MONDAY, SEPTEMBER 12, 1977
The meeting was called to order at 7:33 P.M. by Chairman Stoffel.
Members present~
Commissions' Stoffel, Gergen, Johnson, Fischer,
Kramer, Groth~ Murry and Terrell who arrived at
7:36 P.M.
Moved by C~mmissioner Kramer, seconded by
Commissioner Murry to approve the minutes
of the August 22, 1977 Planning Commission
Meeting~ 7 Ayes 0 Nayes
APPROVAL OF MINUTES
The Public Hearing was opened at 7:34
by Chairman Stoffel~ The Planning Director
indicated that the Public Hearing had been
properly called by reviewing the Notice of
Public Hearing, the Affidavit of Publication
and the Certificate of Mailing that was on
file~ After all people present were afforded
an opportunity to be heard, the Public Hearing
was closed at 7139 P.M~ by Chairman Stoffel.
Moved by Commissioner Fischer~ seconded by
Commissioner Johnson to approve the Preliminary
Plat subject to the drawing being modified to
show individual sewer and water connections
to e~ch lot facing 23rd. Street and that the
dr~wIngs are l~beled to indicate that the
contours are both existing and proposed
elevations, 8 Ayes 0 Nayes,
PUBLIC HEARING - PRELIMINARY
PLAT ~ KAROL ESTATES WEST
23RD STREET
Moved by Commissioner Fischer, seconded
by Commissioner Groth to approve the Site
Plan for a 44 x 13 foot addition onto the
Cahlll Meat Market subject to Mr. Cahill
submitting a letter to the City indicating
his willingness to remove all trash presently
stored behind the building by Nov. 30, 1977
and that a revised Site Plan show plantings
and a screen for the trash storage area which
meets the approval of the City Planner and
all these ~mprovements are to be made by May 31,

Moved by Commissioner Johnson, seconded ENFORCEMENT - REQUESTING
by Commissioner Murry to request that the COUNCIL TO ENFORCE SECTION 9.55
City Council enforce Sec. 9.55 of the City PUBLIC NUISANCE
Code regarding Public Nuisances. A particular
problem is on 23rd Street between T.H.#61 and
Cannon Street 8 Ayes 0 Nayes
Chairman Stoffel referred the request
for a variance by Gordon Robey to the
Kramer Committee.

Chairman Stoffe~/referred the zoning
amendment of Sec. 10.23 to the Fischer
Committee for further Study.
ORDINANCE - AMENDMENT OF SECTION
10.23 - ACCESSORY BUILDINGS
The Planning Commission expressed concern
regarding the credentials of this individual 718 W.
to run a "Christian Counseling Service". The
Planning Director explained that the Planning
Commission was not in a position to judge the
individuals credentials and had to use the
criteria listed in the zoning ordinance as
the sole means of passing judgement on the
application.

Moved by Commissioner Kramer, seconded by
Commissioner Groth to grant a Home Occupation
Permit. 3 Ayes Fischer, Stoffel and Terrell
abstained, Gergen and Murry Nay
The Planning Director reviewed the Capital CAPITAL IMPROVEMENTS PROGRAM
Improvements suggested by the staff for the
year 1978. The list that was reviewed constitutes
an update of last years Capital Improvements Program.
The Commission asked that a map of the Capital Improve-
ments Program be included in the next packet for further
discussion.
The Planning Director informed the Com- MIDTOWN REMODELING PROGRAM
missioners that Mr. Olson, the City Engineer,
had told him that it would not be possible to
have a surmountable curb on the east side of
Eddy Street behind the Midtown Shopping Center
as was discussed at a previous Planning Commission
meeting. The Engineer explained that Eddy Street is
too flat to construct ~onstruct the proposed curbing
and maintain drainage along the street.
Chairman Stoffel referred the matter to the Wendler
Committee for further study.
Moved by Commissioner Fischer, seconded by
Commissioner Groth to adjourn at 9:39 P.M.
