Members present: Commissioners Stoffel, Ge. rgen, Terrell, Murry,~/g~o Commissioner Kramer arrived at 7:32 P.M. and Commissioner Groth arrived at 7:38 P.M. Members absent: Cormnissioner Johnson who was hospitalized. Moved by Commissioner Fischer, seconded by Commissioner Murry to approve the minutes of October 11, 1977. 6 Ayes 0 Nayes. APPROVAL OF MINUTES Chairman Stoffel opened the Public Hear- REZONE FIRST BAPTIST CHURCH ing at 7:32 P.M. Zoning Officer indicated PROPERTY - WEST SIDE OF PLEASANT that within the file was the Notice of DRIVE BET%~EN 23RD AND 25TH STREET. Public Hearing, Affadivit of Publication and Certificate of Mailing. Thus, the Public Hearing was properly called. The Zoning Officer explained that the staff recommendation was to approve the rezoning request and to limit the rezoning to only that land mentioned in the church's proposal as the staff feels that the remaining land in that zoning district is not ready for development and should remain zoned agricultural until such time as it is ready for development. The Zoning Officer also explained that in regards to the possible moritorium on rezoning over three acres brought up at the last Planning Commission meeting, staff felt that such a morotorium would not be a good idea at this time. Commissioner Wendler stated that he had met with City staff to discuss the matter and that he agrees with staff recommentaions. After all people present were afforded an opportunity to be heard, the Public Hearing was closed at 7:40 P.M. Moved by Commissioner Fischer, seconded by Commissioner Wendler to rezone the petitioned property from A to R-1. 6 Ayes Gergen abstained, Terrell Nay. Planning Commission Minutes October 24, 1977 Page 2 Mrs. Ann Hare, a local resident told the PROPOSED REGIONAL WASTE DISPOSAL Planning Commission that she had been at SITE FOR THE HASTINGS AREA the Metro-Council Committee Public Hearing on sites for waste disposal facilities. She said that Hastings or the Hastings area was discussed as being considered for a waste disposal facility site and that she felt that the Planning Commission should be aware of those proceedings. The Planning Commission requested that City staff look into the matter and have input into the process. Chairman Stoffel referred the request for a Home Occupation permit to the Wendler Committee. JAMES PETERS 910 W. 9TH STREET Zoning Officer explained to the Planning PRELIMINARY PLAT Commission a list of concerns that the ADDITION City staff has with the preliminary plat. He indicated that the total number of units in the proposed project exeeeded the number allowed by the density requirements in the City Zoning Ordinance, but that in 1971, the City Council had approved the total number of 247 units provided all other zoning requirements were met. He suggested that in order to clarify the record, the Planning Commission should grant a variance on thetotal number of units. Moved by Commissioner Fischer, seconded by Commissioner Wendler to schedule a Public Hearing for November 14, 1977 on the preliminary plat contingent upon the developer satisfying City staff concerns prior to the dead line for publication of notification of Public Hearing. Also to have the City staff check to see if the developer is complying with previously approved plans and checking with the City attorney to see what authority the City has in with-holding future building permits if the developer has not developed according to approved plans. 8 Ayes 0 Nayes. Mrs. Eleanor Liska, a resident of the PRELIMINARY PLAT existing townhouses, told the Planning THIRD ADDITION Commission that the residents of the townhouses were concerned with the amount of fill being brought in on the project and that they were also worried about drainage - WESTVIEW - WHISPERING OAKS PHASE II Planning Commission October 24, 1977 Page 3 problems around the project. The Zoning Officer informed the Planning Commission that drainage and fill were among the points listed by the staff as concerns the staff has with the pro- posal. He went over the other staff concerns with the Planning Commission. Moved by Commissioner Groth, seconded by Commissioner Wendler to schedule a Public Hearing for November 14, 1977 on the preliminary plat contingent upon the de- veloper satisfying City staff concerns prior to the deadline for publication of notification of public hearing. 8 Ayes 0 Nayes. Commissioner Fischer gave the committee COMMITTEE REPORTS report on the proposed amendment to Sec. 10.23 Footnote C. (District Lot Regulations) of the City Code. Moved by Commissioner Fischer, seconded by Commissioner Terrell to amend Section 10.23 Footnoot C. of the City Code to read as follows: Co Buildings over two (2) stories in-height shall require (5) feet for each additional story in addition to the required minimum side yard. Residential garages shall have a minimum side yard (corner) setback of 20 feet when the driveway enters directly onto the side street. 8 Ayes In the event the normal setback of structures on the street being entered by the driveway exceeds 20 feet, the City Council may require a greater setback in order to avoid non-conformance with the alignment of structures along that street. 0 Nayes Moved by Commissioner Fischer, seconded by Commissioner Wendler to adjourn at 9:37 P.M. 8 Ayes 0 Nayes ADJOURNMENT
