City Council Workshop
August 15, 2022
The City Council of the City of Hastings, Minnesota met in a workshop on Monday, August
15, 2022 at 5:30 p.m. in the Community Room at the Hastings City Hall, 101 East 4th Street,
Hastings, Minnesota.
Members Present: Mayor Fasbender, Councilmembers Braucks, Folch, Fox, Leifeld
Members Absent: Councilmembers Lund, Vaughan
Staff Present: City Administrator Dan Wietecha
Assistant City Administrator Kelly Murtaugh
Mayor Fasbender called the workshop to order at 5:39 pm. Wietecha summarized the discussion
over the two meetings of the Administration Committee. Because the conversation was so
complex, the key recommendation was to take the information to the full Council to better
prepare for any conversation when the formal proposal goes to Council. If this is the right
direction, then it can go to Council on September 6.
Wietecha provided a review of the memo that was presented to Council. Council discussed the
COLA and its impact on the new wage scale. Council discussed the option for merit or incentive
options to promote high-performance.
Council discussion about those at the top of scale and COLA. Will keep the commitment to offer
COLA for 2023 and will review going forward.
Council discussion on budget impact, especially if the year is more difficult financially.
Consideration may need to be made for challenging financial situations and the options that may
exist to slow or reverse implementation. Emergency operations discussions may be a resource to
contribute to planning for challenging financial situations.
Discussion on merit options/bonus/incentives as other cities may give additional vacation days or
cash out some vacation annually. Council discussion about step movement based on performance
and how that might work in this environment.
Highly competitive positions are those where the availability of qualified employees is low and
every City needs the position. It is recommended that certain non-represented positions are
placed at step 6 to improve competitiveness of those positions in retention. Represented positions
have a different scale and move through the scale differently.
Council was generally supportive of the presented material.
Compensation for Council was the other topic discussed. Council discussion on the technology
stipend vs city-issued device—stipend allows councilmembers to opt for device of their choosing
and not have an extra device while a city-issued device can be maintained by City staff and give
consistency to constituent communication.

City Council Meeting Minutes
August 15, 2022
The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, August 15,
2022 at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota.
Members Present: Mayor Fasbender, Councilmembers Braucks, Folch, Fox, Leifeld, and Lund.
Members Absent: Councilmember Vaughan

Approval of Minutes
Mayor Fasbender asked if there were any additions or corrections to the minutes of the regular City
Council meeting on August 1, 2022.
Minutes were approved as presented.
Comments from the Audience
Lester Helten, 802 Old Mill Court, sent emails regarding the increased train traffic from one time per
day to many times per day/evening. Mr. Helten’s primary concern is the extensive use of the horn at all times
of the day and for sustained periods of time waking residents. Mr. Helten shared that some towns have quiet
areas for train horns and this also can apply to trucks using jake breaks. Mr. Helton contacted Canadian
Pacific with no action being taken. Mr. Helten asked if the City can do something about this issue as he has
been told the horn is to be blown at intersections but he indicated that engineers lay on the horn from 18th
Street to the Depot.
Karen Erlandsen, 814 Old Mill Court, spoke to Council about the increased train traffic over the
years. Ms. Erlandsen shared that the evening trains wakes up residents and does not understand why the horn
needs to be blown for as long as it is.
Phil Erlandsen, 814 Old Mill Court, spoke to Council about his concern over the frequency and length
of the horns being blown through the intersections. Mr. Erlandsen has observed rail cameras across the
country and did not see horn blasts for this long unless the train is travelling at a high rate of speed. Mr.
Erlandsen indicated the horn is over 108 decibels. Mr. Erlandsen acknowledges that railroad crossings are
dangerous places and that the horn needs to be blown and asked if there could be some observation to
determine how long a horn should be blown in the City.
Jim Lewanski, 1575 King Midas Lane, noted the increased train traffic and that the horns are blown
day and night. Mr. Lewanski asked if there may be alternatives to the horns at intersections. Mr. Lewanski
expressed his concern on the excessive horn usage impacting their ability to sell their homes in the future.
Council discussion about experience with the train horns and residents reporting that horns are blown
even while moving cars around on Ardent Mills property. Councilmember Folch spoke about their increased

capacity at the mill which could likely by the reason for increased train traffic. Folch asked what the City can
do with Canadian Pacific and Ardent Mills. Attorney Land reported that train traffic is heavily regulated by
the federal government with little wiggle room. The recommended first course of business might be to have a
common-sense discussion with the railroad and mill.
Consent Agenda
Mayor Fasbender requested to add the approval of the Advertisement for Bids for the City Hall
Rehabilitation Project.
Mayor Fasbender motioned to approve the addition, seconded by Councilmember Leifeld.

Councilmember Folch requested Consent Agenda item number 12 be pulled from the Consent
Agenda and moved to Parks and Recreation Reports from City Staff.
Mayor Fasbender motioned to approve the Consent Agenda with the addition of item number 14, and
the removal of number 12, seconded by Councilmember Leifeld.

