Members present: Conmissioners Latch, Gergen, tIughes, Wendler, Kran~r, and Freiermuth, who arrived at 7:43 P.M. M~nbers absent: Conmissioners Liska, Bultman, and Murphy. Moved by C~amissioner Wendler, seconded by C~rr~issioner APPROVAL OF MINUTES Hughes to approve the minutes of the September 10, 1979 Planning Comaission n~eti~4~. Ayes, 5; Nayes, none. Chairman Latch opened ~he public hearing at 7:32 P.M. PUBLIC HEARINGS SPECIAL The Planner indicated that on file were the notices of the public USE PEP~ITS hearing, affidavit of publication, and certificate of mailing. CO±VSTRUCTION OF 2 Thus, the publi,c hearing was properly called. The Planner then DUPLEXES IN R-2 ZONING noted that h~a~ust received a petition from a nuraber of surround- DISTRICY-~DY STR~ ing neighbors ~ndicating that opposition to the special use BETWEt~ 19th & 21st pei~nit. Streets PAUL MURPItY C~anissioner %Vendler gave the Cor~nittee report which favored approviu4~ the two special use pern~its, and granting lot width variance for the southerly lot. It also suggested allowing comnon utilities to serve both structures. ~e public c~aments are as follows: David Peterson- Mr Peterson stated that he felt that the squeezing of these large buildings into narrow lots would have an adverse effect on the ~eighborhood. He also stated that he felt the headlights from aaditional cars would an annoyance to nearby neighbors. ~. Doffing- i~Lr. Doffing stated that there was a sewer problem on this street, and he felt the addition of t~vo duplexes would add to the problem. Mr. Dewey- Mr. Dewey stated that many of the property owners in the neighborhood had large deep lots such as these, and asked if he would be able to develop additional structures on his lots. The Planner responded that the narrowness of the lots made it difficult to provide access for any development toward the rear of the lots. M~s. Haalland- Mrs.Haa|]and stated that she was afraid that the two duplexes would result in additional traffic on the street and expressed concern over the safety of her dnildren. Commissioner Kramer had to leave ~t 7:59 p.m. Page 2 - Planning Comnission meeting 9/24/79 ~ere was a general discussion revolving around traffic, the capacity of this narrow street, sanitary sewer proble~_~, stol~n water problems, and a concern over the need for improvement of utilities and the resulting assessments. After all people present had an opportunity to be heard on the matter, Chai~n Latch closed the public hearing at 8:50 P.M. Moved by Co~missioner Wendler, seconded by Commissioner Hughes to request the Staff to report on the condition of the utilities, the street, the storm water runoff conditions for the area, and addi- tional information on traffic i~act. Ayes, 5; Nayes, none. Chairman Latch opened the public hearing at 8:58 P.M. PUBLIC i~f~RING RE~LAT The Planner stated that on file were the notice of pablic hearing,PORTION OF DAKOTA HILLS affidavit of p~blication, and certificate of mailing. II, us, the public hearing was properly called· The Planner stated that the proposed replatwould neet all the zoning requirements, that a complete engineering review of the. grading plan was not avail- able at this time, and therefore suggested approving subject to the coranents regarding grading. 5TH ADD. PLEASANT DRIVE & BRITI'A_NY ROAD HASTINGS CONSTRUCTION Mr. Allen Jones, nearby resident, stated that he was concerned about ~ie co~oatibiiity with this grading plan to the lot on the southeast corner of the intersection of 14th Street and Brittany Road. He also stated that he would like to discuss the matter with the City Engineer before making any comments. After all people present had an opportunity to be heard on the matter, Chairman Latch closed the public hearing at 9:03 p.m. Moved by Comnissioner Hughes, seconded by Commissioner Freiermuth to approve the prel~ninary plat with the condition that the Staff c~gnents regarding the grading plan be addressed before final approval, and that the Engineer contact Mr. Jones about the lot at 14th and Brittany. Ayes, 5; Nayes, none. Mr. Redding's requesti~o allow h~n to use his home for H~E OCCUPATION PE~IT an office for his construction business. Mr. Spangler's request is to operate a small upholstery HO~E OCCUPATION PERMIT business in the basement of his h~ne. He had indicated that UPHOLSTERY ~USINESS there would be no cnstemers visiting that home as a result of 606 ~liPLE ST. the occupation, and that no sign would be erected. ConT~issioner AL SP~NGLER Gergen indicated that it seemed s~newhat unusual that there would not be any cust~ner visits. Mr. Spangler stated that there n~ght be an occasional visiter, but that he had to go to the customer's home to show samples and look at the furniture.
