HASTINGS PLANNING COMMISSION MEETING
TUESDAY, DECEMBER Z6, 1978
7:30 P.M.
The meeting was called to order at 7:30 P.M. by Chairman Stoffel.
Members Present:
Commissioners Stoffel, Murphy, Groth, Kramer,
Legler, Liska, Latch, Gergen and Wendler who arrived
at 7:34 P.M.
Members Absent: None
Moved by Commissioner Kramer, seconded by
Commissioner Groth to approve the Minutes of the
December 11, 1978 Planning Commission meeting.

APPROVAL OF MINUTES
Chairman Stoffel opened the Public Hearing at 7:34 P. M.
The Planner reported that on file were the Notice of
Public Hearing, the Affidavit of Publication, and the
Certificate of Mailing. Thus, the Public Hearing was
properly called. The Planner went on to explain that
since the last Planning Commission meeting, the
developers had submitted revised plans addressing
the comments indicated in the last Staff report. He
also reported that the NRRC had recommended that
the park dedication requirement be met by cash payment
in lieu of land.

After all people present had an opportunity to be heard on the
matter, Chairman Stoffel closed the Public Hearing at 7:45 P.M.
Cornrnissioner Liska asked if the development contract could
contain a clause which addressed the issue of keeping the
emergency access to the rear open in the winter months. The
Planner explained that either the development contract or home
owners documents could contain such a clause. Considerable
discussion followed regarding the various alternatives for the
emergency access. Cornrnissioner Groth expressed concern
about the appropriateness of the section of the zoning ordinance
relating to the maximum length of townhouse buildings. Also
discussed at length was the issue of cost and needs for improving
streets near the proposed development.
Moved by Commissioner Groth, seconded by
Commissioner Wendler to approve the special use permit,
the preliminary plat, and variances with the following conditions:

The park dedication requirement shall
be met by cash payment in lieu of land.
The emergency access drive be constructed
with a crushed rock surface instead of the
roadway base being covered by sod as
indicated on current drawings.

That 5th Street adjacent to the development
be improved.

Moved by Commissioner Latch, seconded by Commissioner
Murphy to recommend to the Council that the following street
improvements be added to the 1979 Capital Improvements
Program.
Ash Street between 4th and 5th Streets
5th Street between Ash Street and State
Street.
9 Ayes - 0 Nayes.
Moved by Commissioner Latch, seconded by
Commissioner Groth to appoint a committee to
investigate the viability of Section 10.07, Subdivision
6T (limiting townhouse structures to a maximum length
of 160 feet). 9 Ayes - 0 Nayes.
Chairman Stoffel referred the matter to a Committee
consisting of Commissioners Latch, Groth,and Wendler.
Commissioner Groth expressed concern for the need
for more study into aspects of the proposed plan. He
made specific reference to concern of the reasonableness
of policy statements regarding development on slopes
and the policy limiting "clear cutting of significant stands
of native vegetation".
Moved by Commissioner Groth, seconded by Commissioner
Legler to refer the matter to a committee for further
study. 9 Ayes - 0 Nayes.
Chairman Stoffel referred the matter to a committee
consisting of Commissioners Groth, Wendler, and Murphy.

The Planner presented a questionaire proposed to
be sent to a random sampling of 500 residences with
the water billings. Commissioner Liska felt that the
definition of "duplexes" should be more explicit.
Commissioner Gergen also felt that the issue should
be more directly related to possible impact on l~rospective
respondents by possibly indicating that a duplex could be
constructed adjacent to them. Commissioner Groth
also interjected that the questionaire should also state
that the Planning Commission's actions could affect
people intending to construct duplexes on their property.

Moved by Commissioner Kramer, seconded by Commissioner
Legler to direct the Planner to send out the questionaire with
changes in the two areas discussed. 9 Ayes - 0 Nayes.
The Planner explained that the issue currently under
consideration was to create a new industrial zoning
district in the industrial park area to accomodate
impound lots. The Council had asked that the Planning
Cornnnission research the matter and make a recommen-
dation. He suggested that rather than create a new zoning
district, which classification could be petitioned by owners
of property in industrial areas for rezoning, :that the
Planning Commission consider amending the existing
industrial park ordinance to allow such things as
automobile impound lots and storage lots for rental
transportation vehicles with specific site location criteria.

Commissioner Latch stated that since that approach is really
v'e~ry similar to the original recommendation by the Planning
Commission, that the Planner report that condition to the
Council and ask for their direction. As the Planning Commission
appeared to be in agreement on the matter, Chairman Stoffel
directed the Planner to report to the Council as Commissioner
Latch had suggested.
Commissioner Wendler gave a Committee report COMMITTEE REPORT ON
regarding the Committee's research into a development EIGHT-PLEX DEVELOP-
proposal for an eight-plex that a Mr. Jim O'Connor MENT PROPOSAL
had presented to the Planning Commission at their last
meeting. Cornrnissioner Wendler referred to concerns about
access, alternative access routes, utilities, and sub-surface
rock conditions. He explained that he had discussed the matter
with the Planner, and that the Planner was attempting to obtain
information regarding the status of a pre-existing easement.
Moved by Commissioner Groth, seconded by
Commissioner Wendler to adjourn at 9:11 t~. M.
