HASTINGS PLANNING COMMISSION MEETING
MONDAY, JULY 9, 1979
7:30 P.M.
The meeting was called to order at 7:30 P.M. by Chairman Latch.
Members Present:
Commissioners Latch, Gergen, Liska, Hughes,
Kramer, lereiermuth, and Murphy
Members Absent: Commissioners Bultman and Wendler
Moved by Commissioner Kramer, seconded by
Commissioner Murphy to approve the Minutes of the
June 25, 1979 Planning Commission meeting. 7 Ayes -
0 Nayes.
APPROVAL OF MINUTES
Chairman Latch welcomed Leonard Freiermuth as the
new Planning Commission member. Commissioner
Freiermuth will be fullfilling the remainder of
Commissioner Groth's term. Mr. Freiermuth was
previously sworn in by the City Clerk, Wallace Erickson.

Chairman Latch opened the Public Hearing at 7:31 P.M.
The Planner indicated that on file were the Notice of
Public Hearing, Affidavit of Publication, and the
Certificate of Mailing. Thus, the Public Hearing was
properly called. The Planner went on to explain that
if the Planning Commission felt that the approval of the
special use permit was appropriate, a variance would
also have to be granted for the number of required
parking stalls. The zoning ordinance would require
eight parking stalls, while the site plan would indicate
a maximum of three stalls that could be considered
to meet the zoning ordinance.

Commissioner Liska presented tie Committee report.
The report focused on parking for the proposed use and
building and fire code concerns. The Committee's
recommendation was to approve the special use permit
c onditioned upon the installation of certain improvements
necessary to satisfy and fire code requirements.
Chairman Latch read a letter from Mr. Elmer Pederson
to the City Planner opposing the special use request, siting
that it was his opinion that it would interfere with privacy for
tenants of apartments in their building, and that it would crowd
the alley.
After all people present had an opportunity to be heard on the
matter, Chairman Latch closed the Public Hearing at 7:41 P.M.

Commissioner Kramer to approve the variance for
three parking stalls from the required eight. 7 Ayes -
0 Hayes.

Commissioner Freiermuth to approve the special use
permit subject to the items listed in the Committee
report. 7 Ayes - 0 Hayes.
Chairman Latch opened the Public Hearing at 7:43 P.M.
The Planner indicated that on file were the Notice of
Public Hearing, Affidavit of Publication, and Certificate
of Mailing. Thus, the Public Hearing was properly
called. The Planner went to explain that he had
recently discovered information regarding a State
statute which indicated that day care facilities serving
six or fewer persons (the number to be raised to 10 or
fewer persons in August of 1979) should be considered
permitted uses in single family zoning districts. There-
fore, it would appear difficult to deny an application.

Councilman Trautmann was in the sudience and indicated
that he had received a number of calls from individuals
who had signed the Tanner's petition in favor of their
operation, who had changed their minds, and were now
opposed. Councilman Trautmann also went on to discuss
concerns over traffic in the ~ame area that had been
expressed on other issues.
Commissioner Kramer gave the Committee report,
indicating that the Committee had reviewed the site, did
not feel that there would be an adverse impact on the
neighborhood, and recommended granting the permit.
Councilman Trautmann alsb mentioned that special use
permits are associated with property, and not just the
person applying for the permit. The Planner then indicated
that the Council had recently interpreted that day care center
operations in R-1 zoning districts would also have to have a
home occupation permit in addition to a special use permit for
the purposes of yearly review.
After all people present had an opportunity to be heard on the
matter, Chairman Latch closed the Public Hearing at 7:51 P.M.

Moved by Commissioner Kramer, seconded by
Commissioner Murphy to approve the home occupation
permit. 6 Ayes - Hughes, Nay.
The developers propose to rezone and obtain a planned
residential development unit permit for 20 townhouse
units on property that is currently zoned C-5.
The request before the Planning Commission at this
meeting is only for the rezoning from C-5 to R-3, as
the preliminary plat and site plan have not been devel-
oped to a point to formally request those actions.

Moved by Commissioner Liska, seconded by
Commissioner Hughes to schedule a Public Hearing
for the rezoning request for the July 23, 1979
Planning Commission meeting. ? Ayes - 0 Hayes.
Commissioner Hughes left at 8:13 P.M. to answer a
fire call.
The Planner indicated that the revised site plan had SITE PLAN CHANGE-
been received by the Staff. He stated that the Staff's PRIVATE DRIVEWAY FOR
recommendation was to not approve the site plan received, APARTMENT BUILDING-
that the center driveway should be removed completely,
and that the bituminous drainage flumes indicated be
eliminated, and have landscaping instead. He went
on to say that it was the Staff's recommendation that
an additional site plan be developed incorporating the
Staff's recommendation, but that the Staff could deal
with those revisions administratively, without the need
for further Planning Commission review.

Chairman Latch commented that tlqe ze could be poor
visibility from the remaining driveway to the street
and that the small knoll should be reduced at the
entrance.
Moved by Commissioner Kramer, seconded by
Commissioner Liska to approve the site plan changes
as indicated in the Staff report dated July 9th, 1979.

Moved by Commissioner Kramer, seconded by
Cormmissioner Freiermuth to adjourn at 8:18 P. M.
