HomeMy WebLinkAbout03/12/79MIN JTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, MARCH 12, 1979 7:30 P.M. The meeting was called to order at 7:32 P.M. by Chairman Latch. Members Present: Commissioners Latch, Murphy, Kramer, Wendler, Liska, Gergen and Groth who arrived at 7:40 P.M. Members Absent: Commissioners Hughes and Bultman As the Minutes of the February 26th meeting had not been prepared, no action was taken. APPROVAL OF MINUTES Mr. Redlin was requesting a home occupation permit to sell his wildlife art through the mail. Mr. Redtin indicated that the only vehicles anticipated visiting the premises were UPS vehicle once a week during Christmas and less often during the rest of the year, and an occasional visitor to the house, on an infrequent basis. HOME OCCUPATION PERMIT - SALE OF WILDLIFE ART AND LIMITED EDITION PRINTS THRU THE MAIL - TERRY REDLIN - 1028 W. 14TH Moved by Commissioner Kramer, seconded by Commissioner Wendler to approve the home occupation permit. 6 Ayes - 0 Nayes. The Minder$ are requesting a home occupation permit to operate a photography studio in their home. They have indicated that there would be no film processing in the home, and that only one car at a time, with three to seven cars a week expected. There was some d[scussinn whether or not the occupation would involve disruption of the neighborhood, being that the location was on a cul-de-sac. Mr. Minder explained that three to seven cars per week was a high estimate. The Planner explained that the Capital Improvements Plan was very general and very flexible and was done so for a purpose. That purpose being so that the projects included in the Critical Areas Capital Improvements Program could be included in a city wide capital improvements program in the future. Mr. Peter Likes asked if a particular problem on East 1st Street could be included in the Capital Improvements Program. MISSISSIPPI RIVER CORRIDOR CRITICAL AREAS CAPITAL IMPROVE- MENTS PLAN Hastings Planning Commission Minutes (Continued) -2- March 1Z, 1979 The Planner responded that the situation Mr. Like's was referring to is already the subject of a study by the City. Chairman Latch asked the Planner to check the timing for utility construction versus road re- construction for County Rd. #42. Moved by Commissioner Murphy, seconded by Commissioner Liska to approve the Critical Areas Capital Improvements Program subject to the Planner researching the subject referred to by Chairman Latch. 7 Ayes - 0 Nayes. At this point in the meeting, Commissioner Groth commented that he had a conversation with a Ravenna Tox~ashipSupervisor regarding critical areas planning. He stated that the Supervisor had expressed concerns about the limited development possibilities that were available in Ravenna due to critical areas regulations. The Supervisor, Frances McNamara, was present at the meeting and explained that due to the 100 foot setback requirement from bluff lines and the river, the development possibilities for his own land would be limited. He also commented that he was somewhat restricted from cutting trees on his property. At this point, Chairman Latch brought up a subject that had been discussed at the last Planning Commission meeting dealing with the critical areas ordinance. Chairman Latch asked the Planner to report to the Planning Commission about existing platted lands for which taxes had been paid for some time being rendered undevelopable due to the requirements of the proposed Environmental Overlay Ordinance. It was suggested that the Council might want to add to the Critical Areas Plan a policy statement on how to handle these platted lots. The Planner explained that as pa rt of the recent flood insurance meeting, the City had received an evaluation report from the Federal Insurance Administration regarding Hastings's Flood Plain Ordinance compliance with Federal Insurance Administration regulations regarding flood plain management. He explained the comments on Hastings's flood plain ordinance pertain to the lack of specific controls regarding mobile homes in the flood plain, subdivision requirements in the flood plain ordinance, and record keeping regarding building permits in the flood plain. The Planner stated that Loucks and Associates and himself were reviewing the new proposed Environmental Overlay Ordinance to see how well this would relate to the Flood Insurance Administrations comments, and that Mississippi l~ive r Critical Areas (Cont.) Flood Plain Management (Continued) The Council had received a letter from the City of Roseau which indicated that Roscau was challenging the Minnesota Department of Natural Resources's Authority in requiring structures to be elevated to one foot above the 100 year flood elevation. The letter requested a letter of support if the community felt that it identified with Roseau's situation, and also suggested sending a representative to a joint meeting to be held on the matter. The Planner then presented the Planning Commission with a letter from the Department of Natural Resources explaining the rationale and basis for requiring the additional one foot elevation. EVALUATION OF REQUEST FROM CITY OF ROSEAU REGARDING FLOOD PLAIN IV~ANA GEIViEN T RE QUIREMEN TS The Planner then recommended that the Planning Commission not support the City of Roseau for many of the reasons explained in the letter from the Department of Natural Resources and that the additional one foot of protection provided a reasonable level of protection. The Planning Commission comments were as follows: Name Comments Commis stone r Wendle r Commissioner Wendler indicated that he agreed with the City of Roseau's concerns. He did not feel that the Minnesota Dept. of Natural Resources had the authority to require the additional one foot requirement. Commiss/oner Groth Commissioner Groth agreed with Commissioner Wendler and also stated that the flooding problems that have occured in Hastings in 1978 had been outside the flood plains of either of the rivers in Hastings. Commissioner Groth again commented that he felt that other governmental agencies were taking too much power from the local government. He asked that the Planner provide the Planning Commission with a copy of the environmental assessment worksheet that was being prepared for the Rivers Edge development for their information. Commissioner Latch Commissioner Latch also stated that he did not feel the State had the right to impose the additional requirement. Name Comment Commissioner Liska Commissioner Liska commented that she felt that the Dept. of Natural Resources had better information, more resources, and a more complete study of the overall situation. Therefore she felt that the additional one foot of protection was reasonable. Commissioner Latch suggested passing all the comments on to the Council for them to use in re&king their decision on whether or not to support the City of Roseau. Moved by Commissioner Wendler, seconded by Commissioner Murphy to pass the following motion: 'It is generally agreed that the Planning Commission does not agree with the authority of the Minnesota Department of Natural Resources to impose the addition of one foot to the required structure elevation. The additional foot should have been in the form of a recommendation. TM Commissioner Latch suggested that even if the Council decides not to support the City of Roseau, a representative from the City of Hastings should go to any meeting arranged by the City of Roseau. Moved by Commissioner Wendler, seconded by Commissioner Liska to amend the motion to include a recommendation that the City of Hastings send a representative to any meeting held by the City of Roseau. 7 Ayes - 0 Nayes. The vote was then taken on the motion as amended. 7 Ayes - 0 Nayes. Moved by Commissioner Murphy, seconded by Commissioner Wendler to adjourn at 9:10 P.M. 7 Ayes - 0 Nayes. ADJOURNMENT