Levee Park Space for Permanent Art Display
Jenkins introduced the request for a permanent art display in the designated space at Levee Park. As a
part of the 2022 Budget, City Council initiated the Community Investment Fund and allocated $100,000.00 in
funding for 2022. One of the CIF projects is to fund a charette process as proposed by Building Remembrance
for Reconciliation (BR4R) to ultimately develop an art piece to be permanently displayed on City property.
Jenkins outlined the area for the permanent art display space.
Council discussion on appreciation for carrying this project forward. Councilmember Folch asked for

proposed display area and its care and upkeep. Councilmember Leifeld clarified that the display will be
permanent. Councilmember Leifeld asked for clarification on the detail of the charette process will determine
the foundation needs for the display. Councilmember Fox expressed their excitement for this project.
Councilmember Fox asked that they work closely with the Arts Task Force as the work comes out of the
charette process.
Councilmember Braucks motioned to approve as presented, seconded by Councilmember Leifeld.

CP Adams Park
Item moved from Consent Agenda by Councilmember Folch. Councilmember Folch observed the
disc golf course and indicated that the course may need improved signage based on observation and
interaction with disc golfers. Director Jenkins shared a map on the City website and the Disc Golf
Association, but there is not good signage. Jenkins shared there will be tee pads and baskets that will have
hole numbers as well as proposing an updated kiosk map along with other proposed updates. Councilmember
Folch recommended that there be a QR code at each hole or other technology-driven manner to access the
map.
Councilmember Folch motioned to approve as presented, seconded by Councilmember Fox.

Resolution No. 08-11-22: Interim Use Permit – United Heroes League (15211 Ravenna Trail)
Hinzman introduced the Interim Use Permit requested by the United Heroes League. Council is
requested to review the proposed Interim Use Permit and act on a resolution to allow temporary
improvements for up to 18 months. The Planning Commission recommended approval of the request and
briefly discussed the future phases and site plan reviews.
Council discussion on conditions that were not met in 2020 as well as the 2022 conditions. Hinzman
indicated that all conditions were combined and must be met in the 18-month timeline. If conditions of permit
are not met, all sit uses would not be valid. Braucks asked if there would be a penalty if all of the conditions
in the permit were not met. Hinzman indicated that City Council would be able to revoke the permit.

Heritage Ridge 4th Addition – Resolution No. 08-12-22 Final Plat and Authorize Signature: Grading
Assessment
Hinzman introduced the Heritage Ridge 4th Addition, TC Land LLC – General Sieben and Northridge
Drives. This final addition includes 36 lots located West of General Sieben Drive and Northridge Drive as
proposed by TC Land LLC. The final plat approve is to subdivide property into 36 lots and outlot consistent
with the previous Preliminary Plat approval. The Site Grading Agreement authorizes the beginning of limited
grading activities. Planning Commission approved earlier this year.
Council discussion on resuming blasting and jackhammering. Councilmember Braucks raised concern
regarding blasting and drilling. Hinzman indicated that blasting is prohibited within the development but there
may be jackhammering.

Amendments to 2022 Budget
Wietecha expressed appreciation to the Facility Manager for providing a different perspective on
facility needs. Wietecha presented proposed amendments to the 2022 Budget totaling $91,451. The
amendments include preventative and deferred maintenance work, furnishings and fixtures, and other
equipment.
Council discussion on expense offsets by minimal donations. Councilmember Braucks asked where
the remaining funds would come from. Wietecha clarified where the funds come from and what the donations
will be used for.
Councilmember Folch motioned to approve as presented, seconded by Councilmember Fox.

The Hastings Police Department recertifies every year in BLS Training, which is Basic Life Support.
This includes bleeding control, CPR, bandaging, and patient assessment. This training requires
equipment that is borrowed from other jurisdictions to simulate real life scenarios. Officer Nick Cross,
the HPD First Aid Training Instructor, requested funding from the Prairie Island Tribal Council to
purchase the necessary training supplies and to purchase the correct first aid equipment for the Hastings
Police Department. This equipment will ensure the Hasting Police Officers have the necessary tools to
respond and treat each other and the citizens of Hastings in the event or a critical incident.

Background Information:
The Hastings Lyle Russell VFW Post 1210 contacted the Hastings Police Department to donate towards
officer gear or equipment. The VFW was made aware of ongoing training at the police department
regarding first aid and the expense associated with first aid equipment. Some of the new specialized
equipment that is needed is first aid equipment for every officer. This equipment is called an IFAK or
Individual First Aid Kit. These are trauma kit’s that can be carried by every officer and it attaches to their
existing gear. This training and equipment would allow every officer to quickly address and treat injuries
to either themselves or members of the public. The $1,500 received by this donation would provide every
officer with a new IFAK.

Council Action Requested: Authorize Signature of the attached 2nd Amendment to the Development Agreement for Villas at Pleasant, a 32 lot villa home subdivision developed by Simek Property Group
northeast of Northridge and Pleasant Drives.
The amendment modifies the date for completion of wear course bituminous paving from October 15, 2022 to September 15, 2023. No other significant changes are included in the amendment. Action requires a simple majority of City Council.
Background Information: The City Council granted Final Plat and Development Agreement approval on April 5, 2021. The agreement established a June 30, 2022 deadline for installation of pavement wear course and completion of public and private improvements. The 1st Amendment
extended the deadline of wear course paving October 15, 2022.
Wear course paving is recommended when the majority of homes in a development have been completed. Since only 4 of 32 homes are currently under construction, staff recommends extending the date.
Financial Impact: The addition of 32 home sites will add to the tax base and create needed housing opportunities.

