HomeMy WebLinkAbout11/09/81MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, NOVEMBER 9, 1981 7:30 P.M. The meeting was called to order at 7:30 P.M. by Chairman Wendler. Members Present: Member Absent: Commissioners Wendler, Von Feldt, Reuter, Bultman, Simacek and Murphy. Commissioners Stevens, Kunkel and Freiermuth. Moved by Commissioner Murphy, seconded by Commissioner Simacek to approve the minutes of the October 26, 1981 Planning Commission Meeting, with an amendment to the motion on the approval of minutes to state that the motion was made by Commissioner Murphy and seconded by Commissioner Reuter. 6 Ayes 0 Nayes. ' APPROVAL OF MINUTES Chairman Wendler opened the Public Hearing at 7:32 P.M. The Planner informed the Commission that on file were the copies of the Notice of Public Hearing and Certificate of Mailing. While an Affidavit of Publication was not on file, the notice had been properly advertised. Thus the Public Hearing was properly called. The Planner went over additional information that had been provided since the last meeting. Mr. Reuter also explained his proposal in greater detail, indicating that the garage placements could change, and that he would return to the Planning Commission with any changes. PUBLIC HEARING - PLANN- ED RESIDENTIAL DEVELOP- MENT PERMIT AND PRE- LIMINARY PLAT SCHUMACHER 1ST ADDITION WEST 4TH STREET & WHISPERING LANE - PAUL REUTER Eleanor Liska, a resident in the area stated that she felt there were many questions yet unanswered. She also stated that there was nothing concrete in the way of development plans to go by. Commissioner Wendler respond- ed that the plans appeared fairly complete to him. Mr. Bob Liska stated that two re- quests had been made at the last meeting. One was for more detail to the drawings, and the other was that he still did not feel that the plat should even be considered at this time since he felt the terms of the Council's motion in tabling the request in 1978 had not been complied with. Mr. Liska later stated that he felt better assurances in writing, including studies with scientific data would be necessary to resolve his fears about the proposed development. Mrs. Liska again added that she would not feel c0mfortahle about the proposed development unless she received complete assurance that the development would not harm them. Cormmissioner Reuter asked if the site plan showed the required number of parking stalls. The Planner responded that the site plan did not do this, but that in the past the drive- way has been considered to be an additional parking stall, although not in a building of this size. After all people present had an opportunity to be heard on the matter, Chairman Wendler closed the Public Hearing at 8:09 P.M. Moved by Commissioner Von Feldt, seconded by Commissioner Murphy to recommend approval of the Planned Residential Development Permit, Preliminary Plat, Variance from 10.07 Subdivision 6 of the City Code which requires 5 five acres of land for a PRD, and Variance from Section 10.07 Subdivision 6 of the City Code which requires that apartment garage doors not face the street, and a Variance from the required 30 foot setback for lots 1 & 2. This approval based upon the feeling that the proposal does meet the intent of the ordinance, that the variances would not harm the public interest, and conditioned upon a letter from Mr. Reuter indicating what land- scaping would be provided as a minimum, a letter of assurance from Mr. Reuter that con- struction will conform to the plat drawings, and that any changes of other than a minor nature would have to be brought back before the Planning Commission for site plan approval. 4 Ayes, Reuter, Bultman Naye. The Planner stated that his recommendation was to deny the request, as no hardship appeared to be demonstrated. Representatives from Thorp and the sign company stated that they felt the test requirements for a variance had been met with this proposal. It was stated they felt that it would not be unreasonable to grant the variance~ since the existing sign support presented a unique case in their opinion. Moved by Commissioner Reuter, sec- onded by Commissioner Bultman to recommend approval of the variance request. 5 Ayes, Simacek Nay. Moved by Commissioner Reuter, seconded by Commissioner Murphy to adjourn at 8:22 P.M. 6 Ayes, 0 Nayes. VARIANCE SIGN IN RIGHT- OF-WAY - 311 EAST 2ND STREET - THORP FINANCIAL SERVICES ADJOURNMENT Paul Reuter, the developer, made comments to the effect that the proposed development should not change the existing conditions. Mrs. Audrey Ceran stated that she agreed with Mrs. Liska. Mr. Liska stated that he felt the procedure being followed should be challenged by the Planning Commission. Mrs. Betty Tingquist asked who controlled the developers conformance with the Plan. The Planner then explained the building permit in- spection process. Mr. W. Hartmann stated that he felt the City has absolute responsibility to ensure that a project is built exactly to the specifications shown on plans presented to the City. After all people present had an opportunity to be heard on the matter, Chairman Wendler closed the Public Hearing at 8:48 P.M. Moved by Commissioner Simacek, seconded by Comm- issioner Stevens to table the request until Mr. Reuter had provided the information requested by the Planning Commission at their last meeting. 7 Ayes, 0 Nayes. Moved by Commissioner Reuter, seconded by Comm- issioner Simacek to continue the Public Hearing, with additional published notice regarding Mr. Reuter's request until the next Planning Comm- ission Me,ting. 7 Ayes, 0 Nayes. Commissioner Murphy gave the committee report which stated that the committee felt that the proposed use was consistent with the intent of the Industrial Park, and that it would be an approp- riate location for such a use. The committee recommended that the ordinance be amended to per- mit such uses. The Planner stated the specific wording of an ord- inance amendment had not yet been arrived at. Moved by Commissioner Murphy, seconded by Comm- issioner Kunkel to recommend to the City Council that the use of building material sales be per- mitted in the Industrial Park zoning district. 6Ayes, Reuter Naye.
