HomeMy WebLinkAbout11/27/78MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, NOVEMBER 27, 1978 7:30 P. M. The meeting was called order at 7:30 P.M. by Chairman Stoffel. Members Present: Commissioners Stoffel, Murphy, Kramer, Wendler, Legler and Liska Members Absent Commissioners Groth, Latch, and Gergen Moved by Commissioner Kramer, seconded by Commissioner Wendler to approve the Minutes of the November 13, 1978 Planning Commission meeting. 6 Ayes - 0 Nayes. APPROVAL OF MINUTES As the petitioner was not present, Chairman Stoffel continued the Public Hearing until later in the meeting. PUBLIC HEARING- SPECIAL USE PERMIT- DUPLEX IN AN R-2 ZONING DISTRICT- 421 WEST 3RD ST. - AL SIEBEN Chairman Stoffel opened the Public Hearing at 7:33 P.M. The Planner reported that due to the lack of an accurate legal description, the Public Hearing notice for the rezoning request had not been published. However, the Notice of Public Hearing, the Affidavit of Publication, and the Certificate of Mailing for the preliminary plat were on file. Thus, the Public Hearing was properly called for the preliminary plat. The Planner went on to explain that at a Committee meeting prior to the Planning CornmLssslon meeting, the developers had indicated that they would be withdrawing the request for rezoning at this time. The developers affirmed that statement. The Planner then went on to explain that an engineering review had revealed that the developers had at least generally complied with past Staff corrnrnents, that the developers had provided additional information regarding zoning questions, and explained some remaining concerns as outlined in the November Z4, 1978 Staff report. PUBLIC HEARING - PREM. PLAT/PLANNED RESIDEN- TIAL UNIT - RIVERS EDGE ADDITION-SOUTH SIDE OF CO. RD. #47 & WEST OF THE VERM. RIVER-STAR REALTY Mr. A1 Sieben suggested that thought should be given about how to direct traffic for the future ex tensions of the roadways indicated on this preliminary plat. After all people present had an opportunity to be heaad on the matter, the Public Hearing was closed at 7:47 P.M. by Chariman Stoffel. Moved by Commissioner Wendler, seconded by Commissioner Kramer to approve the preliminary plat and planned residential development permit and g ranting a variance from Section 10.0Z, Subdivision 13 of the City Code which requires all lots to have frontage on a public street conditioned upon submission of items noted in the November 24 Staff report and the approval of a development contract and development assurances by the Planning Commission and City Council. 6 Ayes - 0 Nayes. Chairman Stoffel re-opened the Public Hearing at 7:50 P.M. The Planner reported that on file were the Notice of Public Hearing, the Affidavit of Publication, and the Certificate of Mailing. Thus, the Public Hearing was properly called. CONTINUATION OF PUBLIC HEARING - SPECIAL USE PERMIT-DUPLEX IN AN R-Z ZONING DISTRICT No comments were heard. After all people present had an opportunity to be heard onfhe matter, Chairman Stoffel closed the Public Hearing at 7:55 P.M. Moved by Commissioner Wendler, seconded by Commissioner Legler to approve the special use permit for a two family dwelling at 421 West 3rd Street. 6 Ayes - 0 Nayes. The Planner reported that revised drawings had elevated the building one foot. He went on to explain that other points indicated in the last Staff report had not been addressed, and that a park dedication would be required. Mr. Dick Fuchs, the architect, indicated that the developers would be requesting the dedication of the former 5th Street right-of-way at the next Council meeting. SPECIAL USE PERMIT- TOWNHOUSES IN AN R-Z ZONING DISTRICT - N. OF THE N.W. PONDING BASIN BETWEEN ASH AND FARM STREETS - AL SIEBEN Moved by Commissioner Wendler, seconded by Commissioner Murphy to schedule a Public Hearing for the December 11, 1978 Planning Commission meeting subject to revised drawings indicating those items mentioned in the Staff report with an improved Planning Commis sYon IViinute s (Continued) -3- November 27, 1978 (suggested was a gravel base covered with a layer of sod). 6 Ayes - 0 Nayes. A1 Sieben Townhouses Continue d) The Planner outlined discussions the Committee had gone over at the last Committee meeting. He added that he was in the process of constructing a questionaire to be sent to a random sampling of residents and that he would also be attempting to STATUS REPORT - COMMITTEE WORK ON TWO- FAMILY DWELLING - ORDINANCE REVIEW establish a volunteer work group consisting of representatives from persons affected by a two-family dwelling. Mr. Dennis O'Melia, a NRRC member, was on hand to give a presentation explaining a trails-proposal the NRRC was considering. Mr. O'Melia explained that the NRRC was mainly concerned at this time with obtaining input from the Planning Commission and that near future plans called for only designation of the trail route. NRRC TRAILS PLAN PRESENTATION After some discussion, no action was taken. The Planner explained that the planning consultant and Staff were working towards preparing a critical areas ordinance that would also encompass the flood plain ordinance. He explained that this effort was an attempt to see if the ordinances could be combined in order to have one overlay ordinance instead of three separate ordinances for one parcel of property adjacent to the Mississippi River. He also suggested that since the deadline was approaching for submission of the critical areas plan, the draft should be finalized. REVIEW OF THE PRELIMI- NARY DRAFT OF THE MISS. RIVER CORRIDOR CRITICAL AREAS PLAN Moved by Commissioner Kramer, seconded by Commissioner Murphy to set a Public Hearing for the December 11, 1978 Planning Commission meeting to receive public input on the critical areas plan. 6 Ayes- 0 Naye s. The Planner presented recommendations that had been prepared by the firm of Loucks and Assoc. for impound lots standards. Commissioner Wendler found many items that he did not agree with. REVIEW OF STANDARDS FOR AUTOMOBILE IMPOUND LOTS Chairman Stoffel referred the matter to the Kramer Committee. Moved by Commissioner Wendler, seconded by Commissioner Kramer to adjourn at 9:41 P.M. 6 Ayes - 0 Nayes. ADJOURNMENT
