Members Present: Commissioners Wendler, Von Feldt, Reuter, Bultman, Simacek, Kunkel, Freiermuth and Murphy Members Absent: None Moved by Commissioner Murphy, seconded by Commissioner Simacek to approve the Minutes of the Monday, April 28, 1980 Planning Commission meeting with the amendment indicating the committee the Freiermuth two-family dwelling special use permit request was referred to, if it is found that it was, in fact,referred to a committee. 8 Ayes - 0 Nayes. APPROVAL OF MINUTES Chairman Wendler opened the Public Hearing at 7:32 P.M. The Planner reported that on file were copies of the Notice of Public Hearing, Affidavit of Publication and Certificate of Mailing. Thus, the Public Hearing was properly called. The public comments were as~follows: PUBLIC HEARING- REZONE ONE LOT FROM R-2 TOI-2 - 526 EAST 2ND ST. - RON HARRIS Clarence Chapman Joan Warner Another Resident Mr. Chapman expressed concern over the possibility of Judge Electric purchasing Mr. Harris's property and letting it become run down. Mrs. Warner indicated that some years ago, the property owner had the opportunity to have his property rezoned to industrial. She also stated that a good deal of effort had gone into insuring that this area remain residential in nature, and indicated that especially without knowing what specific use the property would be put to, that she felt very strongly it should remain as residential. The lady indicated that she felt the existing warehouse directly adjacent to Mr. Harris's property was an eyesore, and expressed concern that Mr. Harris's property could become one as well. She also indicated that the residents of the area had worked for a long time to see that the area be designated as single-family residential, and that she was Planning Cornn~ission Minutes -2- 1Viay 12, 1980 (Continued) Rezone - Ron Harris (Continued) strongly against any industrial rezoning. Mr. Chapman Mr. Chapman also indicated that he felt that some industrial property in the area was already becoming run doyen. Commissioner Bultman indicated that she had been part of the committee reviewing the request. She indicated that originally it seemed appropriate to rezone the lot to be consistent with all the other property in the same block, but after finding out the attitude of the neighbors, she indicated that she would be opposed to the request. Commissioner Murphy, the Chairman of the committee which reviewed the request, indicated that originally the committee had been in favor of the request, but that after further thought, was concerned that if not combined with other lots, the property could not be put to a reasonable industrial use. Chairman Wendler closed the Public Hearing at 7:43 P.M. Moved by Commissioner Bultman, seconded by Commissioner Reuter to recommend denial of the rezoning request on the grounds that the request was inconsistent with the current and proposed comprehensive plans, that the small size of the property might leave the property with little usefulness if not combined with adjacent lots, and that without a specific proposed industrial use, the property should remain zoned for the existing use which is being made of the property. 8 Ayes- 0 Nayes. Chairman Wendler opened the Public Hearing at 7:44 P.M. The Planner indicated that on file were cop~es of the Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. Thus, the Public Hearing was properly called. The public cornrnents were as follows: PUBLIC HEARING- SPECIAL USE PERMIT- TWO-FAMILY DWELLING IN AN R-Z ZONING DISTRICT - 700 BLOCK OF WEST 5TH ST. - NICK FREIERMUTH Ann Pete rson Mrs. Peterson indicated that she felt that the duplex and tri-plex constructed next to one another would be too much of a burden on the area. Planning Commiss [on Minutes (Continued) May 12, 1980 Special Use Permit - Nick Freie rmuth (Continue d) She said she felt that because there were no curbs, no sidewalks, and the street was narrow along that block, that the area could not accomodate those dwellings. Nick F re ie rmuth Mr. Freiermuth indicated that there would be off-street parking provided for at least three cars for the proposed duplex. He also stated that the three plex would have to park it's cars off the street. He went on to say that the house would be the nicest building on the block, and would add to the area rather than detract. Mike Kelley Mr. Kelley indicated he was the owner of an existing duplex that Mr. Preiermuth's son lived in. He said he had not experienced any parking problems at his duplex, and that he felt that the proposal would not have an adverse affect on the area. After all people present had an opportunity to be heard on the matter, Chairman Wendler closed the Public Hearing at 7:51 P.M. Chairman Wendler indicated that he felt the parking problem was not Mr. Pre [ermuth's problem. He also stated that he did not feel the Planning Commission had grounds to deny this special use permit request, but suggested that the Staff look into the matter of off- street parking for the tri-plex. Commissioners Reuter and Simacek indicated that they felt that the proposal would be against the character of the area. Moved by Cornmissione r Von Feldt, seconded by Commissioner Kunkel to approve the special use permit request. 4 Ayes - Reuter, Bultman, Simacek- Nay, Freiermuth abstained. Planner to contact the owner of the three family dwelling regarding the off-street parking and subdivision of the property regardless of the action on the special use request. Planning Commission Minutes ( C ontinue d) -4- Commissioner Bultman gave the committee report which indicated the committee did not feel the proposed addition to the house would change the character of the house or neighborhood. Moved by Commissioner Bultman, seconded by Commis s [one r Simacek to recommend approval of the home occupation permit request. 8 Ayes - 0 Naye s. The Planner explained that this should be considered identical to a gift or craft shop for purposes of being a permitted use in the R-Z zoning district. He pointed out that although the use might be considered permitted by strict definition, the scope of this proposal might be more than what the Planning Commission might feel was the scope of the intent of the ordinance. The Planner then went on to review specific aspects of the proposed site plan. Moved by Commissioner Bultman, seconded by Commissioner Simacek to table the matter until the next Planning Commission meeting. 8 Ayes - 0 Naye s. Chairman Wendler referred the matter to the F re ie rrnuth Committee. Chairman Wendler gave the committee report which expressed concern over the impact on the adjacent park property, but recommend approval of the proposal conditioned upon four items indicated in the committee report primarily referring to buffering from adjacent properties, and the upgrading of glst Street. Councilman Stoffel was in the audience and asked Chairman Wendler why the proposal was to block off Zlst St. when it might be used as an emergency access, if his rationale had anything to do with the concern that MnDot might do the work without City approval, and expressed skepticism that the State would actually improve 21st St. Chairman VZendler indicated that he felt that it was possible that the State would go ahead without City approval, and that the proposal to block off the street after it was approved, would be to avoid the street being used as thoroughfare. Planning Commis s [on Minute s - 5- (Continued) Moved by Commissioner Von Feldt, seconded by Corn/llissioner ]~ultman to recommend that IM_nDot be allowed to use the property as proposed with the c onditions indicated in the conlrnittee report, with the Staff to recommend to the Council the method by which this use might be permitted. 6 Ayes - Simacek, Freiermuth- Nay. The Planner gave an update on the status of the Flood Plain Ordinance and map amendments. Moved by Commissioner Simacek, seconded by Commi ssioner Bultman to change the meeting date for the second Planning Commission meeting in May to May 27th, 1980 to take into account the Memorial Day holiday. 8 Ayes - 0 Nayes.