SECOND AMENDMENT TO DEVELOPMENT AGREEMENT
THIS SECOND AMENDMENT TO DEVELOPMENT AGREEMENT (this “Second Amendment”) is entered into as of , 2022 (the “Effective Date”), by and between the City of Hastings, a Minnesota municipal corporation (“City”), and Villas at
Pleasant, LLC, a Minnesota limited liability company (“Developer”).
RECITALS Recital No. 1. The City and Developer entered into that certain Development
Agreement of Villas at Pleasant, Dakota County, Minnesota dated April 12, 2021 and recorded as
Document No. 3528860 on March 10, 2022 in the Office of the County Recorder, Dakota County, Minnesota, as amended by that certain First Amendment to Development Agreement dated July 14, 2022 and recorded as Document No. _____________________ on _____________________ in the Office of the County Recorder, Dakota County, Minnesota
(collectively the “Development Agreement”), for the Subject Property identified in the
Development Agreement. Recital No. 2. Developer has requested the Development Agreement be amended to extend the dates of the installation of wear course.
Recital No. 3. The City does not object to the extension. NOW, THEREFORE, in consideration of the mutual promises and covenants of each to the other contained in this Second Amendment and other good and valuable consideration, receipt
of which is hereby acknowledged, the parties hereto do covenant and agree as follows:
1. The entire Development Agreement is hereby incorporated into this Second Amendment, except as modified below.
2. Section 6(B) of the Development Agreement shall be removed and replaced in its entirety
as follows: B. Surfacing. Following Public Works Department approval of street grading and

utility installation, streets shall be surfaced and provided with concrete curbs and gutters in accordance with the latest recommended plans and specifications
prepared by the Public Works Department and on file at the City. The Developer
shall install the bituminous wear course of streets after the first course (base course) has weathered a winter season, consistent with warranty requirements, but no later than September 15, 2023. Final acceptance of the required improvements by the City will not be granted until all work, including final wear course, is completed.
A bituminous ramping wedge to protect the concrete lip from snowplow damage
shall be installed with the bituminous base course. Prior to paving the bituminous wear course, the ramping wedge must be milled off. The City will thoroughly inspect all curb and gutter for damage prior to the installation of the bituminous wear course and may require repairs and/or replacement by Developer depending
on the severity of damage.
3. Except as provided for above, the terms and provisions of the Development Agreement shall remain in full force and effect.
4. This Second Amendment and all disputes or controversies arising out of or relating to this
Second Amendment, or the transactions contemplated hereby shall be governed by, and construed in accordance with, the internal laws of the State of Minnesota, without regard to the laws of any other jurisdiction that might be applied because of the conflicts of laws principles of the State of Minnesota.
5. Nothing contained herein shall be deemed a waiver by the City of any governmental immunity defenses, statutory or otherwise. Further, any and all claims brought by Developer or its successors or assigns, shall be subject to any governmental immunity defenses of the City and the maximum liability limits provided by Minnesota Statutes,
Chapter 466.
6. This Second Amendment may be executed in two or more counterparts, all of which shall be considered one and the same instrument and shall become effective when one or more counterparts have been signed by the parties and delivered to the other parties.
7. This Second Amendment shall not be amended, modified or supplemented, except by a written instrument signed by an authorized representative of each party.

EMS council. Dakota County EMS council will reimburse lodging, travel, and conference attendance.

Vacation Procedure – Hastings Home Rule Charter Section 7.05 regulates the vacation of streets and alleys. The City Council may consider vacating public ways upon published and mailed notice to affected property owners.
Public Hearing – Notification of the public hearing was mailed to all required property
owners and utility companies. At the time of this report no comments have been received. Recommendation – Approval of the vacation is recommended. The Public Works
Department and City Attorney have reviewed the action and are supportive of the

The City Council approved the Final Plat of County Crossroads 4th Addition on March 7,

WHEREAS, the City of Hastings wishes to vacate the Easements legally described above and depicted on the attached Exhibits A, B and C, respectively; and
WHEREAS, a notice of a public hearing on said vacations was duly published, posted and mailed in accordance with applicable Minnesota Statutes, and a public hearing was held on said vacations; and
WHEREAS, the City Council of Hastings then proceeded to hear all persons interested in
said vacations and all persons interested were afforded an opportunity to present their views and objections to the granting of said vacations; and WHEREAS, the City Council of Hastings has determined that the vacations would be in
the public interest.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Hastings as follows:
1. That pursuant to Hastings City Code § 90.08 and Minn. Stat. § 412.851, hereby
vacates the Easements legally described above and depicted on the attached Exhibits A, B and C, respectively. 2. That said vacation has no relationship to the City’s Comprehensive Plan and
therefore the Hastings City Council has dispensed with the requirements of Minn.
Stat. § 462.356, Subd. 2, that may require the Hastings Planning Commission to perform a Comprehensive Plan compliance review of said vacation that may constitute a disposal of real property pursuant to § 462.356, Subd. 2.
3. That the City Clerk shall prepare a notice to be presented to the Hastings County

