Members Present: Commissioners Latch, Gergen, Liska, Kramer, F re ie rmuth and Murphy Members Absent: Commissioner Bultman, Hughes, and Wendler Moved by Commissioner Kramer, seconded by Commissioner Liska to approve the Minutes;of the October 9, 1979 Planning Commission meeting. 6 Aye s-0 Naye s. APPROVAL OF MINUTES Moved by Commissioner Murphy, seconded by Commissioner Liska to reschedule the next Planning Commission meeting for Tuesday, November 13, 1979 due to the Veteran's Day holiday. 5 Ayes - Latch, Nay. MEETING DATE CHAN GE Bahls Motors proposes to remove a number of existing buildings and make an addition to one other building on the southwest corner of the property. This building would house a tire service and sa[e facility. The Planner reviewed the characteristics of the proposal. Moved by Commissioner Murphy, seconded by Commissioner Liska to schedule a Public Hearing for the November 13, 1979 Planning Commission meeting. 6 Ayes - 0 Nayes. SPECIAL USE PERMIT- TIRE SERVICE OPERA- TION IN A C-3 ZONING DISTRICT - EAST SIDE OF VERMILLION ST. & NORTH OF E. llTH ST.- BAHLS MOTORS Chairman Latch referred the matter to the Kramer Committee. Mr. Murphy's previous request for two duplexes for adjoining lots on Eddy Street had been denied by the Council. Mr. Murphy was now requesting a special use permit for one tot, and proposing to build a single- family dwelling on another. Mr. Murphy also expressed a desire to construct a tri-plex on the two lots in combination rather than the duplex and one single-family dwelling. Members of the Planning Commission expressed apprehension at this proposal. SPECIAL USE PERMIT- DUPLEX - WEST SIDE OF EDDY ST. BETWEEN 19TH AND 21ST STREETS- PAUL MURPHY Moved by Commissioner Kramer, seconded by Commissioner Freiermuth to schedule a Public Hearing for the November 13, 1979 Planning Planning Commission Minutes -Z- October ZZ, 1979 (Continued) Commission meeting for the special use permit for a duplex on Lot 12, Auditor's Subdivision ~10. 6 Ayes - 0 Nayes. Chairman Latch referred the matter to the Wendler Committee. Special Use Permit (Duplex - Paul IV~urphy ) Continued The Planner explained that the City had just received correspondence from the Corps of Engineers which defined a flood-way/flood fringe line for the Vermillion River flood plain in the area of the flood control project. The letter and accompanying map identified the line and stated that in order for the line to be accurate, a surface drainageway would have to be maintained open. Moved by Commissioner Murphy, seconded by Commissioner Liska to approve the flood-way as presented by the Corps of Engineers with the condition noted in their letter. 6 Ayes - 0 iNayes. The Planner explained that one Metropolitan Council Staff comment v~nich l~dnot been addressed at the last meeting was a statement that suggested adding a definition for the term "development" to include grading, filling, and clearing. The Planner indicated that in his opinion, the only effect this would have would be to require consultation with the City before any clear cutting of trees. Moved by Commissioner Murphy, seconded by Commissioner Gergen to include a definition of the term "development" in the amendments to the Critical Areas Ordinance. 6 Ayes - 0 Nayes. Moved by Commissioner Liska, seconded by Commissioner Freiermuth to adjourn at 8:07 P. M. 6 Ayes - 0 Nayes.
