HASTINGS PLANNING COMA4ISSION MEETING
TUESDAY, MAY 29, 1979
7:30 13. M.
The meeting was called to order at 7:31 P.M. by Chairman Latch.
Members Present:
Commissioners Latch, Gergen, Liska, Bultman,
Wendler, Kramer, and Murphy
Members Absent: Commissioner Hughes
Moved by Commissioner Murphy, seconded by
Commissioner Wendler to approve the Minutes of
the May 14, 1979 Planning Corrtrnission meeting.
7 Ayes - 0 Nayes.
APPROVAL OF MINUTES
The Planner presented the Planning Commission with a
letter from the City Attorney, as requested by the
Planning Commission. The letter basically explained
that while the sign would be interpreted as a billboard
if used ~to advertise the Star Realty business, because
both premises were o%%rned by Star Realty, a document
could be prepared that would effectively bring the sign
to be considered part of the Star Realty premises. This
left the Planning Commission with the issue of deciding
on the variance request for the height of the structure
considering it as a sign and not a billboard. The Planner
reminded the Planning Commission that it was his
recommendation to deny this variance request, as the
hardship did not appear to be shown, and that this could
not be considered a unique situation.

Mr. Greg Jablonske, of Star Realty, stated that he
felt that the request was justified in order to provide
visibility from the south, and that it would cost them
a fair amount of money to lower the sign. He also
commented that before lowering the sign, they would
Consider raising one wall of the building to bring the sign
into compliance.
Moved by Commissioner Gergen to deny the variance
request. Motion failed for lack of second.
Moved by Commissioner Wendler, seconded by
Commissioner Bultman to approve the variance
request conditioned upon the applicants executing
the document referred to in Mr. Fluegel's letter,
and that the applicant provide more detailed measurements
for the sign. 7 Ayes - 0 Nayes.

Mr. Spangler would like a permit to operate his
upholstery business in a home he would like to build
on the corner of Hillside St. and Westview Drive. He
has indicated that no customers would visit his home.
Moved by Commissioner l~ramer, seconded by
Commissioner Wendler to approve the home occupation
permit. ? Ayes - 0 Nayes.

At this point, Chairman Latch appointed the Comprehensive
Plan Committee to review all home occupations in R- 1
zoning distr ~cts.
Mr. Slattum is currently conducting an upholstery
business in his home. He has indicated that he expects
two (?~) cars per week to be parked at his home as a
result of the home occupation.

Moved by Commissioner Gergen, seconded by
Commissioner Kramer to approve the home occupation
permit. 7 Ayes - 0 Nayes.
The County is proposing to replace two existing fuel
storage tanks with larger tanks at their facility on
Co. Rd. #47. Being that this property is still
technically in the Vermillion River floodplain and
that the tanks, which would be defined as structures,
would be below the flood protection elevation, a
special use permit is required.

Moved by Commissioner Wendler, seconded by
Commissioner Murphy to schedule a Public Hearing
for the special use permit for the June 11, 1979
Planning Commission meeting. 7 Ayes - 0 Nayes.
The site plan for this development had been approved
in 1977. It was discovered that the center driveway
§Nudes substantially deviated from the information
shown on the site plan. The Planner presented the
Staffls recommendation for dealing with the situation.
Mr. Leo Schumacher, the owner of the property,
e xplained that the contractor ran into solid rock while
excavating for the parking lot driveway, and therefore
could not provide a lesser grade. Chairman Latch
referred the matter to the Wendler Committee for
further study.