Background Information:
The applicant is demolishing the existing house on this double lot. He intends to market
the parcel for construction of a twin home. He believes the subject rights-of-way are
unusable and the additional property gained would make for a more buildable lot. Even
though the parcel is a double lot, the original lots are narrow at 66-feet wide.
Due to the extreme topography of the Clay Street ROW, there is little chance of a street
being constructed. The alley which connects Bailly St to the Clay St ROW is
undeveloped and crosses over the spur RR tracks. Staff believes neither ROW is likely to
be useful to the public.
Utility companies have been notified and a couple have yet to contact the city with any
utility line conflicts, despite multiple attempts. There are visible lines within the Rights-
of-Way, which would require easements be created in their place. The applicant or future
owner may pursue vacation of portions of the newly created easements if it is determined
the utilities are clear of those proposed portions.
Property owners were also notified and staff has not received any comment.
Recommendation – Approval of the vacation is recommended with conditions listed in
the resolution.

Background Information:
At the end of the 2022 Legislative Session, the state passed new laws surrounding the sale of
cannabis/cannabinoid products, which went into effect July 1. The new law limits the sale of intoxicating
CBD products to individuals age 21 and older and implements regulations regarding the packaging of
edible CDB products. However the new law has resulted in questions about local regulatory authority,
law enforcement, and taxing.
On August 1, the City Council referred the subject to the Public Safety Advisory Commission. PSAC met
August 18 and recommended a twelve-month interim ordinance to allow time for adequate study. The
Public Safety Committee of City Council met September 1. They discussed concerns about public safety,
community impact, and supporting local business; they recommended a six-month interim ordinance,
acknowledging it could be extended if further study were needed.

In order to grasp the new regulations about cannabis and CBD products, it is important to review
the evolution of the State legislature’s actions regarding marijuana and hemp uses.
BACKGROUND:
A. Medical Marijuana - 2014
In 2014, the THC Therapeutic Research Act (“Act”) legalized the use of marijuana-derived
compounds for medical purposes (“medical marijuana”) in Minnesota, and created a legal
framework for the manufacturing, testing, and distribution of medical marijuana.1 Patients with
qualifying conditions will be able to obtain medical marijuana for use in liquid (including oil) or
pill form, but not in forms which require smoking, or the vaporization of dried leaves or other plant
forms.2 Originally, only 9 types of illneses qualified a patient to use medical marijuana.3
The Act required the state Commissioner of Health (the “Commissioner”) to register two in-state
manufacturers to produce medical cannabis.4 The two approved manufacturers are still only
Leafline Labs in Cottage Grove and Green Goods in Otsego. Each manufacturer must carry on all
of its cultivation, harvesting, manufacturing, packaging, and processing at one single location, in
an enclosed, locked facility.5

Originally, each manufacturer was required to operate a total of four distribution facilities. The
locations of these distribution facilities must be “based on geographical need throughout the state
to improve patient access.”6
Each manufacturer must also contract with an independent laboratory, also approved by the
Commissioner, to test the medical marijuana produced by the manufacturer and verify that it meets
statutory requirements for content, contamination, consistency, and form.7 There are two
laboratories authorized to conduct independent testing, one is located in St. Paul and the other is
in Maple Grove.
There have been many expansions to the law from the original 2014 version greatly increasing the
qualifying conditions, distribution sites, and methods of delivery. The Act allows the
Commissioner to add additional qualifying medical conditions and delivery mechanisms without
legislative approval.8 These expansions are summarized below:
1. Qualifying Conditions
Although the original list included only 9 qualifying conditions, the list has expanded to 17
qualifying conditions, including chronic pain, intractable pain and obstructive sleep apnea.
2. Distribution sites:
The Act originally provided for each manufacturer to have 4 distribution sites, so there would be
a total of 8. Now, the law allows each manufacturer to have up to 8 distribution sites.9 There are
currently 13 distribution sites in Minnesota: Woodbury, Eagan, Burnsville, Bloomington, Blaine,
St. Paul, Minneapolis, St. Cloud, Rochester, Hibbing, Duluth, Willmar and Moorhead.
3. Methods of Delivery:
The Act provided for delivery in the form of a liquid or pill only, and specifically excluded
smoking or vapor. The law now allows both vaporization of the liquid or oil and new this year,
smoking of dried raw cannabis.10
With the increase in the qualifying conditions, the additional distribution sites and the expansion
of methods of delivery, patient enrollment has increased dramatically. In 2015, there were 837
patients enrolled. Today, there are 37,112.

