HomeMy WebLinkAbout07/24/78 MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, JULY 24, 1978 7:30 P.M. The meeting was called to order at 7:31 P.M. by Chairman Stoffel. Members Present: Commissioners Stoffel, Murphy, Groth, Kramer, Wendler, Legler, Liska, Terrell and Gergen Members Absent: None Moved by Commissioner Wendler, seconded by Commissioner Legler to approve the Minutes of the July 10th, 1978 meeting. 9 Ayes - 0 Hayes. APPROVAL OF MINUTES Chairman Stoffel opened the Public Hearing at 7:32 P.M. The City Planner indicated that on file was the Notice of Public Hearing, Affidavit of Publication and the Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner indicated that neither Dakota County or the Minnesota Dept. of Natural Resources had indicated any jurisdiction in the matter. After all people were affor4ed an opportunity to be heard, Chairman Stoffel closed the Public Hearing at 7:36 P.M. PUBLIC HEARING - SPECIAL USE PERMIT- GRAVEL PIT NCR TH OF OLD MUNICIPAL LAND- FILL & WEST OF CO. RD. # 91 - DONALD KLUENDER Moved by Commissioner Murphy, seconded by Commissioner Gergen to approve the special use permit for the gravel pit. 9 Ayes - 0 Hayes. Chairman Stoffel opened the Public Hearing at 7:38 P.M. The Planner indicated that on file was the Notice of Public Hearing, Affidavit of Publication and the Certificate of Mailing. Thus, the Public Hearing was properly called. Commissioner Wendler gave the Committee report which recommended approval of the special use permit. After all people were afforded an opportunity to be heard, Chairman Stoffel closed the Public Hearing at 7:43 P.M. PUBLIC HEARING - SPECIAL USE PERMIT- TWO-FAMILY DWELL- ING IN AN R-1 ZONING DISTRICT - 1361 BLUE- BERRY CT. - MR. & MRS. FAY CHAMBERLAIN Moved by Commissioner Wendler, seconded by Commissioner Kramer to approve the special use permit with a variance for the minimum lot size requirements conditioned upon an inspection by the Building Inspector. 8 Ayes - Gergen, Nay. Planning Commission Minutes -Z- July 24, 1978 (Continued) Chairman Stoffel opened the Public Hearing at 7:45 P.M. Because the individuals requesting the special use permit were not present, ChairmanStoffel continued the Public Hearing until later in the meeting. The Planner indicated that the developers had not submitted revised drawings of the preliminary plat, but that it would be appropriate to discuss the open space issue. Commissioner Terrell recommended that one or two parcels be set aside for private developed open space, not to exceed two parcels. Commissioner Terrell went on to state that this would pose a problem as far as who would be responsible for maintenance of this area. Commissioner Wendler asked for another explanation of the City Attorney's opinion on the private open space issue. The Planner explained that the City Attorney had indicated that the open space included in the individual four-plex lots could be considered the private developed open space as long as the open space amounted to 10% of the lot. A discussion occurred regarding how the open land on each lot would be split up amongst the four property owners. Mr. Tom Loucks of Loucks and Associates was present at the meeting and explained how this type of situation was handled in other communities, and discussed particular aspects of how this type of development could be handled. Moved by Commissioner Terrell that the private developed open space as required by the planned residential development unit requirements take the form of not more than two parcels to be owned by all the residents of the development. Motion died for lack of second. Moved by Commissioner Wendler, seconded by Commissioner Legler to table the preliminary plat until the next meeting for review of revised drawings, additional review of the open space issue, and that members of the Planning Commission meet with the developers to discuss some of the issues. 8 Ayes - Terrell abstained. PUBLIC HEARING - SPECIAL USE PERMIT- BUILDING EXPANSION - EAST OF VERM. ST. & WEST OF HWY 316 - WEBBER FORD PRELIMINARY PLAT- RIVERS EDGE ADDITION- STAR REALTY - SOUTH OF CO. RD. #47 & WEST OF THE VERM. RIVER Planning Commission Minutes (C0nti u dl -3- July 24, 1978 Chairman Stoffel re-opened the Public Hearing at 8:38 P.M. The Planner indicated that on file was the Notice of Public Hearing, Affidavit of Publication and the Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner indicated that he attended the Committee meeting and that the Committee had appeared to be in favor of this special use permit. He indicated that the Staff recommended ten foot parking stall setbacks and that the developer submit plans for the new blacktopped area with elevations showing proposed drainage. Commissioner Wendler asked about the recommendation regarding the setbacks. The Planner explained that a ten foot setback is required along right-of-ways, and that ten feet is required as a rear setback for parking stalls when the parking lot is adjacent to a residential zoning district and a five foot setback is required when the parking stalls are adjacent to other zoning districts. He indicated that the ten foot rear setback requirement was recommended due to the fact that the