ADJOURNMENT Next Regular City Council Meeting: Monday June 20, 2022 7:00 p.m. Proclamation Proclaiming June 2022 as LGBTQ+ Pride Month In the City of Hastings, Minnesota WHEREAS, we reaffirm our common beliefs, aspirations, and commitments to ensure that Hastings is a safe and caring community for all persons, and WHEREAS, the City of Hastings is committed to fostering acceptance of all its residents and preventing discrimination, social stigma, and harassment based on sexual orientation or gender identity, and WHEREAS, the City Council has adopted a set of strategic priorities that includes ensuring diversity, equity, and inclusion in City processes and operations and helping to make Hastings a welcoming community for all, and WHEREAS, the City of Hastings recognizes the importance of building protective factors for LGBTQ+ youth in our community, and WHEREAS, the City of Hastings appreciates the work done by IDEA and by THRIVE to advocate for diversity and equity during this month and throughout the year, and WHEREAS, we recognize there is still more work to be done to ensure our LGBTQ+ family members, friends, and neighbors are treated equitably and with dignity, NOW, THEREFORE, Mayor Mary Fasbender and the Hastings City Council do hereby proclaim and recognize the month of June 2022 as LGBTQ+ Pride Month in the City of Hastings. _________________________ Mary D. Fasbender, Mayor Hastings, Minnesota City Council Workshop May 16, 2022 The City Council of the City of Hastings, Minnesota met in a workshop on Monday, May 16, 2022 at 5:30 p.m. in the Community Room at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota. Members Present: Mayor Fasbender, Councilmembers Braucks, Fox, Vaughan Members Absent: Councilmembers Folch, Leifeld, Lund Staff Present: City Administrator Dan Wietecha Assistant City Administrator Kelly Murtaugh Mayor Fasbender called the workshop to order at 5:43 pm. Wietecha gave an overview of the high-performance leadership course that he participated in over three months. The course was online with embedded videos and reading, structured weekly virtual meetings with a small group, and wrapped up the week with a large group recap. There were four main topics: leadership mindset and positive engagement, leading effective change, communication and collaboration, and leading high-performance teams. A highlight to the course was a better understanding of a positive mindset as not only positive, but intentionally confident and optimistic. As a leader, “You bring the weather.” Wietecha reported that he gained much from the course: • Intentionally developing a positive mindset, positive relationships and communication in the workplace. • Leadership oath—who I am as a leader and what I aspire to be. • Importance of communication and listening • Reasonable minds can disagree. Council discussion on the role of the City Administrator leading two teams—Staff and Council. Discussion on positivity and how it plays out in the City in an environment where all bring their emotions and reactions. Discussion on tactics to implement some of the leadership principles. Discussion on the value of the course for Department Heads going forward, if there is a need to have an operational level supervisor engaged in something like this, and financial support for professional leadership training. Communication is a key take-away for Council. Invitation to dialog and ongoing conversation about roles and working together effectively. Listening to Council and understanding their needs and expectations. Presenting information “7 times in 7 ways” as a habit to ensure that Council has a broad understanding, without being overly burdensome. Continuing to utilize the committee structure in the addressing topics, furthering the trust of Council to their committee colleagues. May possibly schedule a regular time for each of the committees. Wietecha would like to review the Rules of Decorum annually with Council. Council members recommend reviewing at the beginning of the calendar year. Councilmembers provided supportive feedback to City Administrator Wietecha as a result of his investment into the course and application to the work of the City. Appeal of Administrative Decision: Hudella (15213 Ravenna Tr.) Hinzman presented the request of Shane Hudella owner of 15213 Ravenna Trail to appeal the decision that a cable rail fence constructed around a swimming pool is in violation of Hastings City Code Section 155.05, Subd. F.4. Performance Pools and Spas (PPS) applied for a building permit to construct an in-ground pool at fence on behalf of Mr. Hudella on February 17, 2021. The permit identified the placement of the pool and fence, but did not indicate that the fence would be cable railed. The fence was inspected after construction and it determined it did not meet City Code because it was climbable. Councilmember Vaughan commented on the difficulty of receiving information on Thursday to them making this kind of determination on Monday. Folch asked how applications are reviewed and if a step was missed in this process. Hinzman responded that had there been more clarity to the review of the application and the specific construction of fencing, this may have been avoided. Folch asked if the specifics of the fence materials were submitted. Folch asked what kind of information is exchanged between Staff and the applicant upon submitting an application. Hinzman expanded on the process of accepting applications, next steps, and additional permits that may be needed. Councilmember Leifeld questioned how far the cables are in the current constructed fence and expressed concern about voting on this since they are not building experts. Councilmember Braucks explained the research she had done in surrounding cities and the similarities between the surrounding cities and the City of Hastings City Ordinance. City Attorney Land indicated that it may be appropriate to