MONDAY, JUNE Z6, 1978
7:30 P.M.
The Planning Commission held an early meeting at 7:00 P.M. in the Council
Council Chambers to discuss ordinance amendmentS.
The meeting was called to order at 7:30 P.M' by Chairman Stoffel.
Members present: Commissioners Stoffel, Murphy, Groth, Kramer, Legler,
Liska, Terrell and Gergen
Members Absent: Commissioner Wendler
The Planner indicated that on page 3 of the Jm~e 1Zth,
1978 Planning Commission minutes, the motion
approving the site plan review of Gordy's Glass did
not include the approval of the variance for the
driveway entrance width, and should read "Moved
by Commissioner Gergen, seconded by Commissioner
Terrell to approve the site plan for the variance for the
maximum width of the driveway entrance, and subject to
the Staff recommendation with the exception of No. 4.

Moved by Commissioner Leger, seconded by Corrmaissioner
Murphy to approve the minutes of the June 1Zth, 1978
meeting as amended. 8 Ayes - 0 Nayes.
Chairman Stoffel opened the Public Hearing at 7:34
P.M. The Planner indicated that in the files were
the Notice of Public Hearing, Affidavit of Publication
and Certificate of Mailing, thus the Public Hearing was
properly called. Mr. Gerald Stevens, a resident in the
area of the proposed duplex presented the Planning
CorrnT~ission with a petition signed by a number of the
local neighbors stating their opposition to the proposed
duplex. Mr. Stevens went on to question the lot size,
building size, and parking requirements. He also asked
for an explanation of the process whereby a duplex would
be permitted in that location. The Planner indicated the
required and proposed lot size and parking requirements.
He also explained the special use permit procedure. Sharon
ffacobson stated that she felt that the duplex would create
increased traffic which would be dangerous for children in
the neighborhood. She also stated that the residents in the
neighborhood were opposed to any duplex, and that if
anything were to be built on the lot, it should be a single
family dwelling. David Langenfeld, the ~eveloper, indicated
that given the lot size, the size and design of the single family
dwelling that would have to be put on that lot to make the lot pay

would not fit into the design of homes in the area.
Mr. Stevens -indicated that he felt that the other
homes in the area are new enough to fit in to any
new single family home Mr. Langenfeld would build.
Mr. Stevens stated that he felt there were already too
many duplexes in the area.

Commissioner Gergen stated that he felt the Planning
Commission had received enough indication from the
neighborhood that they do not want a duplex. Commissioner
Groth suggested that the developer meet with the area
residents ~:o try to resolve their differences, and come
back to the Planning Cornrnission when those differences
were resolved. Chairman Stoffel closed the Public Hearing
at 8:53 P.M.
Commissioner Kramer gave the Committee'S report which
indicated they had not met with any of the residents in the area
but given the information they had received, had decided to
recommended approval of the special use permit. Commissioner
liramer stated that while he could not speak for the rest of the
Committee after hearing neighbors concerns, he was still in
favor of recommending approval.
Moved by Commissioner Groth, seconded by Commissioner
Gergen to have the developer meet with the neighbors to
resolve their differences, and whena majority of the people
signing the petition approved of the dup lex, that the developer
return to the Planning Commission. 4 Ayes - Murphy, Kramer
Leger and Terrell - Nay. Tied vote.
Discussions on the alternative continued. Commissioner Groth
suggested the developer research the possibilities of vacating
State Street to create two single family dwelling lots.
Moved by Commissioner Groth, seconded by Commi ssioner
Gergen to deny the special use permit application for a duplex
on'~the grounds that the increased traffic and increased density
would have a negative impact on nearby property owners as
indicated by the petitioners. 6 Ayes - Murphy and Kramer -Nay.
The Planner indicated that Mr. Feidt proposes to
conduct a part time band instrument repair business tnhi8
paren~ome at 808 Bailly Street. He indicated that the
driveway was available for off-street par king and that
according to the information provided by Mr. Feidt, it
did not appear that there would be a great deal of traffic
generated and that cars would be parked for a short
period of time. The amount of area proposed to be used
in the Ix) me occupation would amount to about 10% of the

