOCK Moved by Commissioner Fischer, seconded by Commissioner Murry to grant a variance based on Council Action. 7 Ayes 0 Nayes. Planning Commission Minutes August 8, 1977 Page 3 A Public Hearing for a rezoning of Country Village 1st Addition was set for August 22, 1977 at 7:30 P.M. The land is currently zoned R-3 and the owner wants to replat and rezone it to R-1 PUBLIC HEARING - REZONING R-3 - R-1 BLOCK 1 LOT 1 COUNTRY VILLAGE 1ST ADDITION Moved by Commissioner Fischer, seconded by Comm~issioner Terrell to adjourn at 9:15 P.M. 7 Ayes 0 Nayes.
