HomeMy WebLinkAbout04/23/79UTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, APRIL 23, 1979 7:30 P.M. The meeting was called to order at 7:36 P.M. by Chairman Latch. Members Present: Commissioners Latch, Murphy, Kramer, Hughes, Bultman, Liska and Gergen Members Absent: Commissioners Groth and Wendler Moved by Commissioner Murphy, seconded by (~bmmlssioner Hughes to approve the Minutes of the April 9, 1979 Planning Commission meeting. 7 Ayes - 0 Nayes. APPROVAL OF MINUTES Ms. Rohr approached the Planning Commission with a request to approve the moving of a building from the Veteran's home to one of two prospective sites she and her father have picked out. She explained that they were under something of a time limitation and that the house had to be move4 by a certain date. Chairman Latch referred the matter to the Liska Committee. MOVING A BUILDING REQUEST- MS. MARY R OHR The Planner reported that it had been discovered since the last Planning Commission meeting that the two lots were 460 square feet short of the minimum lot size rather than the previously indicated 988 square foot deficit. He went on to explain that there was no evidence that any portion of the block had been rezoned to an R-Z zoning category. The Planner then reported that Commissioner Wendler, the Committee Chairman, had contacted him about the Committee's research. It was the Committee's opinion that 460 square feet would not be a great deviation from the minimum required, that a denial of the variance request might be considered a hardship, that variances would be preferable to the alley vacation, and that duplexes would be preferable to the alternative of a multi-family structure. COMMITTEE REPORT- VARIANCES - LOT SIZE REQUIREMENTS FOR CONSTRUCTION OF DUPLEXES IN AN R-3 ZONING DISTRICT -CORNEB OF WEST 13TH & EDDY STS - PAUL MURPHY A resident of the neighborhood stated from the audience that he felt that the neighborhood would be opposed to anything other than single family dwellings at that location. Mr. Clement Werner asked if a fence could be required with the development. The Planner reponded that it would be difficult for the Planning Commission to require a fence when not specifically required by the zoning ordinance. Planning C0mm[ssi0n Minutes -2- April 23, 1979 Mr. Bob Swanson, a representative of Industrial Builders, which has an office building near the location indicated that he would be in favor of the duplex proposal. Moved by Commissioner Kramer, seconded by Commissioner Bultman to approve both variances as it appears to be in the public interest and subject to Mr. Murphy submitting a drainage plan prior to building permit approval. 7 Ayes - 0 Nayes. The Planner presented the Staff report and reviewed the Staff comments. The Planhing Commission discussed points of the Staff report referring to the possibility of a pedestrian walkway and suggestions for landscaping within the plat. The general concensus was negative on both those points. Moved by Commissioner Kramer, seconded by Commissioner Hughes to schedule a Public Hearing on the rezoning and preliminary plat request for the May 14, 1979 Planning Commission meeting conditioned upon the receipt of a revised preliminary plat addressing the necessary changes noted in the Staff Report by May 7th, 1979. 7 Ayes - 0 Nayes. Mrs. Krizan is requesting a special use permit to operate a day care center. Mrs. Krizan is applying for a day care license from Dakota County which would allow a maximum of five children under her care. Commissioner Gergen noted that when the Planning Commission and Council had been reviewing an application for a special use permit for a pre-school nursery in the same neighborhood, the Krizan's had signed a petition against that request and the request had ultimately been denied. He stated that he felt that it would be difficult for the Planning Commission and Council to approve this request since the former one had been denied. Moved by Commissioner Kramer, seconded by Commissioner Hughes to schedule a Public Hearing for the May 14th, 1979 Planning Commission meeting. 6 Ayes - Gergen, Nay. Paul Murphy Variance (Continued) PRELIMINARY PLAT & REZONING - SOUTH SIDE WEST Z3RD ST. -WILLARD BAUER SPECIAL USE PERMIT- DAY CARE CENTER IN AN R - 1 ZONE- MARY KRIZAN Planning Commission Nlinutes -3- April 23, 1979 (Continued) Iv[la. Loesch is applying for a home occupation to operate a bealty shop in her home. The location is adjacent to the Oakridge Iv[anor elderly housing development, and Mrs. Loesch hopes to have most of her business from that facility. HOME OCCUPATION PERMIT- BEAUTY SHOP - 1101 HILLSIDE ST. - DOROTHY LOESCH Chairman Latch announced that he hgd received a petition signed by 32 residents of Oakridge Manor asking for a beauty shop within walking distance of Oakridge Manor. Cornrnissioner Bultman stated she felt that it did not need a Cornrnittee review, but should be approved without any further study. Chairman Latch stated that he felt it should be studied further and appointed the Liska Committee to review the matter. The City appr3ved the preliminary plat entitled 'Westview Village' a little over one year ago. The final plat was in conformance to the preliminary plat. Commissioner Kramer expressed a concern that under that platting arrangement, it appeared that if each of the lots was owned by a separate person or group, that there did not appear to be any provision for the use of the recreational lot by all residents of all the units. FINAL PLAT - GASPARRE ADDI TI ON- N OR THEAS T OF WESTVIEW DRIVE EAST OF PLEASANT DR. MID CONTINENT DEV. Moved by Commissioner Murphy, seconded by Commissioner Hughes to approve the final plat subject to the developer indicating /he total area and individual lot areas and square feet on the City's copy of the final plat, payment of interceptor sewer charges, and assurances that the recreational area would be available to all residents of the addition. 7 Ayes - 0 Nayes. Star Realty has applied for a variance from the sign height requirements which would limit a sign to only being six feet above the highest outside wa~l of the building. The sign in question is presently a sign advertising the Sinclair Oil Station, and it ks currently in violation of the sign ordinance. Star Realty would like to replace the panels to advertise the Star Realty building. The Planner indicated that he had recently determined that the sign was on a separate parcel from the Star Realty property, and therefore would be considered a billboard if used as a Star Realty advertisement. Billboard height is limited to being no higher than the highest wall of the building. Chairman Latch referred the matter to the '~rendle r Committee.