That same year, the federal government passed the 2014 federal farm bill, allowing the growing
of hemp containing less than .3 percent THC. This resulted in a new industry of manufacturing
and selling hemp products of all kinds, which slowly began to take off in other parts of the country.
B. Nonintoxicating Cannabinoids (CBD) - 2019
In 2019, the Minnesota legislature authorized the sale of products containing nonintoxicating
cannabinoids extracted from hemp.11 This law gave CBD businesses the launching point needed
to open throughout the state, first as part of smoke shops and then as standalone businesses.12 Last
year, the investment bank Cowen estimated that the U.S. CBD industry will be worth $16 billion
by 2025. Without local licensing or zoning, CBD products suddenly appeared as permitted uses in
tobacco stores or general retail establishments on Minnesota’s main streets. Many stores began
selling products that contain CBD with THC as an incidental part of their retail business.
C. Intoxicating CBD
Then, in May of 2022, on the last day of the legislative session, in the middle of the Health and
Human Services omnibus bill, the legislature passed new laws surrounding the sale of CBD
products, which went into effect on July 1, 2022 and which has exploded edible CBD product
sales. The law limits the sale of intoxicating CBD products to those 21 and older and implements
the following regulations regarding the packaging of edible CBD products:

Additional requirements for edible cannabinoid products.
(a) In addition to the testing and labeling requirements under subdivisions 4 and 5, an edible
cannabinoid must meet the requirements of this subdivision.
(b) An edible cannabinoid product must not:
(1) bear the likeness or contain cartoon-like characteristics of a real or fictional person, animal,
or fruit that appeals to children;
(2) be modeled after a brand of products primarily consumed by or marketed to children;
(3) be made by applying an extracted or concentrated hemp-derived cannabinoid to a
commercially available candy or snack food item;
(4) contain an ingredient, other than a hemp-derived cannabinoid, that is not approved by the
United States Food and Drug Administration for use in food;
(5) be packaged in a way that resembles the trademarked, characteristic, or product-specialized
packaging of any commercially available food product; or
(6) be packaged in a container that includes a statement, artwork, or design that could
reasonably mislead any person to believe that the package contains anything other than an edible
cannabinoid product.
(c) An edible cannabinoid product must be prepackaged in packaging or a container that is
child-resistant, tamper-evident, and opaque or placed in packaging or a container that is child-resistant,
tamper-evident, and opaque at the final point of sale to a customer. The requirement that packaging be
child-resistant does not apply to an edible cannabinoid product that is intended to be consumed as a
beverage and which contains no more than a trace amount of any tetrahydrocannabinol.
(d) If an edible cannabinoid product is intended for more than a single use or contains multiple
servings, each serving must be indicated by scoring, wrapping, or other indicators designating the
individual serving size.
(e) A label containing at least the following information must be affixed to the packaging or
container of all edible cannabinoid products sold to consumers:
(1) the serving size;
(2) the cannabinoid profile per serving and in total;
(3) a list of ingredients, including identification of any major food allergens declared by name;
and
(4) the following statement: "Keep this product out of reach of children."
(f) An edible cannabinoid product must not contain more than five milligrams of any
tetrahydrocannabinol in a single serving, or more than a total of 50 milligrams of any
tetrahydrocannabinol per package.13
However, some issues that have arisen since the new law went into effect. Without going into
every business in the city (retail, massage, chiropractor), there is no way to know who is selling
these products. There is also no reliable mechanism for testing edible CBD products for the levels
of THC, therefore local law enforcement is forced to trust the packaging labels provided by the
manufacturers.

FORECASTING THE FUTURE
Many observers believe that authorization for medical marijuana (and now intoxicating CBD) will
precede authorization for recreational use, noting that California, Colorado, Washington and many
other states followed that sequence.14 If this occurs, medical marijuana distribution sites and stores
that sell CBD products could be converted into recreational marijuana stores immediately. Without
any regulations at all, recreational sales of marijuana could be considered general retail uses and
move into any storefront in any business district.
There are concerns that such uses are incompatible or inharmonious in certain zoning districts and
with other land uses.15 For example, growing and processing operations have characteristics of
other agricultural and industrial land uses, including the potential to emit strong odors.16
According to Charles McGinley, a registered Environmental Professional Engineer who
specializes in odor issues and air toxicity, the process of drying marijuana leaves emits a strong
skunk-like odor, suggesting that certain measures such as odor mitigation and air purification
systems should be required. In addition, there are potential security concerns surrounding sales of
marijuana and TCH CBD products. Federal banking regulations do not clearly authorize banks to
provide services to marijuana-related businesses. As a result, most medical distribution sites and
sales of such products operate on a cash-only basis, creating security risks.
In the absence of any municipal regulations, there is a concern that manufacturing, testing
laboratory, and sales for marijuana or CBD will fall under existing land use categories, and qualify
as permitted or conditional uses under existing Zoning Code regulations as medical clinics, retail,
pharmacies, farming, and greenhouses.
Zoning Regulations:
There are many zoning regulations that can be adopted to appropriately place these types of uses
in the right zoning district with public health, safety and welfare performance standards. Some
options are as follows:
• Defining CBD exclusive retail stores as those that derive more than 50% of their gross
revenue sales from CBD products, similar to a liquor store.
• Defining CBD products into 2 types: intoxicating and non-intoxicating
o Intoxicating products means the products that produce intoxicating effects and may
include but are not limited to products made with Delta 8, 9 and 10.

