MONDAY~ AUGUST 22~ 1977
The Meeting was called to order at 7:32 P.M.
Members present: Stoffel, Gergen, Terrell,
and Groth.
Members Absent: Murry, Fischer

Moved by Commissioner Gergen, seconded by
Commissioner Wendler to approve the minutes
of August 8, 1977 7 Ayes 0 Nayes.
APPROVAL OF MINUTES
Chairman Stoffel opened the Public Hearing
at 7:34 P.M. The Planning Director indicated
that in the file was the ~otice of Public
Hearing, Affidavit of Publication and
Certificate of Mailing, thus, the Public
Hearing was properly called. After all
people were afforded an opportunity to be
heard, the Public Hearing was closed at 7:38 P.M.
by Chairman Stoffel.
PUBLIC HEARING - ZONING
AMENDMENT - L.H. MEYERS JR.
WEST 23RD STREET
The Planning Director explained to the Planning
Commission that the request involved not only
the rezoning, but the replatting of the property
on W. 23rd. St. It was suggested that the Planning
Commission schedule a Public Hearing on the Preliminary
plat for their next meeting.
Moved by Commissioner Wendler, seconded by Commissioner
Johnson to rezone the petitioned property from R-3 to
R-1. 7 Ayes 0 Nayes.
Moved by Commissioner Wendler, seconded by Commissioner
Johnson to schedule a Public Hearing for September 12th
1977 at 7:30 P.M. on the Preliminary Plat. 7 Ayes
0 Nayes.
Commissioner Kramer gave the committee
report and suggested that the Planning
Commission that a variance be granted for
the construction of the fire place. Some
Commission members expressed concern about!
a proximity of the chimney to the neighbors
second floor window.

Chairman Stoffel suggested that the item be
tabled to allow an opportunity to talk with
the Fire Marshall and Building Inspector.
Moved by Commissioner Gergen, seconded by
Commissioner Groth to grant a variance for
the construction of a fireplace. 4 Ayes
Stoffel abstained, Wendler and Johnson Nay.
The Planning Director indicated that the FINAL PLAT - INDUSTRIAL
final plat conforms with the preliminary BUILDERS - 999 WESTVIEW DRIVE
plat and a recommended approval. Moved by
Commissioner Wendler, seconded by Commissioner
Terrel to approve the final plat for Industrial
Builders located at 999 Westview Drive. 7 Ayes
0 Nayes
The request for a variance and site plan VARIANCE AND SITE PLAN REVIEW
review by Industrial Builders was before INDUSTRIAL BUILDERS (RED OWL

At that time,the Commission gave conceptual CENTER)
approval to allow the construction of some
loading docks on the west side of the shopping
center and a variance for the construction of
a new parking lot five feet rather than the
required ten feet from a property line. The
revised proposal nowhas one additional loading
dock and the parking lot with a 0 setback rather
than the five foot setback. Concern was expressed
about the additional loading dock and the fact that
it was not designed for angle parking like the other
three facilities. Mr. Swanson assured the Planning
Commission members that there will be no trucks back-
ing up to the facility and in fact, it was basically
an entry way into the building and not a loading dock.
Moved by Commissioner Groth, seconded by Commissioner
Wendler to approve the variances and site plan subject
to theedeveloper submitting a revised plan showing a
surmountable curb on the east side of Eddy Street,
Mr. Swanson and the Planning Director meeting with
the neighbor west of the parking lot to decide on an
appropriate fence, the new Red Owl sign conforming to
the City Sign Ordinance, and the driveway onto Eddy
Street being twnety-four feet wide. 7 Ayes 0 Nayes.

Chairman Stoffel referred the request
for a Home Occupation Permit to the Fischer
Committee.

The Planning Director explained that due to
the limitation of time, as staff suggests
that we not go through the lormal procedure
of completely revising the five year Capital
Improvements program, but rather update the
list of Capital Improvements which should be
scheduled for 1978. The Planning Director
suggested that a complete review of the
Capital Improvements program should take place
every two years, ~ath~r than every year as it
has occurred in the past In addition, the staff
plans on submitting information about creating
improvement districts in the City in the hopes
that this will help the success ratio for pro-
posed improvement projects and also puts the
City in a better position to apply for a
Community Development funds to assist in
Capital Improvements.
Additional information on the topic will be
available at the next Planning Commission
meeting.
CAPITAL IMPROVEMENTS PROGRAM
The Planning Director explained that Mr. BUILDING PERMIT REQUEST
Patrick Carlone was attempting to obtain PATRICK CARLONE
a building permit for property located at
Pine and Highway #55. Mr. Carlone has asked
to move a home onto the site which has problems
with drainage, utility connections and access.
Because of the difficulties with this request,
the Planning Director asked that a committee
be available for referral if it beccr~es necessary.
Chairman Stoffel referred the matter to the
Wendler Committee ir i~ibeccmes necessary to consult
the Planning Commission.
Moved by Commissioner Wendler, seconded by
Commissioner Groth to adjourn at 8:53 P.M.
