Members Present: Commissioners Stoffel, Murry, Groth, Kramer, Wendler, Legler, Terrell and Gergen Members Absent: Commissioner Johnson Moved by Commissioner Wendler, seconded by Commissioner Murry to approve the Minutes of the February ZT, 1978 meeting. 8 Ayes - 0 Nayes. APPROVAL OF MINUTES The Public Hearing was opened at 7:33 P.M. by Chairman Stoffel. The Zoning Officer indicated that this was a continuation of the Public Hearing for the special use permit for a duplex. He indicated that there had been some question as to the true lot lines of the property in question and indicated that it had been resolved, that the State Highway Department has an easement to cross the Southeast corner of the lot and not a right-of-way. He also explained that this easement included provisions that prohibits access across this area. The Highway Dep.artment can conduct surface construction and owns all vegetation in the easement. The owner basically held title to the property but had very limited use of it. The Zoning Officer also indicated that the application also involved a variance from the minimum lot size requirements. The lot has a total area of 9, 000 square feet whereas the zoning ordinance requires a minimum of 9,200 square feet for duplexes with one bedroom units and 9, 700 square feet for duplexes with two bedroom units. The variance for this property would be for 700 square feet below the minimum. CONTINUATION OF PUBLIC HEARING - SPECIAL USE PERMIT - AL SIEBEN - 701 WEST 7TH STREET A nearby property owner asked to be assured that there would be no cars parked on the street. It was explained that duplexes are required to provide three off-street parking stalls, but that no assurances could be made that there would never be any on- street parking. After all people present had an opportunity to be heard on the matter, Chairman Stoffel closed the Public Hearing 'at 7:45 P.M. Moved by Commissioner Cergen, secorrledby Commissioner Terrell to approve the special use permit for a duplex with a 700 square foot variance from the minimum lot size requirements. 8 Ayes - 0Nayes. ~lanning Commission Minutes -Z- March 13, 1978 (Continued) Commissioner Murry felt the matter should be looked into by a committee to determine if the fence surrounded the entire property and to review the application closer. Chairman Stoffel referred the matter to the Kramer Committee with Commissioner Gergen to accompany. HOME OCCUPATION PERMIT - DAY CARE CENTER - 1826 FOREST ST. - MR. & MRS. MICHAEL SIEBEN A discussion followed centering whether or not a public hearing should be called to obtain comments from the ne ighb or s. Moved by Commissioner Terrell, seconded by Commissioner Murry to schedule a public hearing for consideration of the home occupation permit for a day care center. 3 Ayes - Groth, Kramer, Stoffel, Wendler and Legler, Nay. Motion failed. The matter will be looked into by the Committee. The Zoning Officer indicated that the final plat was in accordance with the preliminary plat, but that individual lot areas and the total plat area should be shown on the city's copy of the final plat. FINAL PLAT - PROFILE ADDITION - 10TH ST. & PROGRESS DRIVE Moved by Commissioner Groth, seconded by Commissioner Kramer to approve the final plat of Profile addition subject to the surveyor indicating individual lot areas and total plat area on the city's copy of the final plat. 8 Ayes - 0 Nayes. The Zoning Officer indicated that the Staff had listed a number of items in need of revision for the site plan before approval could be granted and explained that a variance for the driveway width is involved in the site plan approval. SITE PLAN REVIEW - 1ST NATIONAL BANK DRIVE -IN FACILITY 1440 NORTH FRONTAGE ROAD Chairman Stoffel referred the matter to the Wendler Committee. Commissioner Murry gave the Committee report COMMITTEE REPORT which indicated the proposed amendments to the billboards ORDINANCE AMENDMENT- section of the sign ordinance. Commissioner Terrell BILLBOARDS suggested an addition that all billboards shall be licensed, the license be renewed yearly, and present billboards will be registered and licensed within 90 days. Moved by Commissioner Kramer, seconded by Commissioner Groth to recommend that the City Council amend Section 10.07, Subdivision 3U of the City Code regarding billboards as the Committee recommendation indicated with the suggestions of the February 10, 1978 Staff memo and Commissioner Terrell's suggestion. 8 Ayes - 0 Nayes. ~planning Commission Minutes (Continued) -3- The Zoning Officer presented the Planning Commission with copkes of the preliminary data collected by Loucks and Associates, the privateetOnsultant doing the update of the Hastings Comprehensive Plan and asked the Planning Commission to closely review the data collected for discussion when Mr. Loucks next appears before the Planning Commission.
