APPROVAL OF MINUTES
The Public Hearing was opened at 7:33 P.M. by
Chairman Stoffel. The Zoning Officer indicated that
this was a continuation of the Public Hearing for the
special use permit for a duplex. He indicated that
there had been some question as to the true lot lines
of the property in question and indicated that it had
been resolved, that the State Highway Department has
an easement to cross the Southeast corner of the lot
and not a right-of-way. He also explained that this
easement included provisions that prohibits
access across this area. The Highway Dep.artment
can conduct surface construction and owns all
vegetation in the easement. The owner basically held
title to the property but had very limited use of it.
The Zoning Officer also indicated that the application
also involved a variance from the minimum lot size
requirements. The lot has a total area of 9, 000 square
feet whereas the zoning ordinance requires a minimum
of 9,200 square feet for duplexes with one bedroom units
and 9, 700 square feet for duplexes with two bedroom units.
The variance for this property would be for 700 square feet
below the minimum.
