Members Present: Commissioners Stoffel, Murry, Groth, Kramer, Legler, Terrell and Gergen Members Absent: Commissioners Wendler and Johnson Moved by Commissioner Groth, seconded by Commissioner Murry to approve the Minutes of the March 13, 1978 meeting. 7 Ayes - 0 Nayes. APPROVAL OF MINUTES Ellen Hart, from the Dakota County HRA, gave a presentation to explain the background of the program. In August, the City of Hastings and the Dakota County HRA agreed to provide a scattered site new construction program for five (5) iow and moderate income families in Hastings. The HRA has optioned five (5) lots for consideration. Two (g) lots were recommended for consideration for duplex construction and would require special use permits. The Zoning Officer indicated that the Council had referred the matter to the Planning Commission for two purposes: (1) To review the sites indicated and make a recommendation to the Council as to which alternatives the Planning Commission felt was more appropriate; (Z) to begin the special use permit procedure for duplexes at Sites 1 and 4. SPECIAL USE PERMITS DUPLEXES IN AN R-Z ZONE - DAKOTA COUNTY HRA AND CITY OF HASTINGS SCATTERED SITE HOI~SING PROGRAM Commissioner Groth stated that he felt that the County HRA was not following procedures for special use permits that any other private individual would have to conform to. The Zoning Officer explained that the Council had requested the Planning Commission to review the alternatives and make a recommendation on which alternative the Planning Commission was most appropriate, and to begin the normal special use permit procedure which is required of all applications for special permits. Discussion continued on the appropriateness of beginning the special use permit procedure prior to final site approval and neighborhood input on the site selection. Chairman Stoffel referred the matter to the Terrell Committee. Planning Commission Minutes -2- March 27, 1978 (Continued) The Zoning Officer explained that after the Planning Commission had approved a preliminary plat and site plan for Phase II of Whispering Oaks 3rd Addition in November, 1977, the Council had tabled the matter until issues involving access to Whispering Lane, assessment agreements and an easement question were resolved. In order to resolve the problems regarding the assessments and access to Whispering Lane, the developers and adjacent land owners requested that Whispering Lane be vacated. The Planning Commission recommended denial of the street vacation, and the Council had tabled the vacation until the developer presented a revised site plan and preliminary plat for Phase II with access only to 4th Street. The Zoning Officer indicated that the issue before them at this time was the revised preliminary plat and that action on the preliminary plat should include a recommendation on the street vacation issue. PRELIMINARY PLAT WHISPERING OAKS 3RD ADDN. PHASE II - PLEASAI~T DRIVE AlqD 4TH STREET - WHISPER- lNG OAKS PARTNERSHIP Mr. John McDonald, a representative of Whipering Oaks Partnership, indicated that the developers were not asking for approval of a preliminary plat, but that they were asking for a new recommendation on the street vacation issue. Mr. & Mrs. Leo Schumacher, property owners adjacent to Whispering Lane, indicated that they had not been notified of the meeting and that they felt that it was unreasonable for them to be assessed for the improvements on Whispering Lane as their property was not ready for development at this time. The Zoning Officer indicated that the only infornaation the City Staff had indicated that the issue at hand for this meeting was the preliminary plat only, and that since a Public Hearing is required for a preliminary plat, they would have been notified of that meeting. Moved by Commissioner Murry, seconded by Commissioner Groth to deny the street vacation. 4 Ayes - Kramer, Stoffel, and Legler, Nay. Moved by Commissioner Groth, seconded by Commissioner Legler for the Planning Commission to meet with the property owners adjacent to Whispering Lane to discuss the development and use of Outlot B serviced by Whispering Lane. 7 Ayes - 0 Nayes. Later in the meeting, the Planning Commission scheduled the meeting with the property owners adjacent to Whispering Lane to be 1/2 hour before the next Planning Commission meeting. Planning Commission Minutes -3- March 27, 1978 (Continued) The Zoning Officer indicated that the final plat was in accordance with the preliminary plat and recommended approval subject to the developer indicating individual lot areas and total plat area on the City's copy of the final plat. FINAL PLAT - DAKOTA HILLS 5TH ADDITION - 14TH & PLEASANT DRIVE- HAS TINGS CONS TR UC TION Moved by Commissioner Groth to approve the final plat subject to the developer indicating individual lot areas and total plat area on the City's copy of the final plat. 7 Ayes - 0 Naye s. Mr. Terrell presently has an existing garage which sits partially in the alley right-of-way. He proposes to build a new garage 8 feet from the alley right-of-way and up to the rear property line. The variance request is from the rear yard setback of 5 feet for a detatched garage. Chairman Stoffel referred the matter to the Wendle r C ornrnitte e. VARIANCE - SETBACK REQUIREMENTS FOR A GARAGE - 517 RAMSEY ST. - MILTON TERRELL The Zoning Officer indicated that the architect had submitted revised site plans addressing each of the items mentioned in the k4arch 10~ 1978 Staff memo, but by addressing the grades on the driveway from Pleasant Drive, the grades from the exits on the North Frontage Road had been increased. He indicated that the architect had addressed that problem also, but that the Staff had not had adequate time for a complete review, and that approval of the site plan should be conditioned upon City Engineer's review of the grade situation. SITE PLAN REVIEW - 1ST NAT'L BANK DRIVE- IN FACILITY - 1440 NORTH FRONTAGE ROAD Commissioner Groth gave the Committee report which expressed concern over drainage from the City water tower on the southwest and also drainage from Hwy 55. The Committee was also concerned about the status of the North Frontage Road which is in the 1978 Capital Improvements Program and the assessments for that road against adjacent property owners. Chairman Stoffel referred the matter back to the Wendler Committee. Commissioner Kramer gave a Committee report which HOME OCCUPATION recommended approval subject to the following conditions: PERMIT - DAY CARE CENTER - 1826 FOREST 1. No more than 6 children should be permitted. ST. - MR. & MRS. MICHAEL SIEBEN 2. A fence should be required for the safety of the children and to insure the neighbors are not disturbed. Planning Commission Minutes -4- March ZT, 1978 (ConI:inued) The Zoning Officer informed the Planning Commis sion that he had been in contact with the Dakota Cotmty Welfare Dept., and reviewed a number of the requirements the Welfare Dept. places on applicants for day care operations. Moved by Commissioner Kramer, seconded by Commissioner Legler to approve the home occupation permit for the day care center with the conditions mentionsd in the Committee recommendation. 4 Ayes - Murry, Terrell, Ge~'gen, Nay.