reach out to the Department of Labor and Industry for an interpretation if Council is uncomfortable voting on this matter. Braucks agreed with Land on reaching out for a better interpretation. Braucks expressed support for staff who are the experts in the field to make and appropriate recommendation. Fox commented on the unique position of Council in this situation. Fox echoed support for staff within their decisions. Vaughan commented on how to improve how our Ordinance is written to provide better clarity. Vaughan voiced his support in tabling this item. Lund indicated that we also need to take into consideration of our residents as well. Leifeld raised concern to interpretation of what is climbable versus not climbable and voiced support in reaching out for a better interpretation. Folch agreed with Councilmember Leifeld and expressed concern if something was missed in the process of the application and review and inconsistencies in the past. Mayor Fasbender commented on the missing pieces of the application and how more information was needed initially from the change in plans. Mr. Hudella addressed Councilmembers with his change in plans and interactions with the Building Official about the fence. The fence passed daycare inspection and insurance inspection. Hudella asked that Council take a vote this evening so he can get the matter behind him. Wietecha posed questions about his interactions with the Building Official when the change in builder was made. Hudella responded with the conversations over email and stated that the fence cable is aluminum. Councilmember Fox motioned to table the discussion, seconded by Councilmember Braucks. Ayes 7; Nays 0. Announcements • This week is National EMS Week, National Police Week, and National Public Works Week. Please join us in a great and heartfelt thank you to our employees in these departments for their service to our community. • Tomorrow, May 17, we have a Public Safety Night downtown in honor of our Police, EMS, and Fire teams. All are invited to this free event. • The Minnesota Department of Transportation, in collaboration with the City, is beginning a study of Highway 61to evaluate transportation improvements. An informational public meeting is on Wednesday, May 18 from 5 to 7 pm at City Hall. Presentations are at 5:15 and 6:15. • City Offices will be closed Monday, May 30in observance of Memorial Day. • The Hastings Police Department (HPD) in collaboration with the Minnesota Commerce Fraud Bureau announces the launch of a catalytic converter marking program in the community. Marking kits are in partnership with local dealerships–Valley Chevrolet, Hastings Chrysler, and Valley Buick/GMC. Member activities Activity details/results Tree inventory in parks and other public lands Correctly identify and measure the size of the trees and rate their health. Plot tree digitally in ArcGIS Survey123 using a desk top computer and by a tablet. With this data we can get clear picture of the diversity and health of the urban forest in our parks. We can improve our tree planting projects to increase the diversity in our parks by getting the tree inventory completed. Member will learn tree identification skills and how to properly measure a tree and will learn how to assess tree health in addition to learning how to navigate our cities GIS system. Treating ash trees against Emerald Ash Borer Asist City Forester on treating ash trees in our parks and other public lands. Learn the process of injecting ash trees preventatively to treat them against emerald ash borer. We will improve the efficiency of the process of treating trees for the season. The member will gain experience in the proper way to chemically treatment invasive pest and to learn about integrated pest management. Invasive species control. Removal of European buckthorn, bush honeysuckle and amur maple and to chemically treat the stumps. We will see direct improvement in the sites by reducing the invasive species and increasing diversity. We have a parcel of land that still has about 8 acres to be cut treated and hauled that I need help removing. Member will learn the destructive nature of invasive plants and how to properly treat them. Including safe chainsaw and brush saw operation and care. Proper chemical handling to treat invasive species by learning how to read labels, proper mixing and application procedures. Member will also lean the proper PPE for using power equipment and to perform chemical treatments. Assess forest cover percentages and cover type Member will access current and past digital aerial photography from the Dakota county GIS system to assess the percentage of forest cover. Member will learn how to use the measuring tools in the Dakota County GIS to assess forest cover and type. We want to get an idea of the forest cover to be able to know if our forest cover percentages are increasing or decreasing and what the diversity of that cover is. Design a grave lbed nursery We have a need for a gravel bed nursery to help facilitate our tree planting project to replace the ash trees that we removed due to emerald ash borer. We need to find a suitable site, and design a nursery that will work for the long term. The member will do a few site visits of successful gravel bed nursery’s including Hennepin county and the City of Plymouth. The member will learn valuable skills in networking and project planning and implementation. Community need/involvement 1. Describe how the proposed project will serve under-represented, economically disadvantaged, or rural populations. The MN GreenCorps program prioritizes host site projects that support communities with higher concentrations of low-income residents and people of color, including tribal communities. The MPCA’s criteria and interactive mapping tool are on the MPCA’s website. We are a rural city on the edge of the twin cities metro area with a low cocentration of residence that are