MONDAY APRIL 24, 1978
7:30 P.M.
The meeting was called to order at 7:30 P.M. by Chairman Stoffel.
Members Present: Commissioners Stoffel, Murry, Groth, Kramer,
Legler, Terrell and Gergen
Members Absent: Commissioner Wendler
Moved by Commissioner Murry, seconded by
Commissioner Groth to approve the minutes
of the April 10, 1978 meeting.
7 ayes - 0 hayes.
The public hearing was opened at 7:31 p.m.
by Chairman Stoffel. The zoning officer
made reference to the notice of public
hearing, afidavit of publication and cert-
ificate of mailing. Thus the public hear-
ing was properly called.
Mr. and Mrs. Tanner are proposing to con-
duct a pre-school kindergarten in St.
Philip's Lutheran Church during week days.
A special use permit is required for this
type of activity in an R-1 zone district.
In June of 1977, the Tanners had made a
similar request for their residence on
West 17th Street which was denied. The
new location proposed at this time did
not pose the problems the previous request
had.
After all people were given an opportunity
to be heard, Chairman Stoffel closed the
public hearing at 7:33 p.m.
Moved by Commissioner Murry, seconded by
Commissioner Legler to approve the special
use permit. 7 ayes - 0 nayes.
The City Council had referred this pre-
liminary plat back to the Planning Comm-
ission to review the street design of
Whispering Lane and comment on a develop-
ment contract between the City and the
developers regarding the payments for
street improvements on Whispering Lane
and conditions under which certificates
of occupancy would be issued. The zoning

officer indicated that the staff had re-
viewed the street design submitted by the
developers and he commented on two points
the staff felt should be revised. He also
explained two alternatives for the con-
struction of Whispering Lane that the City
would have to decide upon. The first
alternative would have the developer con-
struct Whispering Lane this year. The
other alternative would require the devel-
oper to petition for the improvement of
Whispering Lane upon plat approval.
Commissioners Terrell and Stoffel expressed
the desire that Whispering Lane should go
all the way from 4th Street to Pleasant
Drive instead of just to the end of the
developer's plat. Commissioner Terrell
felt that a complete street should go in
this year. Commissioner Gergen expressed
concern that if the road was petitioned
for next year, there would be no guaran-
tee that the street would go in next year.
Moved by Commissioner Kramer, seconded by
Commissioner Groth to approve the prelim-
inary plat with the conditions recommended
by City staff in the April 21, 1978 memo
and that the developer petition for the
improvement of Whispering Lane for next
year's capital improvements program prior
to final plat approval and if the other
affected property owners do not petition
for the street, the City should initiate
the improvement for the entire length of
Whispering Lane. 5 ayes - Terrell and
Gergen naye
Mr. Bauer owns some property that is
zoned R-3 and surrounded by an R-1 zoning
district. Mr. Bauer would like to rezone
(to either R-1 or R-2) and plat one tier
of single family lots along 23rd Street.
The zoning officer incicated that before
taking any action on a rezoning petition
by Mr. Bauer, the Planning Commission
should see at least a general develop-
ment scheme for the remainder of the
Bauer property. Chairman Stoffel referred
the matter to the Kramer Committee to meet
with City staff and Mr. Bauer.

The zoning officer indicated that the staff
had not had time to review the site plan
and therefore recommended that no final
action be taken at this meeting. Mr. Ben
Sontag gave a presentation explaining the
nature of the proposed development and
site characteristics. Chairman Stoffel
referred the matter to the Murry Comm-
ittee to research the matter.
The zoning officer indicated some re-
visions that the staff felt should be
included in a final copy of the site plan.
He also suggested that the City should
require either a performance bond or a
letter from the developer stating that
all site improvements regarding land-
scaping would be completed as specified
in the site plan.
Commissioner Terrell gave the committee
report which stated that the committee
felt that the site plan was very well done,
and suggested that the City receive copies
of the agreements with Dennis Held regard-
ing the use of the private driveway. Comm-
issioner Terrell also felt that the fire
hydrant, as indicated on the site plan,
should definitely be included.
Moved by Commissioner Murry, seconded by
Commissioner Terrell to approve the site
plan with the conditions mentioned in the
staff memo, plus a letter from the devel-
oper stating that the improvements will
be completed as shown, and that the dev-
eloper provides the City with copies of
agreements with Dennis Held. 6 Ayes - Groth
and Gergen abstained.
The zoning officer indicated that the
Planning Commission had begun research
on various ordinance amendments and
informational items that had never been
completely carried out. He requested the
Planning Commission to contact him on re-
search they felt should continue.
Moved by Commissioner Kramer, seconded
by Commissioner Legler, to adjourn at
9:45 p.m.