o Non-intoxicating products means products that do not produce intoxicating effects.
• Defining incidental CBD sales as those CBD sales that are not typically part of the primary
business or do not make up a majority of sales for the business. (i.e. massage therapy
businesses, drug stores, or gift shops who may have a kiosk with a few CBD products)
• Allowing only CBD exclusive stores to sell intoxicating CBD products. If you allow sales
at any retail store, then we would have to add limitations on accessibility of the products.
• Limit CBD exclusive stores to appropriate zoning districts. The sale of non-intoxicating
CBD products could be permitted anywhere, but intoxicating CBD products would require
a CUP.
• Implementing distance requirements from other CBD exclusive stores and from schools
(most cities have discussed 1,000 feet)
• Requiring security plans for intoxicating CBD stores,
• Prohibiting the sale at drive-throughs windows.
• Allowing medical distribution facilities in certain zoning districts, with a security plan and
distance requirements from schools and residential property, as already required in state
law.
• Allowing medical labs in the industrial park
• Allowing Hemp Growing Operations in the Ag District as a permitted use, as long as they
have 200 contiguous acres, and they cannot sell on site.
• Prohibiting marijuana manufacturing and hemp manufacturing due to nuisance-related
odor problems.
• Prohibiting any sales of CBD products that contain more than .3% THC. While this
prohibition on intoxicating CBD products is state law today,17 in the event the Minnesota
legislature legalizes recreational marijuana, the City’s specific identification of the
prohibition on selling anything over .3% would not allow any business to immediately sell
recreational marijuana upon adoption of state law (unless the state law pre-empted local
zoning). This prohibition would allow the City time to study if and where recreational
marijuana should be allowed.
Licensing regulations
While the licensing regulations will be similar to other licenses of its type (tobacco, liquor),
requiring an application, fee, background check, a process for approval, suspension or revocation,
it could also include the following:
• License only the stores that sell intoxicating CBD products
• Limit the sales to exclusive CBD shops
• Prohibiting anyone under 21 from entering
• Requirement to check IDs (including signs that clearly display no one under 21 can
purchase)
• Prohibiting anyone under 21 to sell the products
• Prohibiting firearms on the premises
• Restricting hours of operation
• Not allow sampling

• Not allow on-site entertainment
• Prohibit internet sales or delivery service
• Prohibit transient merchant sales or sales at special events (no mobile sales)

• Prohibit powders, gels or other forms that are mixed with beverages
• Must comply with the statutory regulations regarding packaging
• Limit the number of CBD licenses

CONCLUSION
Given the potential for unintended consequences without any regulations in place, an interim
ordinance (commonly called a “moratorium”)18 is a tool used by cities in order to study the impacts
of certain uses and determine whether regulations are appropriate for the purpose of protecting the
public health, safety and welfare of their citizens. In order to be proactive and thoughtful in
considering the potential impact of these uses within the City, as well as the uncertainty
surrounding any upcoming legislation, it is recommended that the City adopt an interim ordinance
and undertake a study to consider where these types of uses should be located, how many of them
should be allowed and whether or not licensing restrictions are appropriate. The interim ordinance
may be in place for up to one year, however, it can be terminated at any time by the Council and
would automatically terminate with the adoption of any ordinances surrounding the regulations of
these uses.
RECOMMENDATION
Discuss and made recommendations to the Public Safety Committee of the Council.

OR THE EXPANSION OF EXISTING USES RELATED TO CANNABIS AND
INTOXICATING CANNABINOIDS (CBD) SALES, TESTING, MANUFACTURING OR
DISTRIBUTION
WHEREAS, pursuant to Minnesota Statutes, Section 462.355 subdivision 4, many cities
have adopted interim ordinances in order to study the impacts of certain uses and determine
whether regulations are appropriate for the purpose of protecting the public health, safety and
welfare of their citizens; and
WHEREAS, the City is undertaking a study to consider possible changes to the Zoning
Ordinance and City Code that would address the types of uses that involve the sales, testing,
manufacturing and distribution of cannabis and products that contain intoxicating cannabinoids
(CBD) whether for medical, recreational or for other human or animal consumption purposes and
may implement many of the suggestions from the study.
The City Council of the City of Hastings, Dakota County, Minnesota, does hereby ordain
as follows:
SECTION 1. No business, person or entity may establish a new use or expand an existing use
that includes or involves the sales, testing, manufacturing, or distribution of cannabis in any way,
whether medical or recreational, or any products that contain intoxicating cannabinoids extracted
from hemp (CBD) in any form, for a period of up to six (6) months from the effective date of this
ordinance or until ordinances regulating such uses become effective or until the Council rescinds
this Interim Ordinance, whichever occurs first.
SECTION 2. City Staff is directed to conduct a study to gather information and make a
recommendation to the Council to determine if the Zoning Ordinance and City Code need to be
amended regarding these types of uses to better protect the citizens of Hastings, and if so, what
regulations are appropriate.
SECTION 3. SUMMARY PUBLICATION. Pursuant to Minnesota Statutes Section 412.191,
in the case of a lengthy ordinance, a summary may be published. While a copy of the entire
ordinance is available without cost at the office of the City Clerk, the following summary is
approved by the City Council and shall be published in lieu of publishing the entire ordinance:
The City will be undergoing a study regarding CBD and cannabis uses to determine if
regulations surrounding zoning and licensing are appropriate. No new use may be
established, and no existing use may be expanded until the City adopts regulations
regarding these uses, or determines no regulations are necessary and rescinds the interim
ordinance or for a period of six months, whichever occurs first.

