HASTINGS PLANNING COMMISSION MEETING
MONDAY, AUGUST 28, 1978
7:30 P.M.
The meeting was called to order at 7:31 P.M. by Chairman Stoffel.
Members Present: Commissioners Stoffel, Murphy, Groth, Kramer, Wendler,
Legler, Liska and Gergen
Members Absent: None
Moved by Commissioner Groth, seconded by
Commissioner Wendler to approve the Minutes of
the August 14, 1978 Planning Commission meeting.
8 Ayes - 0 Nayes.
APPROVAL OF MINUTES
Chairman Stoffel opened the Public Hearing at 7:34 P.M.
The Planner indicated,that while not required, a Notice
of Public Hearing had been published, in the newspaper.
The Planner indicated that revised drawings had been
received since the last Planning Commission meeting,
but that the Staff had not had time to make a complete
review. Commissioner Wendler gave the Committee
report which expressed concern about the area wide
drainage, but indicated that in the Commissioner's
point of view, the proposal and construction of 4th
Street might even improve the drainage situation.
At this point, a resident presented the Planning Commission
~vith a petition signed by a number of home owners in the
Whispering Oaks townhouse area that requested that no
building be allowed at the proposed site, and that a building
moritorium be placed~upon the area west of the Whispering
Oaks townhouse area until more drainage control measures
are constructed for the area. Mr. D. Sartman of 1347 W.
4th Street told the Commission that he did not agree with
the petition and felt that the burden should not be placed
on one land owner. He felt that the City and the County were
at fault for flooding in the area. The Planner indicated that
a moritorium should be only considered when there is
substantial evidence of an impending danger from any given
situation. There was considerable disoussion about drainage
from the existing County Government Center and the proposed
new construction at the County site, need for a more detailed
comprehensive land use plan for the area, the northwest storm
Sewer report, the enforcement of agreements and compliance to
approved grading plans, and proposed utilities for the area.

After all people present were affor deal an opportunity to
be heard on the matter, Chairman Stoffel closed the
Public Hearing at 8:18 P.M.
Moved by Commissioner Wendler, seconded by Commisskoner
Murphy to approve the preliminary plat conditioned upon the
following:
The preliminary plat be reviewed by the City
Engineer prior to Council approval.
A variance frorrSection 10.07, Subdivision 6 of
the City code which requires that the tract of land
for planned unit development contain not less than
5 acres of land. The justification being that the
section has not received equal enforcement in the
past, and that in this case it would be appropriate to
not require the 5 acre minimum. The remainder
of Outlot A should be developed in a comprehensive
and coordinated manner.
A variance from Section 10.07, Subdivision 61'4
which requires apartment garage doors shall not
face the street. The justification being that the
design of the proposed four-plexes appear to be
closer to single family or townhouse development
than apartments.
A variance from the required 30 foot front setback
on Lots 1 and 2 to allow a 25 foot setback.
The developer should submit a letter indicating
the minimum landscaping to be provided.
Six Ayes, Liska, Nay, Stoffel abstained.
The developers propes e to remove an existing auto
parts and auto repair building and construct a Hardee's
restaurant with drive-by window. The Planner indicated
items in need of revision on the site plan. One of
the Staff's concerns being that the driveways on Sibley
St. enter into a residential area. The developers presented
some revised drawings which included attention to some
of the Staff comments. Chairman Stoffel referred the
matter to the Wendler Committee and scheduled a
Public Hearing for the September 11, 1978 Planning
Commission meeting it was felt that due to the potential
impact on the adjacent residential neighborhood, it would
be appropriate to hold a Public Hearing to hear any neighborhood
concerns.

Mr. Birkholtz proposes to maintain an office for
keeping records and storing products. He has
indicated very few cars would be parked at his home
in conjunction with his proposed business and the
area to be used would be well within the maximum
allowed by the ordinance.
Chairman Stoffel referred the matter to a Committee
consisting of Commissioners Gergen and Legler.

Commissioner Wendler gave the Committee report
indicating that the Committee felt the Breyer's should
have the use of their property since they were paying
taxes and assessments. However, the Committee
was also concerned about the access for adjacent
re side nts.

Moved b~ Commissioner Wendler, seconded by
Commissioner Murphy that the City consider the purchase
and development of the roadway to include it in the 4th
Street right-of-way. If that is not feasible, then
the recommendation is to vacate the roadway.
7 Ayes - Legler, Nay.
The Planner indicated that no additional information
or progress regarding the issues involved in the
vacation had been received. Commissioner Wendler
gave the Committee report which indicated that the
Committee felt that the alley as existing is an eye
sore and a mess, that if Master could construct an
attractive building, it could he lp eliminate the existing
condition, but reserved any recommendation until the
Planning Commission heard from the downtown businessmen
and Master, Inc.

Mr. Murray Laub of Master, Inc. explained that his
company had not eXperienced water problems until the
construction of the parking lot. He stated that he felt
the parking lot caused water to run off into Masters
building. He also indicated that with the construction
of the parking lot, Local Oil did not need the alley for
access. In regards to the building expansion, Mr. Laub
indicated that plans had been presented to the HRA and that
no zoning requirements had been ment~-oned at that time.

Mr. Gayle Erickson from the Downtown Businessmen
Assoc. indmated that his association was oppos ed to the
alley vacation and that the building addition would increase
the number of employees and worsen an existing parking
problem in the downtown area. He also stated that there
had been water problems at that site prior to the construction
of the parking lot. M r. Laub responded that if additional
parking would be required, he would make an attempt
at locating some parking stalls.
Moved by Commissioner Wendler, seconded by
Commissioner Murphy to approve the alley vacation
up to the east end of the existing Master, Inc. building
and subject to the approval of Hastings HRA. The
Planning Cornrnission members wanted to assure that
the intent of the motion was not in any way to grant prior
approval to variances from the zoning ordinance, as the
Planning Commission had not reviewed a site plan.

An architect representing Dakota County gave a
presentation explaining the proposed County Human
Services building. Members of the Planning Commission
expressed concern of the amount of storm water run-
off of this development would create. Chairman

Stoffel referred the matter to the Kramer Committee and asked the
Planner to meet with representatives from the County
regarding the total drainage situation of the County
property, and to schedule a Public Hearing for citizen
input on the site plan for the September Z5th Planning
Commission meeting.
Due to the late time, the ordinances and land use
applications procedures review was tabled until the
next meeting.
