HomeMy WebLinkAbout04/27/81 MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, APRIL 27, 1981 7:30 P. M. The meeting was called to order at 7:30 by acting Chairman Murphy. Members Present: Commissioners Murl~hy, SLevens, Von Feldt, Reuter, Bultman, Kunkel, and Freiermuth. Members Absent: Commissioners Wendler and Simacek. Moved by Commissioner Reuter, seconded by Commissioner Stevens to approve the minutes of the April 13, 1981 Planning Commission Meeting. 7 Ayes, 0 Alayes. APPROVAL OF MINUTES Acting Chairman Murphy opened the Public Hearing at 7:31 P.M. The Planner indicated that on file was a Certificate of Mailing, notice of Public Hearing, that he had not yet received the affidavit of publication, but assumed that the notice had been properly published. Therefore the Public Hearing was properly called. PUBLIC HEARING PRE- LIMINARY PLAT HIGH- HILLS ~qD ADDITION Commissioner Freiermuth questioned whether the fire safety questions had been resolved the Planner indicated that after checking with the Fire Chief, the concerns about the fire hydrant distance would b~ resolved in the construction program, but that the fire chief was concerned of the length of the dead end street Brittany Trail, and that he was concerned about the similarity in names of some 6f the streets with other streets in the community. Mr. Siewert indicated that the street names could be changed. Mr. Merl Botchers questioned the size of lot and type of homes proposed to be built. The Planner explained the lot size requirements, and that the lots met those minimum standards. Mr Siewert indicated that the homes would be sim'ilar to those being constructed in the area presently. Minutes-Hastings Planning Commission Meeting, Cont. -2- Additional questions were asked about how homes would be built on the slopes of the hills, drainage, and the construction of walk ways in the plats. After all people present had an opportunity to be heard on the matter, acting Chairman Murphy closed the Public Hearing at 7:50 p.m. Moved by Commissioner Freiermuth seconded by Commissioner Bultman to approve the Preliminary Plat conditioned upon the items in the Staff reports, and that the issue of outstanding "buy-in" fees be resolved before the final plat is approved. 7 Ayes, 0 Hayes. The Planner explained that filling stations are special uses in C-3 zoning districts. The proposed use is a convenien~ store with gas pumps. Gas pumps require the Special Use Permit. Commission members questioned whether fill was needed and if there were problems with limitations of number of stations in a community. Mr. Landks Iverson, a representative of the petitioners, indicated that fill was-~necessary and that there is no allocation system for gasoline, and no limitations on the number gas stations. The mayor was in the audience, and asked who would be the owners of the facility. Mr. Iverson indicated that a group of investers would ownthe business. Mr. Don Maderich stated that he was the owner of the Tom Thumb Store and that he felt there were enough gas stations and grocery stores in this town. He felt that any additional stores would adversly effect existing stores. The Planner explained to the Planning Commission that while the city has a responsibility to try to protect the economic interest of the community in general in setting up its zoning district boundaries, that the city really could not regulate competition between individual businesses within zoning districts. Moved by Commissioner Freiermuth seconded by Commissioner to schedule a Public Hearing for the Special Use Permit for the May 11, 1981 Planning Commission Meeting. 7 Ayes, 0 Hayes. The Planner explained that the matter was before the Planning Commission as the Board of Design Control. He informed the Planning Commission that he felt the proposed metal structure to house the emergency generator for the Dakota County Jail was, due to its building materials and design, so dissimilar to the structures in the area as to potentially cause adverse impacts on those properties, and that the structure should be constructed out of more compatible materials. The architect for the county informed the ]Planning Commission that the structure would only be used ten~porarily_until the Coun. ty Ja~il was phased out of operation. There was considerable discussion about the advantages and disadvantages of the proposed structure. Moved by Commissioner Freiermuth seconded by Commissioner Bultman to approve the preposed building and materials, provided that the exterior of the structure would blend in with the color and appeara~ce of surrounding str~ctures, and that the County building superintendant ask the County Board to agree to remove the structure and generator upon the discontinuance of the building as the Dakota County Jail. 6 Ayes, Stevens Alaye. The Planner indicated that there were also considerations of adding fire e~scapes to the building which would be enclosed by cyclone fencing and metal roofs. He asked if the Planning Commission cared to review the building plans prior to the issuance of a building permit. Moved by Commis~q. oner Von Feldt seconded by Commissioner Freiermuth to leave the question to the Planners discretion. 7 Ayes, 0 Nayes.
