HASTINGS PLANNING COMMISSION MEETING

The meeting was called to order at 7:32 P.H. by Chairman Stoffel.
Members present: Commissioners Murphy, Kramer, Stoffel,Wendler,
Liska and Gergen.
Members absent: Commissioners Groth, Legler, and Latch.
Moved by Omrmissioner ,~u~shy, seconded by Cc~,~nissioner Wendler
to approve the minutes of the Novenber 27, 1978 Planning Comm-
ission meeting. Ayes, 6; Nayes, none.
APPROVAL OF MINU~ffES
Chainnan Stoffel opened the Public Hearing at 7:33 P.H. The PUBLIC ItE/LRINC~-SPECIAL
Planner reported that on file were the notices of l~ablic Hearing~USE PEt{~iIT-TOW~HOUSES IN
Affidavit of Pablication and Certificate of }~ailing, thus the
Public Hearing was properly called.
(~e neighbor asked if the tennis court would be ava~ lab!e for
t~se by people in the neighborhood. It was explained thai the
tennis court would only serve those residents of the towrfl~ouse
~evelo~nent. ~lr. Milo Simacek expressed concern that ~anoff
from the devel~oI~mnt would ~o into Lion's Park. The architect
explained that ran-off from the north would be directed to a
drainage swale on the north property line and then to the
western end of the development on into the Northwest Pending
Basin. ~mother area resident asked for an estLmate of how
mucU the assessments would be for the in~0rovenmnt of ,~h St.
The Planner explained that he did not have an estimate available.
?h~. Sieben indicated that the Ash Street improvements would be
s~mthing that should be considered and also the possibility of
i?.r~rovements on 5th Street from the intersection of Ash East
should be considered ss property owners and the City would have
to pay for those improvements.

After all people present had an opportunity to be heard on the
~atter, Onainnan Stoffel closed the Public Hearing at 8:0] P.M.
Chairman Stoffel continued the Public itearing until tbe next
Planning C~ssion meeting and scheduled an additional ~2blic
Hearing for the Prelih~naa%~ Plat for the next Plann~ ng Camaission
n~eting.

Chairman Stoffel opened the Public Hearing at 8:08 P.M
The Planner indicated that on file were the notice of Public
Hearing~and the Affidavit of Publication, the Public gearing
was properly called.
Since there were a number of other Land Use applications for
consideration, Chairman Stoffel continued the Public Hearing
until later in the meeting.
The American Legion buildi~ addition proposal would involve
a 16 foot addition to the north side o£ the existing building
and a 9 foot addition to the northeast section of the
existing building. Variances for the rear-yard setback,
number of required parking stalls, and a variance from the
required 40 foot set-back from a bluff line were requested.
Also requested was an 8 foot street vacation for the First
Street right-of-way adjacent to the north property line.
Mr. Brian Cluts, the architect, explained the development
proposal and indicated the justification for the variances and
street vacation request. The Planner reviewed these requests,
ccmmented on each request, and explained that an existing
watermain running through the site should be indicated on the
site plan.
Some Planning Ccr~nission members expressed concern about grant-
ing the variance for the required number of off-street parking
stalls. The architect explained that no space was available
for adding off-street parking stalls, and stated that being
that the nature of the business involved the highest vol~ne
during eveai~ hours and weekends, they felt that the variance
was justified.
Moved by C~r~issioner Wendler, seconded by Conrnissioner Murphy
to approve the site plan, variances, and street vacation
requests conditioned upon receipt of a revised site plan showing
the location of the watermain. Ayes, 6; Nayes, none.
~. J~n O'Connor was present to inform the Planning Ccxap~
ission that he hoped to develop an 8 Unit apartment building
directly north of three apartment buildings on the north side
of County Road #47 and west of Eddy Street. He showed the
Planning Ccranission sketches of the site and proposed
building and explained that he was seeking the Planning
Ccxnnission's initial reaction to the need for a density variance
and a private access throu~a an easement on adjacent property
from Eddy Street. The Planner indicated that Staff would be
very concerned about the private access on land not owned by the
developer and that the easement was only 12 feet wide and well
below the necessary width. Chairman Stoffel referred the matter
to the Wendler Cc~rnittee.

F~r. Ed Elliott, £rcmLoucks and Associates, was at the CONTINUATION OFPUBLIC
meeting and presented a slide show which explained the HEARING FOR THE MISSISS-
critical areas act. After the slide presentation, Mr. Elliott IPPI RIVER CORRIDOR
and the Planner explained the various aspects of Hastings CRITICAL AREAS DRAFT
Draft Critical Areas Plan and explained that due to scme
necessary refinements o£ the plan and accompanying ordinances,
it would be appropriate to ask for an extension fr~n the
required submission date of January 1st.
One member o£ the audience asked if restrictions on develop-
ment on slopes greater than l~would be placed on land not
within the river corridor. The Planner explained that at
present those restrictions would apply only to the river
corridor. However, in the development of the Comprehensive
Plan and Zoning Ordinance ~nendments, it was anticipated that
restrictions on developi~ent on slopes greater than 12%would
be included for the entire c~rmunity. Another member of the
audience asked if the critical area regulations would be under
the City's jurisdiction or under a State or Regional Agency.
The Planner responded that the jurisdiction would be pr~narily
up to the City of Hastings, with the exception of development
that would be of greater than local significance, or that would
require State or Federal Agency peri, its. After all people present
had an opportunity to be heard on the matter, Chairman Stoffel
closed the Public Hearing at 9:38 P.M.~ The matter will be placed
on the next Planning Oa~nission AgendaI°r the final draft plan.

Moved by Co~missioner Kramer, seconded by Commissioner Wendler to
schedule the first Planning Comnission meeting in January for
January 9, 1978. Ayes, 6; Nayes, none.
As no new information was available,the issue was tabled
until the next n~eting.
CONTINUATION OF DISCUSSION
ON TWO FAMILY STANDARDS
C~missioner Wendler presented a Con~nittee report on standards IMPOUND LOTS IN INDUSTRIAL
for Ir~pound Lots. Coamissioner Wendler also expressed concern PARK-ORDINANCE STANDARD~
over the effect these standards might have on existing service
stations and and auto repair shops which from time to time store
autos. Chairman Stoffel referred the matter back to the Cnn-
mittee for additional review. Planner to investigate concerns
expressed by Ccam~issioner Wendler.

The Planner presented review comments ~nade by Louck s and
Associates on Nininger's propoSed amendments to the Township
Development Guide Plan as they relate to Hastings' Compre-
hensive Plan.