low-income or people of color according to the MPCA's website. we surve the surrounding rural communites in our zip code by giving them free tree assessment and advice. They can also be a part of the many events in the City of Hastings that we try to have a forestry presence. We plan to have our green corps member engage the community at the many events the City of Hastings parks department is a part of and has informational tables set up. This includes Our yearly Arbor Day tree planting event, River Town Days weekend, Paws in the Park at our dog park, and Party in the Parks which is our kickoff event to national park month. We will be mobilizing volunteers to help with our Arbor day event and recruiting people to help stack brush piles after removing invasive tree. We have many reliable groups in the City of Hastings that can help with finding volunteers like the Hastings high school athletic department. Our Facebook page is also a great place to ask residence to help with a project and we can usually get 20+ people to help us. 3. Compensation would be at a rate of $85.00 per hour Advisory Commission Discussion: N\A Council Committee Discussion: N\A Attachments: • Joint Powers Agreement VIII-06 1 JOINT POWERS AGREEMENT BETWEEN THE CITY OF HASTINGS AND THE CITY OF COTTAGE GROVE FOR INSPECTION COVERAGE ON PUBLIC BUILDINGS AND STATE LICENSED FACILITIES THIS AGREEMENT (“Agreement”) is made and entered into this day of June, 2022 (“Effective Date”) by and between the City of Cottage Grove, 12800 Ravine Parkway South, Cottage Grove, MN 55016 (“Cottage Grove”) and the City of Hastings, 101 4th Street East, Hastings, MN 55033 (“Hastings”), or collectively “City.” WHEREAS, pursuant to the provisions of Minn. Stat. § 471.59, cities are authorized to enter into an agreement to exercise jointly or cooperatively governmental powers common to each and to permit one governmental entity to perform services or functions for or with another governmental unit; and WHEREAS, the Minnesota Department of Labor and Industry (“DLI”) has entered into a delegation agreement with each City that each City’s Building Official is authorized to conduct inspections involving public buildings and state-licensed facilities; and WHEREAS, each City desires to offer reciprocal services from the other when each City’s Building Official is unavailable. NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is agreed, by and between the parties as follows: 1. PURPOSE. The purpose of this Agreement is to provide reciprocal coordinated inspection coverage for public buildings and state-licensed facilities, on an as needed basis, as more fully described herein. 2. TERM. This Agreement will become effective on the Effective Date. This Agreement may be terminated with or without cause by either City upon thirty (30) days’ written notice to the City. Each City agrees to indemnify, defend and hold harmless the other, its officers, agents and employees against any and all liability, loss, costs, damages, claims or actions its officers, agents or employees may hereafter sustain, incur, or be required to pay, arising out of or by reason of any act or omission of the indemnifying party, its officers, agents, or employees, in the execution, performance or failure to adequately perform its obligations pursuant to this Agreement. B. To the full extent permitted by law, actions by the parties pursuant to this Agreement are intended to be and shall be construed as a “cooperative activity” and it is the intent of the parties that they shall be deemed a “single governmental unit” for the purposes of liability, all as set forth in Minnesota Statutes, Section 471.59, subd. 1 a, provided further that for purposes of the statute, each party to this Agreement expressly declines responsibility for the acts or omissions of the other party. Each party also specifically intends that the single tort cap limits specified for cooperative agreements under Minn. Stat.§ 471.59, subd. l a, or as such statute may be amended or modified from time to time, shall apply to this Agreement and to the activities of the parties hereunder. The statutory limits for the parties may not be added together or stacked to increase the maximum amount of liability for either party. C. Each party to this Agreement shall be liable for the acts of their own officers, employees, and/or agents and the results thereof to the extent authorized by law and shall not be responsible for the acts of the other party, its officers, employees, and/or agents. It is understood and agreed the provisions of the Municipal Tort Claims Act, Minn. Stat. Ch. 466, and other applicable laws govern liability arising from the parties’ acts or omissions. Each party warrants they can comply with the indemnity requirements through an insurance or self-insurance program and each has minimum coverage consistent with the liability limits contained in Minn. Stat. Ch. 466. 8. NON-ASSIGNABILITY. Neither City shall assign any interest in this Agreement and shall not transfer any interest in the same, whether by subcontract, assignment or novation, without the prior written consent of the other City. 9. DATA PRACTICES. The parties will comply with all applicable data practices laws, including but not limited to the Minnesota Government Data Practices Act (MGDPA), Minn. Stat. Ch. 13 and the Minnesota Rules implementing the MGDPA, as amended, as well as any applicable state or federal laws on data privacy and security. The parties are mindful that when exchanging private data only the minimum necessary will be provided. VIII-06 4 All data created, collected, received, stored, used, maintained, or disseminated by the parties in the performance of their roles and responsibilities are subject to the requirements of the MGDPA, the Minnesota Rules implementing the MGDPA, as amended, as well as any applicable state or federal laws on data privacy and security. The terms of this Section shall survive the termination or expiration of the Agreement. 