SECTION 4. EFFECTIVE DATE AND EXPIRATION DATE. This ordinance shall be in full
force and effect from and after its passage and publication according to law and shall expire upon
adoption of ordinances regulating such uses, until the Council rescinds or terminates the Interim

Friends of Pleasant Hill Library has requested a disbursement of $500 from the Doffing Trust Fund to
support Crafter-noon events this fall and winter.
Background Information:
In 1990, Mrs. Ruth Doffing executed a Charitable Remainder Unitrust establishing the City of Hastings as
the recipient of certain funds to be used for land acquisition for a public library. When a new library was
built as a fully incorporated branch of the Dakota County Library System in 1994, the intent of the
Unitrust was amended to indicate the funds be used “to purchase things for the library that are not in their
normal budget. It may be possible to keep the money invested and use the annual income for these
purchases. The decision as to what should be purchased could be made by the Executive Board of the
Friends of the Pleasant Hill Library.”
In 2007, the Friends of Pleasant Hill Library, Jeff Carlson representing the Doffing Estate, and the City
Finance Committee developed a set of criteria for considering requests for use of the funds. The City
Council approved the Doffing Funds Expenditure Guidelines in October 2008:
a) Historical collections and other items specific to Hastings.
b) Reading programs, books and computers.
c) Use to purchase items for the Library that are not in the normal budget.
d) Items/equipment purchased cannot be used at other sites.
e) Friends of the Pleasant Hill Library must submit the request and include recommendations for
approval.
f) Attempt to use the annual income for these purchases, based upon investment earnings of the
principal.
In late July of this year, the Friends of Pleasant Hill Library on behalf of the Library requested $500 to
support the expansion of an existing Crafter-Noon program. This would be additional programming
beyond what the Library has budgeted, “Our programming funds have already been expended through the
close of the year, and these programs would meet a request from the community.”

City of Hastings guidelines (dated October 16, 2008), “Friends of
the Pleasant Hill Library must submit the request and include a
recommendation for approval.”
Pleasant Hill Library is requesting use of the Doffing Estate funds
in the amount of $500 to support Crafternoon events in Fall/Winter
2022.
These events for teens and adults are a response to interest and
requests we have gotten for more crafting programs, and ones on
different topics than we have been able to offer in the past. Each
session focusses on a different craft technique or medium.
Funding will enable us to purchase supplies for these programs or
contract with an instructor.
The request above is in keeping with the guidelines adopted by
the City of Hastings in 2008 for use of the Doffing Estate funds.

respond to customer interests and build community at the library.

Item: Implementation of Compensation Study
Council Actions Requested:
1. Adopt the Step & Grade Scale (2022 final).
2. Approve wage adjustments for non-represented (non-union) employees, retroactive to July 4,
2022, as outlined in this memo.
Background Information:
At the July 18 City Council meeting, Abdo Solutions presented the Position Classification &
Compensation Study Report. Subsequently, the Administration Committee of City Council met July 27
and August 5 to discuss the Study and how to implement it. The City Council held workshop on the
subject August 15.
I believe the recommendation fairly balances several priorities: making sure that the City is paying wages
competitive with neighboring communities, providing a formalized structure for internal consistency and
legal compliance, and maintaining a payroll that is affordable for the City’s budget. This positions the
City to retain high-performing employees, while also being able to recruit top talent to meet future needs.
Please note that the recommendation outlined here is subject to revision and approval by the City Council.
My recommendation is based on the two Administration Committee meetings and is also included in my
recommendations for the 2023 Budget. Here’s the step-by-step version of it:

1. Ensure all positions are in the competitive market range. Please see the illustration above,
noting that each union, each position, and each individual employee will be different.
• The current pay range of this position goes from Step G ($31.20) to Step A ($39.01), and
this hypothetical employee is at Step B ($37.72).
• The competitive pay range is based on the survey of neighboring cities. It goes from Step
1 ($34.53) to Step 8 ($43.21).

• The two pay ranges are lined up so no one would have a pay cut when converting from
the current range to the market range. Please note that some positions line up further
below the market than shown here, and some closer to or even above the market range.
• Several positions are currently above the new market range. They are recommended to
keep their current pay rate (no one has a cut in pay).
2. No cut in pay.
• No employee has a cut in pay when converting from the current range to the market
range.
• Depending on the position and the market, most positions would have an increase
somewhere between $0.20 and $1.56. There is one considerably below market currently,
which is recommended for $3.84 to get into the market range. There are also several
positions already above the market range, which would remain at their current wage as
discussed below.
• In the case of this hypothetical employee, converting from Step B to Step 4 results in a
modest raise of $0.29.
• Exception: In order to avoid misperception of my recommendation being self-serving, the
recommendation is that my wage as City Administrator not receive an incremental
increase when converted into the new range effective July 2022 and also not receive a
step increase in January 2023.
3. Retroactive to July 2022.
• The new pay rate is recommended effective July 4, 2022. This is approximately when the
Compensation Study was completed, and it keeps the math easy with the beginning of a
pay period.
4. Opportunities for steps going forward.
• In the example, the hypothetical employee had 1 step until reaching the top of the current
range, and would result in 4 steps until the top of the new range.
i. This gives opportunities for additional raises going forward.
ii. The recommendation includes step increases in January 2023.
iii. Advancing steps each January should be based on satisfactory job performance
throughout the preceding year.
• A different example might be a long-term employee at the top of the range Step A, then
converting to Step 5 in the new range.
i. It might be nice if we could keep this hypothetical employee at the top of the
range, but that got really cost prohibitive when running the calculations across all
employees. The recommendation is to phase in future steps to keep the budget
impact reasonable.
ii. This is also partly due to adding a step, since the current system has 7 steps;
while, the new system has 8 steps.
iii. Please note this still meets the goal of making sure employees are in the
competitive range and not having a cut in pay.

