Members Present: Commissioners Wendler, Stevens, Von Feldt, Reuter, Bultman, Kunkel, Preiermuth, and Murphy. Members Absent: Commissi oner Simacek. Moved by Commissioner Murphy, seconded by Commissioner Freiermuth to approve the Minutes of the April 27, 1981 Planning Commission with the correction of a typographical error in the last para- graph of the second page. 8 Ayes, 0 Nayes. APPROVAL OF MINUTES Chairman Wendler opened the Public Hearing at 7:32 p.m. The Planner had on f~le a Certificate of Mailing, notice of Public Hearing, and Affidavit of Publication. Thus, the Public Hearing was properly called. The Planner then went on tm inform the Planning Commission that certain Site Plan deficencies brought out by the last Staff Report had been correcte-d, and recommended that the Planning Commission consider the matter based upon the proposed developments ~ffect on th&,surroanding area, rather than its potential impact upon the competition between gasolin~ stations in the community. PUBLIC HEARING SPECIAL USE PERMIT CONVENIENG'E STORE WITH GAS PUMPS- 23RD & VERMILLION- STREETS SUPER STORE, INC. Mr. Bill Birchin stated that he did not feel that the city coul'd support another gas station. He presented a report from the State Department of Revenue that indicated that gasoline consumption was down oirer previous years. Mr. Dan Waters, the manager of the Arco Station told the Planning Commission that he felt this proposed use would not benefit the City of Hastings, as he understood that the profits would be transfered to Wisconsin. Mr. Land~s Iverson, a petitioner indicated that this was a Minnesota Corpor- ation. Mr. Brian Ettesvold, the Executive Director of the Minnesota Service Station Association informed the Planning Commission that while there has not Minute s-Hastings l~lanning Commission Meetings, cont. -3- The Planner explained that tke proposal met all zoning requirements, with a possible exception of being short of one (1) parking stall depending upon the interpretation of the question. He suggested that the parking might be considered to be adequate given the circumstances. He also stated that additional screening should be provided along the east edge of the parking lot. Mr. Kunkel, representing the petitioners, indicated that this would be provided. Moved by Commissioner Murphy, seconded by Commissioner Freiermuth to approve the Site Plan conditioned upon the owners arranging for the provision of additional parking spaces if the need becomes apparent. 7 Ayes, Kunkel abstaining The Duplex would be permitted in this zoning district. The request was for a Variance for the c~)mmon iV~ll property line. Mr. Charles Clark, a neighbor asked the Planning Commission to require private ownership of the units as part of their approval. The Planner stated that he did not believe the City could make that requirem~mt. Moved by Commissioner Freiermuth, seconded by Commissioner Kunkel to approve the Zero Side Yard Setback Variance conditioned upon ~J~6 buildiDg being elevated, and that the develope: comply with other staff requirements at the time of building permit approval. 7 Ayes, Bultman abstaining. The Planner showed the Planning Commission what had been approved a~ a change in the private Open Space Improvements for the Whispering Oaks Town House Development. Moved by Commissioner Freiermuth, seconded by Commissioner Murphy to adjourn at 8:44 p. m. 8 Ayes, 0 Nayes. May 11, 1981 SITE PLAN REVIEW PARKING LOT CONST~ FOR LAW OFFICE BUILDING SOUTHEAST CORNER OF 7TH & VERMILLION STREET VARIANCE REQUEST ZERO SID3~ YARD SETBACK IN MINOR SUBDIVISION FOR A DUPLEX SOUTH SIDE OF 23RD STREET BETWEEN CANNON & VERMILLION STREETS WHISPERING OAKS RE- CREATIONAL AND OPEN SPACE IMPROVEMENTS ADJOURNMENT Minutes-Hastings Planning Commission Meeting, cont. -2- been any allocation system for gasoline supplies in efiect since the Governments decontrol of the oil industry, prior to that decontrol the U. S. Department of Energy did deny a number of requests for al]0~ations to new stations because of the number of outlets in area. He did not indicate that this had ocurred in Hastings. He went on to say that it appeared to him that the development of this proposed convenience store and gas station would cause a parking shortage for Mr. C's Pizza Parlour, as patrons presently use this property to park while at the Pizza Parlour. He also stated that he felt the Planning Commission should consider the fact that ~ock ~onditions in the area may cause some construction problems for the proposed development. The discussion continued into various aspects of parking den~and and physical constraints. Mr. Bill B~l-rchin indicated that with the construction of the medians and turning lanes on that segment of Highway 61, he felt the proposed development would create traffic pro]~lems at the intersection. .~fter all people present had an opportunity to be heard on the matter, Chairman Wendler closed the Public Hearing at 8:06 p. m. Moved by Commissioner Von Feldt seconded by Commissioner Bultman to deny the Special Use Permit Request based upon the definition of a Special Use Permit in the Zonir~ Ordinance, that the proposed use would, based upon the testimony presented at the Public Hearing affect the prosperity 'or general welfare of the comm- unity, and affect the safety of the area, because of increase traffic at the intersection. 4 Ayes, Bultman, Murphy, Naye.