10. COMPLIANCE WITH APPLICABLE LAW. Each City agrees to comply with all federal, state and local laws or ordinances, and all applicable rules, regulations, and standards established by any agency of such governmental units, which are now or hereafter promulgated insofar as they relate to its performance of the provisions of this Agreement. 11. AMENDMENTS. Other than as authorized in Section 5, any alteration, variation, modification, or waiver of the provisions of this Agreement shall be valid only after it has been reduced to writing and duly signed by both parties. 12. INTERPRETATION OF AGREEMENT; VENUE. This Agreement shall be interpreted and construed according to the laws of the State of Minnesota. All litigation regarding this Agreement shall be venued in district court in Washington County, Minnesota. 13. ENTIRE AGREEMENT. This Agreement shall constitute the entire agreement between the parties and shall supersede all prior oral or written negotiations. RECITALS WHEREAS, Owner is the fee owner of real property legally described as follows: Lot 1, Block 1, Vermillion Acres Addition Abstract Property (the “Property”); and WHEREAS, there are existing sanitary sewer and water utility service lines (“Original Service Lines”) at the site of the future construction of a multi-unit senior living facility (“Development Project”); and WHEREAS, the Owner does not intend to utilize the Original Service Lines on the Property and instead, will make new connections at a different location and different size to accommodate the Development Project; and WHEREAS, as a result of the foregoing, the Original Service Lines will be abandoned and will not be used for the Development Project or any other purpose on the Property; and WHEREAS, City is willing to waive the requirement that Owner remove the Original Service Lines completely on the conditions that Owner, its successors and assigns agree: (1) if reasonably deemed necessary by City, to remove the Original Service Lines at its cost; (2) to repair and remedy any unwanted conditions caused by the Original Service Lines remaining in place at its cost and to indemnify and hold harmless City for any resulting damage or claims; (3) that if Owner fails to perform removal or repair work in a timely manner, City may complete the needed work; and (4) that City may assess the cost of any such work against the Property as provided in this Agreement; and VIII-07 WHEREAS, Owner understands that the conditions and potential problems which may result from the Original Service Lines remaining in place are not certain and cannot be fully identified or described with certainty but Owner desires to assume all future responsibility and costs of correcting such conditions and damage. NOW THEREFORE, in consideration of the City’s willingness to waive the current requirement that Owner remove the Original Service Lines completely, the parties make the following agreement: A. City waives the current requirement that Owner remove the Original Service Lines, subject to the conditions and requirements set forth herein and subject to compliance with the Plans attached as Exhibit A. B. In the event there is leakage from the Original Service Lines or disturbance to the ground above the Original Service Lines that the City reasonably determines has been caused by a breakage or other issue with the Original Service Lines (a “Removal Event”), then, upon written demand by City, Owner at its cost shall disconnect and remove the Original Service Lines completely and reasonably restore any disturbed areas to their original conditions. If Owner fails to perform the removal or repair work as required herein within a reasonable time period after the occurrence of a Removal Event and the City’s delivery of written notice as required hereunder, City may undertake all work necessary to disconnect and remove the Original Service Lines, and Owner shall immediately reimburse City for all costs actually incurred by the City in connection with removal of the Original Service Lines (the “Removal Expense”). C. If Owner fails to timely reimburse City for all of the Removal Expense, Owner, for itself, its successors and assigns, agrees that the City may assess the costs against the Property in the amount of the Removal Expense plus a $25.00 fee (if the Removal Expense is $10,000.00 or less) or a $50.00 fee (if the removal expense is greater than $10,000.00). D. The Owner agrees that the assessment amount is commensurate with the estimated special benefit of the Removal Expense to the Property. Owner hereby covenants with the City not to appeal or sue the City for a court to set aside, reduce, repeal, or invalidate the assessment, or for other relief from the payment of the City’s assessment up to the assessment amount against the Property for the Removal Expense. E. If the Removal Expense is $10,000.00 or less, the resulting assessments shall be paid over a period of five years, but if the Removal Expense is over $10,000.00, the assessment shall be paid over a ten-year period. In addition, interest shall accrue on the unpaid assessment at a rate equal to the interest rate applied by the City for other assessments in the year the work is performed. If no such assessments are certified for other properties in the City during that year, the interest rate shall be equal to the interest rate imposed on the most recent assessment certified by the City. Where reference is made herein to Owner, reference shall be to Owner, its successors and assigns as to the Property and the rights and obligations hereunder shall run with the land and shall burden the Property and all subsequent Owners thereof and City shall record this Agreement on the public property records to provide notice of this agreement and all obligations hereunder to subsequent Owners of the Property. G. Owner shall indemnify