iv. A long-time employee who might convert from Step A to Step 5 (for example)
would not lose longevity, which is calculated separately from the steps.
5. Adjustments for highly competitive positions.
• Accountants and Building Inspectors are in short supply in the market.
i. In order to make sure we are extra competitive with these positions, the
recommendation is that none of these positions (and their supervisors) be below
Step 6 in the new range.
ii. Any that place in the upper Steps 6 through 8 when converted into the new range,
would be at that step.
iii. Any that might convert to a lower step, would be raised to Step 6.
There are several additional factors important to considering the City’s compensation system. They are
not directly part of the recommendation for City Council action tonight, but they are presented here for
transparency and to keep the entire system in context.
6. COLA.
• The budget recommendation includes a 3% COLA in January 2023, including for several
positions currently above the new market range.
• Please note that this amount is consistent with our 3 union contracts that cover 2023 (the
other 2 contracts need to be negotiated beyond 2022), as well as in line with what
neighboring cities are planning.
7. Union negotiations.
• We have a number of employees represented by unions. 2 of the 5 union contracts expire
at the end of 2022. The other 3 expire at the end of 2023.
• These contracts would need to be negotiated and approved separately.
i. I expect these negotiations to be similar and consistent with this overall
implementation plan.
ii. We have had positive negotiations with the 2 unions with whom we’ve met this
past week.
• We have committed to re-open these contracts after completion of the Comp Study.
8. Round tables and correcting potential mistakes.
• We have scheduled opportunities to discuss and explain the study and its implementation
with employees on September 7 and 13. Additional meetings will be schedule if needed.
• If there might be technical mistakes (for example a required license missed when
updating job descriptions, or a data entry error), we would certainly investigate and
correct as appropriate.

AND SETTING TRUTH IN TAXATION HEARING DATE
WHEREAS, the City must annually prepare a budget that is responsive,
responsible, and in alignment with our CORE values and strategic plan; and
WHEREAS, departments prepare requests with are discussed and reviewed as a
team and with the Finance Committee of the Council (Folch, Fox, Vaughan*); and
WHEREAS, the Finance Committee and the City Council have met several times
over the last few months to discuss the preliminary budget information; and
WHEREAS, the committee has directed the City Administrator and staff to
prepare a preliminary 2023 tax levy and budget, a special levy, and set a truth in
taxation hearing date; and
WHEREAS, provisions of the Minnesota Truth and Taxation Law require Cities to
certify a Proposed Property Tax Levy and City Budget to the County Auditor by October
1, 2022; and
WHEREAS, City staff was directed to set the 2023 City Preliminary levy at
$17,373,405, the Preliminary Budget at $38,011,078, and to schedule a truth in taxation
public hearing date at 7:00 p.m. on Monday, December 5, 2022 in the City Council
Chambers at Hastings City Hall, with a continuation date (if needed) of Monday,
December 19, 2022; and
WHEREAS, the City has sufficient cash on hand to reduce the debt levy to
$2,381,918.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Hastings,
Minnesota; that the preliminary Property Tax Levy of the City of Hastings, for the 2023
City Budget to be certified is hereby adopted.

A RESOLUTION APPROVING A PROPOSED 2023 HEDRA-HRA SPECIAL TAX LEVY
WHEREAS, the Hastings Economic Development and Redevelopment Authority
(the “Authority”) was created by the City Council of the City of Hastings (the “City”)
pursuant to Minnesota Statutes, Sections 469.090 to 469.1081; and
WHEREAS, the Authority was granted all of the powers of a municipal housing
and redevelopment authority under Minnesota Statutes, Sections 469-001 to 469-047
(the “Act”); and
WHEREAS, Section 469.033, Subdivision 6, of the Act, as amended, permits the
Authority to levy and collect a special benefit tax of up to .0185 percent of taxable
market value in the City upon all taxable property, real and personal, within the City;
and
WHEREAS, the Authority desires to levy such tax based upon the limit of .0185 %
of the taxable market value; and
WHEREAS, the levy of such a special benefit tax is subject to consent by
Resolution of the City Council of the City of Hastings.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Hastings,
Minnesota; that the City of Hastings HRA Special Levy be granted subject to the limit of
.0185 percent of taxable market value as per Minnesota Statute.
