HASTINGS PLANNING COMMISSION MEETING
MONDAY, DECEMBER 10, 1979
7:30 P. M.
The meeting was called to order at 7:30 P.M. by Chairman Latch.
Members Present:
Commissioners Latch, Gergen, Bultman, Hughes,
Kramer, Freiermuth, Murphy and Wendler who
arrived at 7:32 P.M.
Members Absent: None
Moved by Commissioner Murphy, seconded by
Commissioner Kramer to approve the Minutes of
the November Z6, 1979 Planning Commission meeting.
7 Ayes - 0 Nayes.
APPROVAL OF MINUTES
Chairman Latch read a letter from Eleanor Liska
indicating that she was resigning from the Commission
effective December 4, 1979.
RESIGNATION OF
ELEANOR LISKA
Commissioner Hughes, a member of the committee
assigned to research the Daniels's request indicated
that he had reviewed the site, and recommended that
approval of this request would be compatible with
past similar actions.
Moved by Commissioner Hughes, seconded by
Commissioner Murphy to approve Mrs. Daniels
request for a home occupation permit. 8 Ayes -

Commissioner Kramer gave the committee report,
indicating that this request was also similar to others
which have been approved, and recommended approval
without requiring a fence for the property.
Moved by Commissioner Kramer, seconded by
Commissioner Murphy to approve the home occupation
permit request from Mrs. Erdman. 8 Ayes - 0 Nayes.

MARGARET ERDMAN
Mr. Chapman is requesting a home occupation permit
to operate a photography studio on an appointment basis.
This request meets the zoning requirements. Chairman
Latch suggested referring the matter to a committee
to evaluate off-street parking and other impacts.

Commissioner Kramer indicated that he did not feel
that a committee was necessary, and that the request
could be approved. The Planning Commission then
discussed whether or not to ask that no sign be included.
Moved by Commissioner Bultman, seconded by
Commissioner Kramer to approve the home occupation
permit without any limitations on an advert[sing sign
other than imposed by the zoning ordinance. 8 Ayes -
0 Naye s.
The preliminary plat to this final plat was entitled
"Whispering Oaks 3rd Addition Phase II". The
Planner explained that his report recommended
approval of the final plat with three conditions. He
went on to state that the first condition noted in the
Staff report had to do with the smaller lot sizes sho~vn
on the final plat compared to the lot sizes indicated on
the preliminary plat. He explained that after writing
the memo, he had looked more closely at the restrictive
covenants for the development and consulted with the
City Attorney, and come to the conclusion that the City
would not need to include that condition on the approval.
Commissioner V~ndler asked about the drainage situation
in the development. The Planner gave a summary of the
status of various drainage issues associated with the
townhouse development. He indicated that approval of
this final plat did not constitute City acknowledgement
of completion of the development.
Moved by Commissione r Murphy, seconded by
Commissioner Wendler to approve the final plat
with the following conditions:
That the total plat area and lot areas shall be
provided on the City's copy of the final plat.
The payment of the interceptor sewer fees shall
ba made prior to the filing of the plat. 8 Ayes -
0 Nayes.
The Planner explained that after again contacting the
City Att orne y and individuals involved in the issuance
of performance bonds, it was still not clear as to
whether a performance bond would be practical in the
case of the Bohlken's.parking area.
Moved by Commissioner Wendler, seconded by
Commissioner Bultman to grant an additional time

extension to August 31, 1980 for the deadline for the
paving of the Bohlken Draper[es parking lot, and that
the Bohlken's acknowledge that time extension by
written statement. 8 Ayes - 0 Nayes.
Moved by Commissioner Wendler, seconded by
Commissioner Kramer to schedule the next
Planning Commission meeting for December Z6,
1979, the City Planner to contact all Planning
Commission members during the week prior to
the meeting to make a final decision as to whether
to hold the meeting. 8 Ayes - 0 Nayes.
Moved by Commissioner Kramer, seconded by
Commissioner Freiermuth to adjourn at 8:11
P.M. 8 Ayes - 0 Nayes.