and hold harmless City for any damages or claims resulting from the Original Service Lines remaining connected and in place pursuant to this Agreement except to the extent such damages or claims result from the gross negligence or willful misconduct of the City or its employees, agents, officers, officials, or contractors. H. This Agreement shall be construed and enforced in accordance with the laws of the State of Minnesota and any dispute shall be venued in the Dakota County District Court. Background Information: The applicants are proposing to rent e-bikes from their home over the current biking season. Home Occupation Home based businesses that utilize a garage, have employees working at the home not residing at the home, or that have more than one customer visit at a time are required to get a Type II Home Occupation License. These type II Home Occupation Licenses require review by the Planning Commission and City Council. This proposed home occupation will be utilizing the garage. The applicants are not anticipating multiple groups of customers at the property at a single time, but they would certainly have multiple cars parked and bikes rented out to multiple parties. The intended hours for the rental operation are proposed to be 8:00 am to 8:00 pm., seven days per week. Customers will often come to the property to pick up the rented e-bikes. Applicable Regulations The following are requirements of home occupations that must be followed in addition to any conditions placed on approval. If any of the provisions are violated, the City Council has the right to revoke the license. (a) Exterior alterations or modifications that change the residential character or appearance of the dwelling, any accessory buildings, or the property itself for the purpose of a home occupation shall be prohibited. (b) Exterior display or storage of equipment or materials related to the home occupation is prohibited. No article for sale shall be visible from the street. (c) There shall be no indication of offensive noise, vibration, smoke dust, odors, heat, or glare at or beyond the property line. (d) The home occupation shall be conducted indoors and shall be clearly incidental and subordinate to its use for residential purposes by its occupants. (e) The use shall not generate sewage of a nature or rate greater than normally associated with a residential occupancy nor shall it generate hazardous waste or solid wastes at a rate greater than that normally associated with residential occupancy. Outside Employees No outside employees are proposed to work at the site. Access and Parking The applicants intend to meet large groups off site with the bikes by trailer. They have six off street parking spaces on the subject property and anticipate about one to three customer vehicles at a time on a busy day. Additionally, a file sharing and transfer system is in place to process, transfer and/or share criminal justice data with courts, jail services, probation, and social services, just to name a few. Over the last few years, discussions took place with Dakota County and board members to move CJN from being a subset of Dakota County and make it a separate JPA organization. The Hastings City Council approved the new JPA on December 20, 2021. In late May 2022, the Dakota County Attorney’s Office sent the attached Termination Agreement to end the services agreement under the prior CJN JPA. County and Agency are individually referred to as a “Party” and collectively as the “Parties.” WHEREAS, the Parties entered into a contract for County to provide Agency with certain criminal justice system services, dated July 25, 2008, referred to as County Contract # C0021713 (the "Contract"); and WHEREAS, the County program that provided Agency with the criminal justice system services is now a separate joint powers organization, formed pursuant to Minn. Stat. § 471.59, known as the Criminal Justice Network (“CJN JPO”); and WHEREAS, the County no longer provides such services, and all future services will be provided to Agency by the CJN JPO, subject to the terms of an agreement between Agency and the CJN JPO (“New CJN Agreement”); and WHEREAS, the Parties desire to terminate the Contract on the terms and subject to the conditions set forth herein. ACCORDINGLY, the Parties agree: 1. Termination of the Contract. (a) The Parties mutually agree that the Contract, which is attached hereto as Exhibit 1, is hereby terminated effective on the date the last Party executes this Termination Agreement or the date on which Agency and CJN JPO execute the New CJN Agreement, whichever date comes first (the "Termination Date"). From and after the Termination Date, the Contract will be of no further force or effect, and the rights and obligations of each of the Parties thereunder shall terminate, except for any rights and obligations of the Parties that are expressly designated to survive the termination of the Contract. (b) Notwithstanding the Contract provision that states that County will return Agency Data to Agency upon termination, the Parties agree that County will not return Agency Data upon the Termination Date. Agency agrees that County will transfer the Agency Data to the CJN JPO for continuity of services. 2. Consideration. The County acknowledges and agrees that it has already received all amounts owed from Agency under the Contract and that no additional consideration of any kind is due the County with respect to the Contract. 3. Representations and Warranties. Each Party hereby represents and warrants to the other Party that: (a) the execution and delivery of this Termination Agreement is the duly authorized and binding act of the Party, and that the Party’s signatory is duly authorized to execute this Termination Agreement on behalf of the Party; and (b) it knows of no claims against the other Party relating to or arising out of the Contract; and has neither assigned nor transferred any claims regarding the Contract to any person or entity and no person or entity has subrogated to or has any interest or rights in any claims. 