Members Present; Conmissioners Stoffel, Gergen, Terrell, Fischer, Kramer, Gergen, and ~urry who arrived at 7:31 P.M. Members Absent: Johnson and Wendler Moved by ~ssioner Groth, seconded by Con~ssioner llurry to approve the minutes of Novamber 14, 1977. 7 Ayes 0 Nayes. APPROVAL OF MINUTES Chairman Stoffel opened the Public Hearing at 7:33 P.M. The Zoning Officer indicated that on file was the Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. Thus, the Public Hearing was properly called. The Zoning Officer explained that since the last Planning Co~raission meeting, the developer had submitted new plans showing sewer and water locations but that fire hydrant locations were not shown and that a drainage and utility easement would be needed on the east side of the property. Comnissioner Groth gave the conraittee report recommending approval of the petitions but suggested researching the possibility of having the jog in the Right-of-Way revert to the City if the existing house is ever removed. PUBLIC HEARING - REZONING - PRELIMINARY PLAT - SPECIAL USE PEPA{IT - PROPOSED VAI,I,EY WEST ADD. WEST SIDE OF FAI~ ST. BE/~aEN 1ST & 2ND ST. ALOIS CONz~IUS Moved by Co~nissioner Fischer, seconded by Conraissioner Groth to approve the Rezoning frcm A to R-2. Special Use Permit for a duplex and Preliminary Plat subject to the developer indicating fire hydrant locations to be approved by the Fire Marshall. Also to approve a variance to the Right-of-Way width as shown on the plat subject to a legal opinion as to whether the City could grant a temporary variance to have the right-of-way width as shown on the plat subject to a legal opiniom as to whether the City could grant a temporary variance to have the right-of-way revert back to a full 66 feet if and when the existing house is removed. 7 Ayes 0 Nayes. planning C~ssion Minutes November 28, 1977 Page 2 The Welch's have petitioned to have their land rezoned fr~n A to R-1 for the purpose of sub- dividing. The Zoning Officer explained that because the property has frontage on a County Highway, the preliminary plat must be reviewed by the County before the City could act on it, but that he felt the City could consider the re- quest for rezoning at this time. Some Ccarnissioners expressed concern over whether rezoning would con- flict ~rith flo~plain regulations and the issue of an access easement to the City's property on the north side of the plat. Chairman Stoffel scheduled a Public Hearing for the December 12, 1977 Planning Conmission m~eting and requested the staff to provide more in- formation on the status of the floodplain and possibilities for access tothe City property. REZONING - NORTH OF COUNTY HIGHWAY 47 AND ~ OF TIE VERMILLION RIVEt{ - HAROLD AND RUSS~,L WELCH The Planning C~rmission discussed the need for PRELIMINARY PLAT - COUNTRY CLUB 4th preserving an easement for a possible pedestrian ADDITION - SOUThWIEW DRIVE - DONALD pathway through the plat. Chairvran Stoffel FLUEGF~, scheduled a Public Hearing for the December 12, 1977 Planning C~ssion meeting and asked that the staff provide a copy ofthe park plan and more information from the Natural Resources Coranission as to why the easement should be preserved for a pathway. Cor~nissioner Fischer gave the conmittee report RENEC~)TIATION OF DEVELOPMENT AGP~ stating that the conmittee bad met with Mr. FOR WESTVIEW SHOPPING CENteR Robert Swanson of Industrial Builders and he had agreed to submit plans to the City for a building addition to store waste materials before the end of the year. The conraitte~also suggested that the item in the development agTee~ent requiring that all roof- top machinery be screened shoud be eliminated. Moved by Cor~nissioner Fischer, seconded by C~ssioner Kramer to implement the findings of the Fischer cc~Inittee mem~. 7 Ayes 0 Nayes. The Planning Cc~mission discussed Corrmissioner's TE~MS OF pLaNNING COmmISSION ~BERS terms. Coramissioner Fischer indicated that he would be resigning at the end of his term in Decernber.
