HASTINGS PLANNING COMMISSION MEETING
MONDAY, AUGUST 13, 1979
7:30 P. M.
The meeting was called to order at 7:32 P.M. by Chairman Latch.
Members Present:
Commissioners Latch, Liska, W'endler, Kramer,
Freiermuth, and Murphy
Members Absent: Commissioners Gergen, Bultman, and Hughes
Moved by Commissioner Wendler, seconded by
Commissioner Kramer to approve the Minutes of
the July 23, 1979 Planning Commission meeting.
6 Ayes - 0 Nayes.
APPROVAL OF MINUTES
The Planner presented information regarding a similar
home occupation request for an accessory building that
had been approved. He also presented the Planning
Commission with an opinion from the City Attorney
regarding just what would be considered an accessory
building.

There was considerable discussion about the favorable
aspects of the request, and the ramifications of allowing
a home occupation in an accessory building. It was also
brought up that the applicant's wife is in poor health and
susceptible to the paint fumes that might be produce~ by
this home occupation.
Moved by Commissioner Wendler, seconded by Commissioner
Murphy to pass the matter on to the Council for their discretion.
6 Ayes - 0 Nayes.
Moved by Commissioner Wendler, seconded by
Commissioner Murphy to have Mr. Loucks address
home occupations in his update of the zoning ordinance.

ORDINANCE UPDATE
Commissioner Liska gave the Committee report which
reported that, according to information provided by
the Hopkins's , it would be estimated there could be
60 to 72 students per day. It was also indicated that
some contact with property owners in this neighborhood
had revealed some concern about this home occupation.
The Committee's recommendation was to deny the
permit request.

Mr. Hopkins stated that the number of students
anticipated would be I/Z of what the Committee
had anticipated. Mr. Hopkins went on to explain
that there is currently a home occupation for a
swim school in another part of town, which had not
apparently generated any problems. He also indicated
that there were other home occupations that existed
without permits, and that he was willing to cut back
on the volume and any other conditions the Planning
Gommis sion might impoae.

Chairman Latch presented the Planning Commission
with a petition from individuals throughout the
community expressing their desire to have such a
service available in the community. Commissioner
Wendler suggested having the Engineering Department
conduct the traffic count on the street to get an idea of
the volume of traffic on the street.
Moved by Commissioner Murphy, seconded by
Commissioner Freiermuth to set a Public Hearing
on the matter for the next Planning Commission
meeting, refer the matter back to the Committee to
contact the Hopkins's, and to have the Planner
invest[gate the possibility of having a traffic count
conducted. 6 Ayes - 0 Nayes.
Chairman Latch referred the matter back to the
Liska Committee and added Commissioner Freiermuth
to the Committee.
Master, Inc. had previously received a variance to
allow for a 40 foot setback for the loading dock for
their proposed addition. The new request would allow
a 30 foot loading dock. The required length of a loading
dock is 50 feet. The Planner recommended denial of
the request, as the trailer would extend approximately
I0 feet into the right-of-way.

Mr. Murray Laub, of Master, Inc., explained that
Master was concerned with getting the most building
area out a small amount of land, that the loading dock
currently in use involves a trailer extending a great deal
farther into the right-of-way than the proposed loading
dock, that the tractor would be removed from the trailer
when in the loading dock, and that the trailer would not
extend into the traveled portion of the right-of-way.
Moved by Commissioner Kramer, seconded by
Commissioner Liska to approve the variance request
with the conditions th~: the northern most curb of the
HRA parking lot be extended to the same point in the right-

of-way as the curb in front of Master, Inc. existing
building, that Master pay the cost, and that the tractor
be removed from the trailer once it is in the loading
dock. 5 Ayes - Commissioner Murphy abstained as
he is an employee of 1Viaster, Inc.

The Planner explained that concern had been expressed
from various sources about the lack of a swimming
pool ordinance in Hastings. He also explained that the
City Council had directed the Planning Commission to
research the possibility of adopting a swimming pool
ordinance. He suggested that it might be more reasonable
to add a swimming pool ordinance to the Comprehensive Plan
and zoning ordinance update work already in progress.

Commissioner Wendler to direct Mr. Loucks to add
a swimming pool ordinance to his work on the zoning
ordinance update. 6 Ayes - 0 Nayes.

Commiss loner Kramer to adjourn at 8:49 P.M.