4. Miscellaneous. (a) All notices, requests, consents, claims, demands, waivers, summons, and other legal process, and other similar types of communications hereunder (each, a "Notice") must be in writing and addressed to the relevant Party at the address set forth on the signature page. All Notices must be delivered by personal delivery, nationally recognized overnight courier (with all fees pre-paid), or certified or registered mail (in each case, return receipt requested, postage prepaid). A Notice is effective only (i) upon receipt by the receiving Party and (ii) if the Party giving the Notice has complied with the requirements of this Section 4(a). (b) The laws of Minnesota govern all matters related to this Termination Agreement, without giving effect to the principles of conflict of law. Venue and jurisdiction for any litigation related to this Termination Agreement must be in those courts located within Dakota County, State of Minnesota or U.S. District Court, District of Minnesota. (c) This Termination Agreement and each of the terms and provisions hereof may only be amended, modified, waived, or supplemented by an agreement in writing signed by each Party. Background Information: Rivertown Days has been a successful community event for over 40 years and the Hastings Area Chamber of Commerce & Tourism Bureau has made a request to have July 15 – 17 designated as a special event. The 2022 event layout is the same as 2021. Management Staff have been working with the Rivertown Days Committee and are supportive of the event. City Staff are supportive with the following conditions: • Traffic Management Plan submitted by Vendor/Chamber President for City Staff review. • Detour route and trailblazing implemented using third party traffic control vendor for deliver, setup and takedown. • Traffic control/sign vendor to provide metal fencing similar to 2021. Fencing will run along Tyler St. from the Mississippi River up to 2nd Street. Additional fencing available to fill areas that are not blocked by a stage or entrance tent. An easily movable barricade near the small stage on Sibley St. to block foot traffic but allow EMT access if necessary. Barricades at ally behind Lock & Dam and one behind Hastings Social Tavern to deter alcohol beyond boundaries. • Signage at both ends of 2nd St., mid-block 2nd-3rd on Sibley and Ramsey be similar in size/visibility used for last summer’s downtown closures. ‘Road Closed Ahead’ signs at Vermillion/3rd, 4th/Sibley, 4th/Ramsey, and warning on Tyler both north and south of 2nd St. ‘No Right Turn’ sign on frontage road just prior to 2nd St. and ‘No Right Turn’ and ‘No Left Turn’ sign north and south of 2nd St. E. on Tyler Street. • Advance notification to traveling public required along 2nd St. on approaches to closure area (example: This road closed for event July 15-17th) • Accessible parking spots to be identified and posted by RTD Committee. • Access to and egress from the alcohol service areas must be staffed with private security personnel at all times during service hours. Security personnel need not be uniformed but must wear something that identifies them as SECURITY. Security personnel may be employees of the event’s liquor license or volunteer staff. • Security personnel are expected to immediately report to the Hastings Police Department any traffic safety issues, disorderly conduct, or criminal behavior that may affect the safety of the event staff, attendees, or surrounding community. VIII-10 • Identification checks must be made to ensure with the Minnesota alcohol consumption possession statutes. Beer tent hours will be 5:00 – 11:00 p.m. on Friday, and 11:00 a.m. – 11:00 p.m. on Saturday. Last call at 10:30 p.m. on Friday and Saturday. • Only alcoholic beverages allowed outside the bar/restaurant spaces from Chamber beer tent. List of beverages provided to Police Dept. prior to the event. • Alcoholic beverages are not permitted to leave Rivertown Days boundaries. • Proof of insurance for the temporary liquor sales must be received by City staff in advance of the event. • Tent inspection by the Fire/EMS Department to address proper safety items in advance of the event. • Stages taken down by event volunteers after event Saturday night to allow space for car show on Sunday. • Car show volunteers will hand out flyers at the June 19th Car Show explaining Rivertown Days and requirement of cars to register to reserve a spot. Car must stay the full event to avoid traffic in the event area. • Public Works Department staff check electrical outlets at Jaycee Park prior to RTD weekend for craft fair and food vendors. • Public works department to provide water access for food vendors and the carnival at Levee Park from hydrants. Public Works and RTD staff identify hydrants prior. • Public Works to mow and mark off the grassy area past the boat launch in Jaycee Park for additional parking. • Parks Department connect with Mosquito Control District to spray for mosquitos in Jaycee and Levee Park before RTD weekend. • Parks Department to mow private property adjacent to Levee Park the Monday of Rivertown Days weekend, prior to carnival set up. • Parks Department will provide delivery and pickup of picnic tables to Jaycee Park and Levee Park. • Parks Department will check garbage/recycling for pickup throughout Jaycee Park, Levee Park and City owned receptacles in downtown area in the morning and afternoon, July 15-17. Event volunteers to empty garages/recycling in the evenings, July 15-16. • Any additional coordination with City Staff as requested to ensure a successful event. 