Members Present: Commissioners Stoffel, Murphy, Groth, Kramer, Wendter, Legler, Liska, Terrell, and Gergen Members Absent: None Moved by Commissioner Wendler, seconded by Commissioner Murphy to approve the Minutes of the Suly Z4, 1978 meeting. 9 Ayes - 0 Nayes. APPROVAL OF MINUTES Chairman Stoffel opened the Public Hearing at 7:33 P.M. The Planner indicated that on file was the Notice of Public Hearing, Affidavit of Publication, and the Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner indicated that since the last Planning Cornnlission, the Staff had received a site plan for the four-plexes that the Schumacher's propose to construct on the lots in the subdivision. He Went on to explain that the type of structures proposed on the site plan were not the same as the buildings indicated on the preliminary plat,and therefore the drainage would not be the same, that there Were a number of conditions in the site plan that do not meet Hastings zoning ordinance requirements, and therefore the Staff felt that the Public Hearing should be continued for the receipt of a revised preliminary plat and site plan. LEO & CLARA SCHUIk4A- CHER- SCHUMACHER 1ST ADDITION Members of the Planning Commission questioned various points of the Staff comments. Conlrnissioner Wendler gave a Committee report which expressed concerns about the drainage situation of the plat and its effect on surrounding property. Mr. Bailey Seida, a representative for the Schumacher's, responded to the items indicated in the Staff report. Mr. Seida requested the Planning Commission to review the preliminary plat as per the subdivision ordinance only, discussed the drainage situation of the plat and gave an explanation regarding the history of park dedication for the property. The Planner explained that the planned residential development requirements, which are required for multiple-family development other than duplexes in an R-3 zone are applicable in subdivision review as are other zoning requirements, such as loc size. After all people present were given an opportunity on the matter, Chairman Stoffel closed the Public Hearing at 8:24 P.M. Planning Commission Minutes -Z- August 14, 1978 · (Contimed) Moved by Commissioner Groth, seconded by Commissioner Murphy to continue the Public Hearing to the August 28, 1978 Planning Commission meeting for a revised preliminary plat and to a site plan showing revised drainage and including the comments indicated in the August I1, 1978 Staff memo. 9 Ayes - 0 Naye s. Chairman Stoffel opened the Public Hearing at 8:25 P.M. The Planner indicated that on file was the Notice of Public Hearing, the Affidavit of Publication, and the Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner indicated that the proposal met applicable zoning requirements. He went on to explain that the Staff f~lt a condition of approval should be that the existing building be sprinkled for fire protection, that proposed contours around the new building should be reviewed by the Staff, and suggested that if the Planning Commission felt a limit for future development of this property was appropriate, it could be a condition of approval. He then stated that it had been determined that the property was zoned R-1 and could be considered as a special use permit as opposed to the C-1 zoning classification which had been questioned. Commissioner Groth stated that he felt that it would not be necessary to place a limit on future expansion at this time. Chairman Stoffel closed the Public Hearing at 8:32 P.M. Moved by Commissioner Kramer, seconded by Commissioner Groth to approve the special use per,nit conditioned upon the sprinkling of the existing facility for fire protection, and the review of proposed contours prior to Council approval. 9 Ayes - 0 Nayes. Chairman Stoffel opened the Public Hearing at 8:33 P.M. The Planner indicated that on file was the Notice of Public Hearing, the Affidavit of Publication, and the Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner indicated ti:at the critical areas recommendation suggested that the City of Hastings and Denmark Tox~rnship require King's Cove to prepare a master plan for future marina development. He went on to indicate that the Staff felt a structural engineer should review and comment on the type of foundation system proposed, that the proposed on site sewage system did not appear to meet City orState standards and would have to be revised to meet those standards, and that the removal and evacuation plan proposed to meet flood-proofing classifications be formally drafted and filed with the City and include Schumacher 1st Addn. PUBLIC HEARING - HAVEN HOMES -930 WEST 16TH STREET-SPECIAL USE PERMIT -BI/LDING ADDITION PUBLIC HEARING- KING'S COVE-FLOODWAY SPECIAL USE PERMIT- ACCESSORY BUILDING Planning Commission Minutes -3- August 14, 1978 (Continued) a statement that in times of flooding, the openings for the Hwy 61 railroad shall be sandbagged to protect the site against flood water current movements. King"s Cove (Cont.) Several Planning Commission members indicated that they did not feel that it would be necessary to require the formulation of a n~ster plan for the entire marina. After all people present were afforded an opportunity to be heard on the matter, C~.airman Stoffel closed the Public Hearing at 8:41 P.M. Moved by Commissioner Wendler, seconded by Commissioner Kramer t o approve the floodway special use permit subject to Staff comments (Augts t 11, 1978 Staff report) and not require a master plan for future development. 9 Ayes - 0 Nayes. Mr. Olson proposes to remove a portion of his ex[sting greenhouse and replace it with a new structure. According to the zoning ordinance, the new structure would involve a required setback of 15 feet from the property line. The variance request is for a 0 setback. Planner indicated that the construction of the new structure would also mean that the required number of off-street parking stalls would also be necessary. VARIANCE - SIDE YARD SETBACK - OLSON'S GREENHOUSE - 809 W. llTH ST. The The Planning Commission discussed whether or not the variance would be appropriate, whether some setback distance from the property lines should be required, adding some type of screening or buffering, and the existing parking situation. Moved by Commissioner Terrell, seconded by Commissioner Gergen to deny the variance as the request did not meet the burden of proof required by Section 10.02, Subdivision 25 of the zoning ordinance. 4 Ayes - Murphy, Stoffel, Wendler, Legler & Liska - Nay. Motion failed. The Cornrrissbners then d~ scus sed whetl~er or not the failure of a motion to deny constituted approval, or if the Plannlng Commission could pass a subsequent motion approving a variance with certain conditions. Chairman Stoffel ruled that the failure of the motion to deny constituted approval and the matter was closed. Planning Commission Minutes -4- August 14, 1978 (Continued) The street vacation request was to vacate the traveled roadway of 4th St. between Locust and Lake Streets and not the platted right-of-way. ChairmanStoffel referred the matter to a cornrnittee consisting of Commissioners Wendler, L egler, Groth and Liska. This alley vacation involves a purchase agreement, an access easement, the cost of relocating utility lines, removal of an existing loading dock, and the capping of an existing well. Chairman Stoffel referred the matter to the Wendler Committee. An example of the proposed exterior building materials for the racquetball court was presented. Moved by Commissioner Kramer, seconded by Commissioner Terrell to approve the exterior building materials for the Villa Dev. racquetball court. 9 Ayes - 0 Nayes.
