HomeMy WebLinkAbout09/08/80 MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, SEPTEMBER 8, 1980 7:30 P. M. The meeting was called to order at 7:30 P.M. by Chairman Wendler. Members Present: Commissioners Wendler, Stevens, Von Feldt, Reuter, Bultman, S[macek, Kunkel, Freiermuth, and Murphy Members Absent: None Moved by Commissioner Murphy, seconded by Commissioner Kunkel to approve the Minutes of the August 25, 1980 meeting. 9 Ayes - 0 Nayes. APPROVAL OF MINUTES Chairman Wendler opened the Public Hearing at 7:31 P.M. The Planner stated that on file were a Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner went on to explain aspects of the site plan and summarize the proposed use. He also explained that the zoning ordinance would require a screen on the rear of the property, being that it is adjacent to a residential zoning district. He stated that there existed a chain link fence, but that it was open. He also explained that Mr. Menard preferred to leave the fence open so as to be able to keep an eye on children in the playground. PUBLIC HEARING - SPECIAL USE PERMIT REQUEST - RETAIL SALES AND WELDING REPAIR- C-3 ZONING DISTRICT- 1630 VERMILLION ST.- ANDRE MENARD Commissioner Freiermuth stated that he felt the closed fence would not serve any useful purpose. Giving his Committee report, he also indicated that he felt any improvement to this property would be a distinct benefit to the area, and that he felt both the interpretation and the special use permit be approved. He then asked if there would be any outside welding. Mr. Menard responded that there not be. After all people present had an opportunity to be heard on the matter, Chairman Wendler closed the Public Hearing at 7:37 P.M. Planning Comm[ss [on Minute s (Continued) -2- September 8, 1980 Moved by Commissioner Freierrnuth, seconded by Commissioner Murphy to recommend approval of the special use permit for auto repaix, and also to consider Mr. Menard's proposed small scale welding repair to fit in the definition of repair uses in a C-3 zoning district. 9 Ayes - 0 Nayes. Special Use (Andre Menard) Continued Chairman Wendler opened the Public Hearing at 7:38 P.M. The Planner stated that on file was a Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. Therefore, the Public Hearing was properly called. Commissioner Freiermuth questioned whether there was an intention to develop the large lot area behind the building. Mr. Olson's son was in the audience and indicated that there was no such intent. Commissioner Bultman indicated that it appeared to be an appropriate conversion. PUBLIC HEARING - SPECIAL USE PERMIT REQUEST - TWO-FAMILY DWELLING -,R-2 ZONING DISTRICT - 7g0 W. llTH STo - DONALD OLSON After all persons present had an opportunity to be heard on the matter, Chairman Wend[er closed the Public Hearing at 7:43 P.M. Moved by Commissioner Murphy, seconded by Commissioner Freiermuth to recommend approval of the special use permit for conversion of a single- family home to a two-family dwelling. 9 Ayes - 0 Nayes. The church was requesting a sign with an area of 26 square VARIANCE - SIGN SIZE feet. The sign ordinance only allows a maximum of 12 square feet. The Planner explained that the church had contacted him and indicated they had down sized their request to slightly over g2 square feet. The Planner warned the Planning Commission that approval of this variance would very possibly result inthe creation of a new standard, since the request would be difficult to describe as being unique or constituting a hardship. REQUIREMENTS - 907 W. 15TH ST. - CALVARY BAPTIST CHURCH Commissioner Simacek said that the sign appeared attractive and appropriate for the location. Commissioner Bu[tman agreed. Commissioner Freiermuthalso indicated that since the sign's location is in a very large yard area, the sign did not appear to be out of perspective. Mr. Robert Bilein indicated that the sign displayed the wrong times for services, and that it was falling into disrepair. Commissioner Wendler stated that he was very concerned about the action com- promising the integrity of the sign ordinance restrictions. He stated that these standards had been adhered to in other cases, and felt that approval of this request might go against the principtes of the sign ordinance. Commissioner Kunkel indicated that he felt other uses such as apartment buildings could request similar variances. Variance - Calvary Baptist Church (Cont.) Moved by Commissioner Simacek, seconded by Commissioner Bultman to approve the variance request based upon the extensive size of the property for which the variance was requested, the pleasing character of this particular sign, and due to the fact that it would be advertising an institutional activity rather than a cornrnerc[al venture within a residential zoning district. 6 Ayes - Reuter, Kunkel, Wendler, Nay. The Planner explained that the site plan had been modified somewhat, that the proposal stitl met the minimum zoning requirements, and had not changed the basic character of the silt plan. Moved by Commissioner Murphy, seconded by Commiss ioner Bultman to approve the site plan modification. 9 Ayes - 0 Nayes. REQUEST FOR CHANGE IN SITE PLAN-ANTIQUE SHOP - 718 VERMILLION ST. - HELEN FURBER JACQUES The Planner explained that the final plat had not been filed REAPPROVE PRELIMI- within the required one year period, therefore approva| of the preliminary plat was necessary. He also added that the depth of lots had been changed from 120 feet to 140 feet. Moved by Commissioner Murphy, seconded by Commissioner Kunkel to reapprove the preliminary plat for Bauer View Addition, accepting cash in lieu of land to meet the park dedication requirements. 9 Ayes - 0 Nayes. NARY PLAT AND APPROVE THE FINAL PLAT FOR BAUER VIEWADDITION- SOUTH SIDE OF W. Z3RD ST. Moved by Commissioner Murphy, seconded by Commissioner Reuter to approve the final plat of Bauer View Addition conditioned upon the payment of the park dedication fee, the interceptor sewer fees, and that the City's copy of the final plat contained the total plat acreage, and the individual lot square footage. 9 Ayes - 0 Nayes.