adjacent zoning district is agricultural and should be considered the same as residential for setback requirements. PUBLIC HEARING - SPECIAL USE PERMIT- BUILD~-NG EXPANSION- EAST OF VERM. ST. & WEST OF HWY 316 WEBBER FORD Moved by Commissioner Groth, seconded by Commissioner Murphy to approve the special use permit as per the Staff recommendation with a five foot setback on the south (rear) property line. 8 Ayes - Terrell, Nay. The Planner indicated that the Schumacher's are PRELIMINARY PLAT- proposing to plat six lots along 4th Street for dUplexes SCHUMACHER 1ST and reviewed the plat characteristics. The Schumacher's ADDITION - SOUTH SIDE indicated that the lots would be developed as four- OF WEST 4TH ST. BE- plexes. Commissioner Liska questioned the adequacy TWEEN WHISPERING LN. of the drainage plan. & THE GOV. CENTER Moved by Comt~aissioner Legler, seconded by Commissioner Wendler to schedule a Public Hearing for the August 14th, 1978 Planning Commission meeting. 9 Ayes - 0 Nayes. King's Cove proposes to construct an accessory maintenance and storage building at their location on Conley Lake. This location is in the floodway of Hastings floodplain and also within the Mississippi River Critical Areas. He explained that comments from the State regarding critical areas review will be a%railable to the City on or about August 9th, 1978. FLOODWAY SPECIAL USE PERMIT -ACCESSORY BUILDING - KING'S COVE Planning Commission 1VHnutes -4- Moved by Commissioner Groth, seconded by Commissioner Wendler to schedule a Public Hearing for the August 14th, 1978 Planning Commission meeting. Chairman Stoffel referred the matter to the Wendler Committee with Commissioners Kramer, Groth and Murphy included. The Jackson's propose to construct a chimney on the south side of their house which would be approximately five feet from their property line. Hastings zoning ordinance requires a seven foot setback. He indicated that the Jackson's had access to a su~r~e¥ corrLrnissioned by their neighbor which could be used'a reasonably accurate representation of the prot)erty lines. Moved by Commissioner Kramer, seconded by Commissioner Groth to approve the variance. 9 Ayes - 0 Nayes. Haven Homes proposes to construct a two-story 48 bed addition to their facility located directly north of the southwest ponding basin. The Planner indicated that this expansion required a new special use permit. Reverend Fair indicated to the Planning Commission that in 1965 or about that time, the property had been rezoned to C-1-Commercial. The Planner indicated that the Staff research had discovered that that property had been rezoned at that time, but had not been able to determine yet whether or not it had been rezoned in the process of the last Comprehensive Plan. The existing zoning map indicates the property to be zoned R-1. Moved by Commissioner Murphy, seconded by Commissioner Wendler to schedule a Public Hearing for a special use permit for the August 14, 1978 Planning Commission meeting under an R-1 zoning district until a clear determination on the zoning classification could be determined. 9 Ayes - 0 Nayes. Mr. Tom Loucks of Loucks and Assoc. was on hand to discuss the format of the Citizen's Survey Questionaire. Commissioner Kramer indicated that he would like to see an addition to the questionaire to add the category of commercial / industrial uses as one type of land use that questionaire recipients would indicate whether they would prefer to see increased or decreased in Hastings. Mr. Loucks went on to discuss the format for Citizen participation meetings to be held in mid-September. At this point it was proposed that meeting places be established in each of the four Council Wards, with July 24, 1978 King's Cove (Cont.) VARIANCE - SIDEYARD SETBACK FOR CHIMNEY 2008 PINE STREET - RAUL JACKSON SPECIAL USE PERMIT- BUILDING EXPANSION- NURSING HOME - HAVEN HOMES COMPREHENSIVE PLAN CITIZENS SURVEY REVIEW - LAND USE APPLICATION PROCE- DURES REVIEW - LOUCKS AND ASSOCIATES Planning Commission Minutes (Continue~) -5- affected Council members, Staff, the Chairman of the Planning Commission and the consultants present to discuss citizen's attitude regarding community development in Hastings. Mr. Loucks also explained a proposed review procedures manual that his firm had prepared at the Planner's request. Major revisions proposed by the consultants included provisions for the administrative official to set the Public Hearing dates, a proposal that public hearings be held on variance requests, that the Council have the final approval of Site plans, and that the Planning Commission Committee system for land use applications be eliminated. Some of the Planning Commission members felt that having the administrative official schedule the Public Hearingsp]aced too heavy a burden on the Staff person, or Planner, in dealing with applicants. Some members also felt that the Planning Commission Committee system was a viable system. The Planner indicated that Staff had not yet been able to prepareaformal recommendation to the Committee's proposals. Commissioner Liska left at 10:40 P./Vi. Commissioner Terrell anounced that he would be resigning effective August 22nd to attend graduate school.
