Members Present: Commissioners Wendler, Stevens, Von Feldt, Reuter, Bultman, Simacek, Kunkel, Freiermuth, and Murphy Members Absent: None Moved by Commissioner Murphy, seconded by Commissioner Re uter to approve the Minutes of the August 11, 1980 Planning Commission meeting. 9 Ayes - 0 Nayes. APPROVAL OF MINUTES The Planner explained that Mr. Menard proposes to use the site, a former gas station, for small scale welding repair, retail sales of wrought iron furniture, and possibly repair marine propellers. The Planner went on to explain that the request was being made for a special use permit in order to altow Mr. Menard to work on the occasional larger pieces of equipment that might come in, and an interpretation of the ordinance which would classify the small scale welding repair similar to other repair uses allowed in the C-3 zoning district. SPECIAL USE PERMIT AND ZONING ORDINANCE INTERPRETATION - HASTINGS WELDING - i630 VERMILLION ST.- ANDRE MENARD Commissioner Murphy suggested referring the matter to a committee while waiting for the public hearing. Commissioner Stevens expressed concern about the building being brought up to the fire code standards. The Planner explained that those matters would be dealt with when Mr. Menard applied for a building permit to remodel the building, if the special use permit were granted. Moved by Commissioner Murphy, seconded by Commissioner Reuter to schedule a Public Hearing for the special use permit request for the September 8, 1980 Planning Commission meeting. 9 Ayes - 0 Nayes. Chairman Wendler referred the matter to the irreiermuth Committee. The Council had recently approved a minor subdivision VARIANCE REQUEST for the Moore's. The Moore's are requesting authoriza- TO ALLOW BUILDING tion to cross unimproved street rights-of-way with a PERMIT AND PRIVATE private access for their new building site. Moved by Commissioner Simacek, seconded by Commissioner Murphy to approve the variance request based upon the condition that this is at the end of existing platted blocks, that the Council had approved the minor subdivision based upon certain conditions, and that those conditions also apply to the variance approval. 9 Ayes - 0 Nayes. The Planner presented the Planning Corrdmiss[on with a petit[on signed by two o[ the three owners along the alley, which is platted through only one-half of the block. The Planning CommissLon discussed whether or not to hold a Public Hearing on the matter. Several Commission members indicated that they had viewed the propert y, and did not see any public use of the property. Moved by Commissioner Murphy, seconded by Commissimer Simacek to recommend the Council approve the alley vacation with the condition that easements be created for any necessary public and private utilities. 9 Ayes - 0 Nayes. The Planner explained that the property met the physical requirements of the zoning ordinance, and that the request was to convert a walk out basement into an apartment. Commissioner Murphy suggested scheduling a Public Hearing and referring the matter to a committee. Commissioner Murphy explained that he felt since there was often such concern in the neighborhoods about two family dwellings, that each request should be thoroughly researched.
