Six ayes, zero nays. APPROVAL OF MINUTES The Public Hearing wasopened at 7:33 P.~L by Chairman Stoffel. The 7~ning Officer referred to the Notice of Public Hearing, the Affadavit of Publication and the Certificate of Mailing thtk~ the Public Hearing was properly called. PUBLIC HEARING - REZONING NORTH OF ODUNTY HIGHWAY 47 ~ST OF VERMILLION RIVER - HAROLD ~ HUSh. ELL The Z~ningOfficer made reference to the Flood Plain boundaries indicated on the map of the Welchs property. He explained to thePlanning Conntission that the Floodway could not be rezoned and the rezoning pertained only to those areas of the property that were either in the Flood Fringe or not in the Flood Plain at all. He also explained that the rezoning would be from A-Flood Fringe and A-Zoning District to R-1 Flood Fringe and R-1ZoningDistricts. Comnissioner Groth indicated that he wanted to see the official zoning map with the flood plain boundaries on it. He felt that the boundaries were not fairly designated and stated that he could not vote on this rezoning as he had personal feelings regarding the flood plain issue. ConnRssioner Terrell felt the flood plain boundaries were not defined clearly enough and also voiced a concern that the people buying property in the flood fringe might not be aware of the additional building constraints the flood fringe designation puts on a piece of land. After all peoplepresent had a chance to be heard on the matter, Chairman Sto£fel closed the Public Hearing at 8:16 P.M. ~oved by Conmissioner Terrell, seconded by Co~nissioner C~rgen that the City of Hastings declare a 90 day moratorium on all rezoning on Vermillion River west of Hwy. 61. q%vo ayes, Murry, Kramer, Stoffel, nay, Groth abstaining. Moved by Cor~nissioner Kramer, seconded by Co~nissioner M~rry to rezone the property as indicated in the staff memo. Three ayes, Terrell and C~rgen nay, Groth abstaining. -2- Plmmin~ Commission ~lnutes January 9, 1978 The Public Hearing was opened ~t 8:29 P.M. by Chairman Stoffel. The Zoning Officer n~de reference to the Notice of Public Hearing, Affadavit of Publication and Certificate of ~ailing thus the Public Hearing was properly called. The ?mning Officer explained that since the last time this preliminary plat had been before the Planning Commission the developer had submitted a revised preliminary plat showing proposed sewer and water locations, street grades and approximate total acreage as required by the Subdivision Ordinance. Coranissioner Kramer gave the conrzittee report stating that the Kramer conmittee had reviewed the plat and found it to be in accordance with the staff report of Dec~mber 9th, 1977 and reconmended approval. A nearby property owner asked about the drainage on one area of the plat. The ?tuning Officer explained that the area he was questioning had been a special concern to the City staff and the developer had provided drainage proposals for the area. After all people were afforded an opportunity to be heard on this mtter, Chairman Stoffel closed the Public Hearing at 8:37 P.M. Moved by Ccranissioner Kramer, seconded by Conmissioner Groth to approve the preliminary plat for Dakota Hills 5th Addition. Six ayes, zero nays. Mr. Franz Altpeter from Profile Extrusions made a presentation to thePlanning O~mmission explaining ~at the Cx)mpany proposed to do in the next few years and explained what their intentions were for the upcoming year. He answered scme questions from the Planning Coranission members and explained that Profile was concerned with expediting the review process. He stated that a preliminary plat would be forthcoming to the City Staff within the next week and the Planning Cx~anission would be seeing it hopefully at their next meeting. Chairman Stoffel referred the matter to the Kramer committee to be contacted when the preliminary plat is received by City staff. The Zoning Officer explained that the owners of Hastings Farmers Market had contacted him throughout the Fall on their plans for expanding their facility at 14th and Vermillion St. He indicated that the staff had been working with the owners to try and work out a proposal which would meet City zoning requirements. He also indicated that the owners were interested in obtaining a variance to allow them to have on-street parking to lend a portion of their property for more display area for their product. He asked that City staff arrange the meeting. Moved by Commissioner Kramer, seconded by Commissioner Groth to adjourn at 9:30 P.M.
