HASTINGS PLANNING COMMISSION MEETING
MONDAY, MAY 14, 1979
7:30 P.M.
The meeting was called to order at 7:34 P.M. by Chairman Latch.
Members Present:
Commissioners Latch, Gergen, Liska, Bultman,
Hughes, Wendler, Kramer, Groth, and Murphy
Members Absent: None
Moved by Commissioner Wendler, seconded by
Commissioner Hughes to approve the Minutes of the
April 23, 1979 Planning Commission meeting.
9 Ayes - 0 Nayes.
APPROVAL OF MINUT ES
Chairman Latch opened the Public Hearing at 7:36 P. M.
The Planner reported that on file were the Notice of
Public Hearing, the Affidavit of Publication, and the
Certificate of Mailing. Thus, the Public Hearing was
properly called. The Planner went on to explain that
although the County limits the number of children
under Mrs. Krizan's license to five (5), there could
be more if taken at different times of the day. He
suggested that it might be appropriate for the City to
place a limit on the number of children under Mrs. Krizan's
care.

Commissioner Kramer gave the Committee report which
recommended approval of the special use permit.
Commissioner Gergen referred to a similar request for a
special use permit for a pre-school nursery that had been
requested by Mr. & Mrs. Jame~s Tanner on West 17th St. within
the last two years that had been denied. Commissioner Gergen
felt that it would be contradictory to approve this application
after having denied the Tanner's. Commissioner Groth
stated that he felt that they were different applications and
should be viewed as such. After all people present had an
opportunity to be heard on the matter~ Chairm~n Latch closed
the Public Hearing at 7:53 P.M.
Moved by Commissioner Groth, seconded by Commissioner
Hughes to approve the special use permit. 7 Ayes - Gergen
and Liska, Nay.

Chairman Latch opened the Public Hearing at 7:56
P.M. The Planner noted that the Notice of Public
Hearing, Affidavit of Publication, and Certificate of
Mailing were on file. Thus, the Public Hearing was
properly called. The Planner went on to report that,
while not unanimous, the iNatural Resources and
Recreation Commission had recommended that cash
in lieu of land be accepted for the park dedication
requirements. The Planner also explained that while this
request could be justified ,' due to the compatibility this
would have with zoning classifications adjacent to
and across the street from the property, that an action
to approve the rezoning and preliminary plat should not
be mistakenly interpreted to mean that the City would
promote small-scaled, specialized rezonings.

Commissioner Wendler indicated that he felt that this
would just be an extension of the surrounding zoning
classifications (R-l). Chairman Latch asked if any
member of the audience ha~l anything to say regarding
this proposal. Mr. Sheldon Fox, representing the
First Baptist Church, which owns property across the
street from the site, stated that the church was in favor
of the proposed action. After all people present had an
opportunity to be heard on the matter, Chairman Latch
closed the Public Hearing at 8:12 P.M.
Moved by Commissioner Kramer, seconded by
Commissioner Wendler to approve the preliminary
plat and rezoning from R-3 to R-1 of the Bauer View
Plat with the park dedication requirement to be in the
form of cash in lieu of land. The rezoning request is
viewed as being compatible with the surrounding zoning
classifications. 9 Ayes - 0 Nayes.
Commissioner Liska gave the Committee report and
indicated that the Committee would prefer to see the
operation located in the elderly hi-rise adjacent to the
site requested for the home occupation permit. She
stated that she felt that that possibility should be explored
further before acting on the home occupation request.
Mrs. Loeschwas asked which location she preferred.
She responded that she would prefer to be located in
Oak Ridge Manor. The Planner asserted that if the
home occupation permit were approved, that there should
be provision_ for additional off-street parking. Commissioner
Groth stated that the Planning Commission should act on the
request as presented, and not deal with a side issue.

Groth to approve the home occupation request without requiring
additional parking space. 9 Ayes - 0 INayes.

The Planner explained that under his interpretation,
the sign would be considered to be billboard and would
not he allowed to be any higher than the highest outside
wall of the building. He recommended denial.
Commissioner Wendler, the Committee Chairman,
indicated he did not feel the request met the just'rfination
for a variance.

Commissioner Groth stated that he did feel that it was not a
fair interpretation of the ordinance to consider the sign a
billboard, and that it should be considered a sign only.
Commissioner Kramer indicated that he tended to agree.
Moved by Commissioner Wendler, seconded by Commissioner
Bultman to table the request until all members of the
Plarming Commission have had a chance to review the most
recent amendment to the billboard ordinance, and until the
Planning Commission receives a written opinion from the
City Attorney. 9 Ayes - 0 Nayes.
The Planner explained that Mr. Rohr had requested that
the issue be tabled until he could have a grading plan
reviewed for a lot he had under consideration.

Moved by Commissioner Hughes, seconded by
Commissioner Wendler to table this item for
additional information. 9 Ayes - 0 Nayes.
Mrs. Hamilton is applying for a home occupation
permit for a day care center in her home. She
currently has three children of her own under pre-
school age, which would limit the number of children
she could care for under her county license. The
Hamilton's also have a fence around their back yard
and live on a collector street.

Commissioner Bultt~nan to approve the home
occupation permit. 7 Ayes - Liska, Nay,

The Planner presented a statement he had prepared which
had been approved by the Council for submission to a
Public Hearing at the Metropolitan Council Chambe rs
on the subject of whether or not to continue the
designation of the Mississippi River Corridor as a
critical area. No action was taken.
