HASTINGS PLANNING COMMISSION
MONDAY, FEBRUARY 13, 1978
7:30 P.M.
The meeting was called to order at 7:33 P.M. by Chairman Stoffel.
Commissioners Stbffel, Wendler, Legler, Terrell, Gergen,
Groth, Kramer, Johnson, who arrived at 7:41 P.M. and
Murry, who arrived at 8:17 P.M.
Members Absent: None
Moved by Commissioner Wendler, seconded by
Commissioner Kramer to approve the Minutes of
the January Z3, 1978 meeting. 7 Ayes - 0 Nayes.
APPROVAL OF
MINUTES
The Public Hearing was opened at 7:35 P.M. by
Chairman Stoffel. The Zoning Officer referred to the
Notice of Public Hearing, the Affidavit of Publication
and the Certificate of Mailing; thus the Public Hearing
was properly called. The Zoning Officer indicated that
the Staff had reviewed the preliminary plat and found it
to meet all applicable city codes with the exception of the
length of the cul-de-sac which would require a variance.
Commissioner Groth questioned the adequacy of the turning
radius of the cul-de-sac noting that large semi trailer trucks
may have difficulty turning in that small a radius. After
all people present had a chance to be heard on the matter,
Chairman Stoffel closed the Public Hearing at 7:39 P.M.

Moved by Commisaioner Wendler, seconded by Commissioner
Legler to approve the preliminary plat with a variance for
the length of the cul-de-sac. 7 Ayes - 0 Nayes.
The Zoning Officer indicated that the square footage
for each lot and the total plat area should be indicated
on 'the city's copy of the final plat. Commissioner
Groth noted that when the dimensions of Lot 1, Block 1
of the plat are multiplied, the resultant is 1/10 of a foot
short of the minimum lot size required by Hastings Zoning
Ordinance.

Moved by Commissioner Kramer, seconded by Commissioner
Wendler to approve the final plat of Country Club 4th Addition
subject to the surveyor indicating individual lot areas and
total plat areas and clarification of the lot area of Lot 1, Block

The Zoning Officer indicated that the site plan, as
shown, for the special use permit requires a variance
for the rear setback. The developer was in the audience
and indicated that he would alter his site plan to meet
all setback requirements.

Moved by Commissioner Groth, seconded by Commissioner
Wendler to schedule a public hearing for the special use
permit for the February 27, 1978 Planning Commission
meeting. 9 Ayes - 0 Nayes.
Chairman Stofiel refermdthe matter to the Terrell
Cornrniftee in the interim.
Commissioner Wendler gave the Committee report and
stated that the Committee had met with Mr. Welch and
recommended that the park dedication requirements
take the form of a 60 foot wide strip of land between the
City property and the County right-of-way which would
not have frontage on the river. Commissioner Wendler
went on to state that his interpretation of the park
dedication ordinance was that when land was proposed to
be dedicated, the City had the option to require cash
in lieu of land. He did not feel that the City, by ordinance,
had the right to require land in lieu of cash, and asked that
the Planning Commission be presented with the City attorney's
opinion on this matter. He also suggested that, if the City
war, ts additional land from this plat, just compensation should
be provided the land oxvner. Mr. Gary Seibert, Chairman of
the Natural Resources Commission, was in the audience and
explained why the NRC made the recommendation it had.
There was considerable discussion about the park plan and
the City's rights in carrying out that park plan. Commissioner
Terrell questioned the advisability on acting on this plat before
hearing what the Council's reaction to the NRC recommendation
that future plats along the south side of the Vermillion River
be required to provide access to and along the river.

Moved by Commissioner Wendler, seconded by Commissioner
Legler to schedule a public hearing for the preliminary plat
for the February 27, 1978 Planning Commission meeting and
to obtain a legal opinion regarding the requirements of the
park dedication ordinance and a recommendation from the
Wendler Committee for a specific area for park dedication.

The Zoning Officer indicated that it had come to the
City Staff's attention that two houses were being
constructed in violation of the City's setback
requirements. He also noted that the two houses
partially extended into utility easements. The
developer has applied for variances from' the setback
requirements and vacation of sufficient amounts of the
utility easements. The discussion centered around the
appropriateness of granting a variance in a case such
as this, the cost of moving the houses, and the
consequences of any action the ]Planning Commission
might take.

Commissioner Terrell to deny the request for
variances. 4 Ayes- Groth, Kramer, Stoffel,
Wendler, Legler -Nay. Motion failed.
Moved by Commissioner Wendler, seconded by
Commissioner Groth to schedule a special meeting
at 7 P.M., February Z1, 1978;prior to the City
Council meeting, to consider the request for
variances and transmit their recommendation
to the Council following that meeting. Also to
require each Planning Commission member to
look at the site prior to that meeting. 8 Ayes -
Gergen, Nay.
A representative from the Villa Development Company
presented a proposal to the Planning Commission which
consisted of a development proposal of a raquet ball
court facility to be located at the Villa Development
property at llth and Pine St. between Pine St. and the
School District property. The Zoning Officer indicated
that the proposal would involve either a rezoning or an
amendment to the zoning ordinance regarding uses by
special permit for an R-Z district. Chairman Stoffel
asked the Planning Cornrnission for a consensus of opinions
on the two alternatives.

Moved by Commissioner Kramer, seconded by
Commissioner Wendler to appoint a committee to
research the alternatives for permitting the proposal
when the developer applies for a special use permit.
8 Ayes - Groth, abstained.
Chairman Stoffel referred the matter to the Terrell
Cornrnittee. Commissioner Gergen asked to be excused
from the Committee on this proposal.

Corrn:nissioner Murr¥ gave a status report on the
proposed ordinance amendment. He noted some
proposed changes to the original ordinance amendment.
ORDINANCE AMENDMENT-
BILLBOARDS
Moved by Commissioner Groth, seconded by Commissioner
Wendler to refer the amendment back to a committee to
determine which parts of town billboards would be limited
to and to determine if signs advertising motels would be
interpreted as billboards. 9 Ayes - 0 Nayes.
Moved by Commissioner Wendler, seconded by ELECTION OF OFFICERS
Commissioner Kramer to cast a unanimous vote to
re-elect Chairman Stoffel. The vote was not unanimous
therefore the motion failed. Chairman Stoffel then opened
the nominations for Chairman of the Planning Commission.
Commissioner Groth nominated Commissioner Stoffel;
Conarnissioner Gergen nominated Commissioner Terrell.
Moved by Commissioner Wendler, seconded by Commissioner
Johnson to close nominations for Chairman. Chairman Stoffet
was re-elected as Chairman of the Planning Commission for
the ensuing year.
Chairman Stoffel opened nominations for Vice- Chairman.
Commissioner Wendler nominated Commissioner Groth;
Commissioner Murry nominated Commissioner Kramer;
Commissioner Gergen nominated Commissioner Terrell.
Moved by Commissioner Johnson, seconded by C hairman
Stoffel to close nominations for Vice-Chairman.
Commissioner Terrell was elected as Vice-Chairman of the
Planning Commission for the ensuing year.
Moved by Commissioner Wendler, seconded by
Commissioner Murry to adjourn at 101.26 P.M.