total floor area of the home which is well under the

The Planner indicated that based on the information
provided, he recommended approval of the home
occupation permit as long as the business is confined
to repair and not sale of new instruments.
Moved by Commissioner Murphy, seconded by
Commissioner Legler to approve the home occupation
permit per the Staff recommendation. 8 Ayes - 0 Hayes.
The Planner indicated that since the last Planning
Commission meeting, the Staff had been in contact
with the Dakota County Plat Commission and the
Department of Natural Resources. He stated that the
comments from these agencies had a strong bearing
on this plat and that their comments were necessary
before the City could act on the preliminary plat. He
also indicated that the preliminary plat be revised to
indicate flood fringe, floodway boundaries, a more
detailed drainage plan that the Staff was recommending
be done by a registered engineer, road elevation
revisions, that dwelling unit elevations should be checked
for feasibility of connecting to sanitary sewer lines on
Co. Rd. ~47, finish dike and diversion channel elevation
from the Corps of Engineers project adjacent to the plat,
a more detailed site plan indicating building height and a
landscapw'~g~plan, that the Planning Cornnlission should
decide/to accept for private development open space, and
pedestrian ways as required by the Subdivision Ordinance
in blocks longer than 600 feet. He explained that the Fire
Marshal had indicated that with proper fire hydrant location,
the variance for the length of the cul-de-sac could be allowed.
However, as indicated to at least one Planning Commission
member, 'he Lwould prefer some sort of lateral connection to
the street. The Planner then recommended that based on the
need for comments from other affected agencieS, and the need
for additional information, that the Planning Commission continue
consideration on this preliminary plat until the next Planning
Commission meeting.

Commissioner Terrell gave the Committee report which stated
they had met with the Fire Dept. and that the Committee
recommended that a minimum 400' distance be required between
fire hydrants and that cross streets-be developed in the
preliminary plat instead of a variance for the length of the
cul-de-sac. Discussion continued on the appropriateness of
granting a variance for the length of the cul-de-sac.

Moved by Cornrnissioner Terrell, seconded by
Cornrnissioner Gergen to continue consideration on
the preliminary plat of Rivers Edge Addition as per
the Staff memo with the drainage plan to be done by
a registered engineer and for the developer to indicate
proposed private recreational space. 8 Ayes - 0 Nayes.
IVioved by Commissioner Terrell, seconded by
Commissioner Gergen to deny the request for a
variance for the length of the cul-de-sac because the
conditions do not show sufficient uniqueness or hardship
for granting a variance. 8 Ayes - 0 Nayes.
The Planner had indicated that Mr. Anderson had
contacted him with a question regarding the placement
of a sign advertising his business on his residential
yard. Upon being informed that the only signs allowed

be a sign for a home occupation or other permitted use
in the residential zoning district. Mr. Anderson was
thereby requesting a home occupation permit. Chairman
Stoffel referred the matter to the Wendler Cornnlittee.
As was reported in the early meeting, the Committee
will continue to research the ordinance requiring a
survey and the elderly housing parking requirements
proposed ordinance..
Commissioner Terrell gave the Committee report which
~contained a proposed~amendment to the Anti-
Li~ter Ordinance defining an "authorized
private receptacle" f6r planning Commission
action.
Moved by Commissioner Groth, seconded by
Commissioner Terrell to recommend the Council
amend Ordinance No. 14 - second series, Section
9.93~ Sub-section g per the amendment proposed by
the Terrell Committee. 8 Ayes - 0 Nayes.
Cornmis sione r Stoffel requested each Planning
Commission member to indicated their feelings
regarding the proposed Industrial Park at Prairie
Island. Generally, most of the Planning Commission
members felt that the industrial park would have a
beneficial impact on the economies of Hastings and
surrounding areas. FDwever, that development should
be planned in such a manner so as to be as compatible
as possible with the aesthetics and natural resources
of the area. Commissioner LegIer opposed the concept
as he felt it should remain as it is since the area has
many recreational and natural qualities.

Commissioner Groth gave a partial Committee report
which indicated that the Committee's initial feelings
were that the proposal · containing Whispering Lane
as presently dedicated should be preferre~h~ design
appeared to have better drainage capability and more
residential appeal with a cul-de-sac as opposed to a
through street.