2022 conditions based off previous year: • Event coordinators ensure there are way finding signs on Tyler St. and behind the Legion to identify entrances. • Security member positions in the alley behind Lock and Dam Eatery. • Police Department requests two golf carts for shuttling police reserves. Background Information: The American Cancer Society’s event planners are requesting use of the Rotary Pavilion, Amphitheater and surrounding area at Levee Park to host a Relay for Life event, ‘Party on the River’ encompassing a similar footprint that was approved in 2021. The event will include: live music, food & beer tent, luminary bags, kids’ activities, & silent auction. Anticipated attendance is 250 people. The application and event map are included for City Council review. Since 2017, the American Cancer Society has held their Relay for Life event at Levee Park and it has been a success. City Staff are supportive based on the following conditions: • All vendors must obtain a vendor license prior to the event, the cost of the licensure is the responsibility of the event organizer or vendor. Licenses can be obtained through the Deputy City Clerk. • American Cancer Society to provide an Insurance Certificate naming the City as an additional insured. • Written confirmation for use of land to host a portion of event activities provided by event coordinator, from private property owner. • Access to and egress from the alcohol service areas must be staffed with private security personnel at all times during service hours. June 6, 2022 Special Event Designation & Temporary Liquor License – Relay for Life VIII-11 • On the attached map, event organizers indicate the Relay for Life walk utilizing a portion of the Mississippi River Trail. The trail will remain open to the public and walkers will be in small sporadic groups, allowing for regular use of the Trail. • City restroom facilities will remain open but will not be staffed by City personnel. Staff will clean restroom facilities prior to the event and provide a key to event representative for stocking bathroom supplies as needed. • Portable toilets are recommended to be placed on-site to alleviate over-use of the indoor bathrooms. • Event organizers are required to work with a hauler for trash and recycling containers on-site. Containers must be paired side-by-side and visually labeled as Trash and Recycling. All garbage generated from the event will be hauled off site by event organizers in coordination with their hauler. • Any tent or additional “structures” used within the park will need to be anchored with weights. No stakes due to underground irrigation and bedrock. • Decorations must be adhered with rope, zip ties or other materials that does not leave a mark on the facilities. • No unauthorized vehicles on City trails or parked in Levee Park. • All event supplies and equipment will be removed by event organizers directly following the end of the event. • Event organizers agree the site will be left in at least the condition it was pre- event. • Any other reasonable conditions as determined by staff to ensure a successful event. Background Information: Hastings Golf Club is requesting to hold a 4th of July Parade starting 6:30 at p.m. on 15th Street from west of General Sieben to Westview Drive and fireworks at 10:00 p.m. at Hastings Golf Club. This is a free event and open to the public. Hastings Golf Club expects 2,000 attendees for the event. City Staff are supportive of the event with the following conditions: Event organizer will obtain a Fireworks permit application and submit to the Fire Marshal prior to the event. Event organizers will coordinate temporary traffic control and post appropriate signage on parade route. Traffic management plan submitted by Vendor/reviewed by City Staff. Third party traffic control vendor will be utilized for delivery, setup and takedown along parade route. Way finding signs will be utilized for any detours that are needed due to parade. Homes affected by parade routes will be contacted prior to event to make aware of road closures. Seller agrees that if Seller fails to provide such information then Seller will pay a Commission to Brindlee as if the buyer of the Apparatus was a Referral referred by Brindlee and the Apparatus was sold at the List Price. Seller may advertise and sell the vehicle on its own and if the District’s advertisement shall result in the sale of the vehicle to a buyer not previously referred by Brindlee, no commission shall be due to Brindlee. Either party may terminate this Agreement at any time by notifying the other party in writing. If any sale of the Apparatus takes place to a Referral previously referred by Brindlee within one year subsequent to termination of this Agreement, Seller shall pay the same Commission to Brindlee as would have been paid if this Agreement had not been terminated. Seller agrees that Brindlee may list, market and sell other fire apparatus to prospective buyers who are interested in the Apparatus, including but not limited to fire apparatus owned by Brindlee. Council Action Requested: Consider the following actions related to the request of Shane Hudella owner of 15213 Ravenna Trail to appeal the decision of an administrative official (Building Official Travis Dunn) that a cable rail fence constructed around a swimming pool is climbable and in violation of Hastings City Code Section 155.05, Subd. F.4: 1) Remove action from the table 2) Adopt the attached resolution affirming the determination by staff The City Council acts as the Board of Adjustment and Appeals in considering the request. Reversal of a decision by an administrative official requires the support of six of seven councilmembers. Prior City Council Action: The City Council reviewed the appeal on May 16, 2022. Councilmembers discussed the subjectivity of the ordinance, review process for fences, and ordinances in other cities. The Council discussed having further guidance on the definition of climbability by the Department of Labor and Industry and tabled the request. Definition of Climbable: Staff contacted the Minnesota Department of Labor and Industry (DOLI) seeking further information on how to interpret the definition of climbability. DOLI responded that since the definition is not specifically related to Minnesota State Building Code they could not provide further direction. Minnesota Administrative Rules, Chapter 1300.0070 (Building Code - Definitions) does not provide a specific definition for “climbable”. For terms that are not specifically defined, Minnesota Rules states the Merriam-Webster Collegiate Dictionary shall be considered as providing ordinarily accepted meanings. Merriam-Webster does not specifically define climbable but offers a number of different definitions of climb, the most applicable appears to be “to upward or raise oneself especially by grasping or clutching with the hands”. X-C-01 Board of Adjustment and Appeals: City Code Chapter 30.02 establishes the Board of Adjustment and Appeals, designating the City Council to act as the Board. Subd. G – establishes the parameters for reversing the decision of an administrative official as follows: In exercising the above mentioned powers, the Board of Adjustment may, so long as the action is in conformity with the terms of the provisions of the City Code, reverse or affirm, wholly or partly, or may modify the order, requirement, decision, or determination appealed from and may make the order, requirement, decision, or determination as ought to be made and to that end shall have the powers of the administrative official from whom the appeal is taken. The concerting vote of 75% of the entire Board shall be necessary to reverse any order, requirement, decision, or determination of the administrative official, or to decide in favor of the applicant on any matter upon which it is required to pass under provisions of the City Code including special use permits or to effect any variation in the application of Chapter 155. City Code Regulation: Hastings City Code Section 155.05, Subd. F.4 regulates the placement of fences within the Zoning Code and states the following: Height restrictions. The maximum height of any fence installed within a residential zoning district of the City of Hastings is 6 feet; however, fences installed within the front yard are limited to a maximum height of 3.5 feet or 42 inches. Fences installed around swimming pools from ground up must be a minimum of 4 feet high and non-climbable with a self-closing, self-latching gate. Maximum height of all fences shall be in compliance with the city zoning code or as approved by the Planning Commission. Background Information: Performance Pools and Spas (PPS) applied for a building permit to construct an in-ground pool and fence on behalf of Mr. Hudella on 2/17/21. The permit identified the placement of the pool and fence, but did not indicate that the fence would be cable railed (an aluminum fence was shown). The permit was issued on 2/24/21. Via a 7/27/21 email Mr. Hudella stated he would be installing the fence instead of PPS. On 10/5/21 Building Inspector Craig Schultz inspected the fence and determined it did not meet City Code because it was climbable. Via a 10/13/21 email Building Official Dunn concurred with Inspector Schultz’s assertion that the fence was climbable and did not meet City Code. Email correspondence between the City and Mr. Hudella pertaining to the permit and violation is attached to this report. Appellant argues that the pool has a lockable cover, however, this does not negate the requirement that the fence be non-climbable. It has been found that lockable covers are not fool-proof and wear out over time or are left unlocked, leaving them accessible. Appellant Position In the attached email communication with Mr. Hudella he contends the following: - 3 residences in town that were not required to even have a fence with the type of lockable heavy duty auto-cover that we have. X-C-01 - Letters from several commercial contracting companies such as Ryan Co explaining that cable rail systems are still widely accepted and considered no more climbable than chain link. - Email traffic where I offered to submit plans on the fence, an was told I didn’t need to, just to ensure the fence was 48” high with self-closing gates, which I did. No further information was received from Mr. Hudella prior to release of this report. Staff Determination Staff’s position is that the cable rail fence is climbable and therefore in violation of Hastings City Code Section 155.05, Subd. F.4. The intent of this requirement is to prevent injury to children who may attempt to access the pool by either scaling the fence, or squeezing between the cable rails. The tension of the cable wires may loosen over time easing ability to access the site an\or posing a choking hazard for children that may get caught between wires. Acceptable Modifications to Existing Fence Staff has discussed with Mr. Hudella potential modifications to the fence to meet ordinance requirements. Mr. Hudella could utilize the existing fence post, install a rigid top and bottom rail and affix a non-climbable chain link mesh fence. In reviewing options for the pool fence there are two possibilities. 1) You have the option of appealing the decision of a staff member to the City Council who serves as the Board of Adjustment and Appeals. Staff contends that your fence does not meet the non‐climbable provision of City Code; you could ask City Council to overrule staff’s decision to find the fence non‐climbable. In my 20 years at X-C-01 2 the City we’ve had less than five of these type of decisions before the Council, and I don’t’ believe the Council has overruled staff. 2) Modify the existing fence. At the end of the day I want to do right / play by the rules with the city but I feel really strongly on this one too, other pools with this type of auto‐cover haven’t even been required to have fencing in the past, and I do think mine meets code with the cabling being 3.5 inches apart.
